PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;

Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;

Considering the proposal of the Minister, Head of the Office of the Government, and the Minister of Public Security,

DECISION:

Article 1. The list of state secrets classified as Top Secret of the Government, the Office of the Government includes:

1. Information, documents, projects of the Government,the Prime Minister implementing the national security strategy, the strategic defense plan for the country, plans to mobilize and respond to war;

2. Information, documents related to important internal and external policies of the Government that have not been or will not be announced;

3. Information, documents of the Government, the Prime Minister relating to the national strategic reserve, plans and overall supply situation of money, revenue and expenditure plans that have not been announced;

4. Reports of the Government, the Prime Minister on foreign affairs, national defense and security, organizational structure, personnel submitted to the Politburo, the Central Committee's Secretariat but not yet or will not be announced;

5. Other reports and documents using information and documents included in the list of state secrets classified as Top Secret of other agencies.

Article 2. The list of state secrets classified as Confidential of the Government, the Office of the Government includes:

1. Information, documents of the Government, the Prime Minister regarding negotiations and agreements with foreign countries and international organizations on politics, national defense, national security, economy, science and technology that have not been announced;

2. Reports of the Government, the Prime Minister on the current economic and social situation, finance, banking, foreign affairs, and national defense and security that have not been or will not be announced (except Article 1);

3. Figures on the budget estimates and final accounts of the State of the Government and the Prime Minister during the review and approval process, information and documents related to reports on plans, budgets, financial and monetary matters. Absolute figures on State budget revenues and expenditures. Figures on Vietnamese currency and foreign currency printing, issuance, and reserves; State price plans reported to the Government and the Prime Minister that have not been announced;

4. Plans of the Government on exporting and importing weapons and equipment for national defense and security;

5. Information, documents related to records, documents, minutes of meetings of the Government, the Prime Minister, and Deputy Prime Ministers that have not been or will not be announced;

6. Information, documents using Confidential information from other agencies.

Article 3. This Decision shall take effect fifteen days after its publication in the Official Gazette and shall replace Decision No. 338/TTg dated June 29, 1994 of the Prime Minister on the list of state secrets of the Office of the Government..

Article 4. The Minister, Head of the Office of the Government, and the Minister of Public Security are responsible for supervising the implementation of this Decision.

Article 5. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government agencies, Heads of agencies and organizations mentioned in Article 2 of the Law on Protection of State Secrets dated December 28, 2000, and Chairpersons of provincial People's Committees under the central government are responsible for implementing this Decision./.
