CIRCULAR
Guidelines for determining unit prices of machinery and equipment for mine clearance operations
and explosive ordnance disposal

Based on Decree No. 164/2017/NĐ-CP dated December 30, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;
Pursuant to Decree No. 18/2019/NĐ-CP dated February 1, 2019 of the Government on Management and Implementation of Activities to Address the Consequences of Explosive Ordnance After War;
At the proposal of the Commander of the Engineering Corps;
The Minister of National Defense promulgates this Circular hguiding the determination of unit prices of machinery and equipment for mine clearance and explosive ordnance disposal.
Article 1. Scope of Regulation
This Circular guides the determination of unit prices of machinery and equipment for mine clearance and explosive ordnance disposal serving the preparation of budget estimates and settlement of accounts for mine clearance and explosive ordnance disposal activities.
Article 2. Applicability
Article 1. This Circular applies to units, organizations, and individuals related to the preparation of budget estimates and settlement of accounts for mine clearance and explosive ordnance disposal activities funded by state budget funds and non-budget state funds.
Article 2. It is encouraged for units, organizations, and individuals related to the preparation of budget estimates and settlement of accounts for mine clearance and explosive ordnance disposal activities funded by other sources to apply the provisions of this Circular to determine unit prices of machinery and equipment for mine clearance and explosive ordnance disposal.
Article 3. Principles for determining unit prices of machinery
Clause 1. Unit price of machinery is the average cost determined for one shift of work according to the regulations of machinery and equipment for mine clearance and explosive ordnance disposal.
Clause 2. The unit price of machinery is determined based on management requirements, usage of machinery and equipment for mine clearance and explosive ordnance disposal, consumption rates for calculating unit prices of machinery, and consistent with the budget estimate consumption rates for mine clearance and explosive ordnance disposal.
Clause 3. Unit prices of machinery and equipment for construction are the basis for preparing budget estimates and settlement of accounts for mine clearance and explosive ordnance disposal activities.
Clause 4. If unit prices of machinery and equipment for mine clearance and explosive ordnance disposal are determined within local construction unit prices, they shall be applied according to the local unit prices.
Article 4. Contents of unit prices of machinery
Clause 1. Unit prices of machinery include depreciation costs, repair costs, fuel and energy costs, labor costs for operation, and other costs as prescribed.
Clause 2. The contents of costs in unit prices of machinery are determined appropriately according to the type of machinery with the same technology, origin, and main technical indicators.
Article 5. Methods for determining unit prices of machinery
Clause 1. The procedure for determining unit prices of machinery is as follows:
a) Prepare a list of machinery and equipment for mine clearance and explosive ordnance disposal;
b) Determine basic information and data to serve the calculation of unit prices of machinery;
c) Calculate and determine unit prices of machinery according to consumption rates and basic data or according to rental unit prices of machinery.
Clause 2. Detailed methods for determining unit prices of machinery are specified in Appendix I attached to this Circular.
Clause 3. Consumption rates and basic data for determining unit prices of machinery are specified in Appendix II attached to this Circular.
Article 6. Management of unit prices of machinery
Clause 1. The Ministry of National Defense assigns the Engineering Corps Command to use the method for determining unit prices of machinery as guided in this Circular to determine and manage unit prices of machinery and guide units, organizations, and individuals to apply unit prices of machinery to prepare budget estimates and settlement of accounts for mine clearance and explosive ordnance disposal activities.
Clause 2. The project owner uses the unit prices of machinery issued by the Ministry of National Defense to determine unit prices of machinery in mine clearance and explosive ordnance disposal construction. In cases where types of machinery and equipment for construction have not been issued or have been issued but are not suitable for usage requirements and construction conditions, the project owner shall cooperate with consulting survey units and construction units to establish unit prices of machinery according to the principles and methods for determining unit prices of machinery stipulated in this Circular for each project and submit them to the competent authority for review.
Clause 3. In cases where it is necessary to lease construction equipment, the budget preparation unit has the responsibility to propose rental unit prices of machinery and equipment according to the principles and methods for determining unit prices of machinery stipulated in this Circular to prepare the budget and ensure the completeness and accuracy of the documentation submitted to the project owner and for approval by the competent authority.
Article 7. Transitional Provisions
Projects, components, and tasks of mine clearance and explosive ordnance disposal that have been approved by the competent authority for technical construction plans and budgets before the effective date of this Circular shall continue to implement unit prices of machinery and equipment for construction according to the approved technical construction plans and budgets.
Article 8. Effective Date
Article 1. This Circular takes effect from November 5, 2021.
Article 2. Decision No. 177/2005/QĐ-BQP dated November 4, 2005 of the Minister of National Defense on the issuance of the Table of Unit Prices of Machinery and Equipment for Mine Clearance and Explosive Ordnance Disposal; and Decision No. 80/2007/QĐ-BQP dated May 3, 2007 of the Minister of National Defense on the issuance of the Table of Unit Prices of Machinery and Equipment for Mine Clearance and Explosive Ordnance Disposal Underwater shall cease to be effective from the date this Circular takes effect.
3. In cases where legal normative documents cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new amended, supplemented, or replaced documents.
Article 9. Responsibility for implementation
The Commander of the Engineering Corps, heads of agencies, units, organizations, and individuals concerned are responsible for implementing this Circular./.
