DECISION OF THE MINISTER OF TRADE

Regarding the supplementation of the regime of goods of the Kingdom of Cambodia transiting through the territory of Vietnam issued together with Decision No. 1162/TM-XNK dated September 20, 1994

THE MINISTER OF TRADE

On the basis of the Agreement to amend and supplement certain clauses of the Agreement on the Transit of Goods between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia signed on April 3, 1994;

On the basis of Clause 3, Article 26, Chapter V, Decree No. 33/CP dated April 19, 1994 of the Government on state management over export and import activities;

After reaching consensus with the General Department of Customs;

 

DECISION:

Article 1. Supplementing Clause 2.1, Point 2, Part I:

1 - Regarding permission for transit of goods:

In order to facilitate Cambodian enterprises, the following transit cases do not require a transit cargo transport permit from the Export-Import Permit Office under the Ministry of Trade:

1.1 - Transit of goods from one region of Cambodia to another region of Cambodia via the following border gates:

Bu Porang (Dak Lak) - O Raing (Mondulkiri) on Route 14.

Le Thanh (Gia Lai) - An Dong Pech (Ratanakiri) on Route 19.

1.2 - Transit along the Mekong River via the Cuu Long (Tien) River.

Both cases above must comply with the following provisions:

a - The means of transport must travel directly, follow the designated route continuously, without unloading, loading, or transshipment. The driver must declare to the customs office at the border gate the goods transported on the means of transport according to international practice regarding transit goods.

b - The goods on the means of transport must be sealed and escorted by Vietnamese customs throughout the transit process through Vietnamese territory.

The General Department of Customs shall specify specific measures for supervision and management of Cambodian goods and means of transport transiting through Vietnam.

2 - Regarding prohibited exports and imports:

For goods listed in the prohibited export and import list, the transit regulations are as follows:

1 - Transit of goods strictly prohibited by international laws and practices is not permitted, specifically: narcotics, toxic chemicals, radioactive substances, wild animals, and rare flora and fauna.

2 - Transit of weapons, ammunition, explosives, and military technical equipment for national defense and security purposes requires a permit from the Minister of Trade.

3 - Transit of goods prohibited for export and import by Vietnam but not prohibited by Cambodia: Cambodian enterprises submit applications (as stipulated in the Regime of Goods of the Kingdom of Cambodia Transiting Through the Territory of Vietnam) to the Export-Import Permit Office (under the Ministry of Trade) located in Ho Chi Minh City (or Da Nang, Nha Trang, Can Tho). The Permit Office is responsible for reporting to the Ministry of Trade before issuing a transit permit for each shipment.

4 - Transit of timber shall be carried out in accordance with the guidelines of the Ministry of Forestry and the General Department of Customs.

Article 2 - Supplementing Point 2, Part I (regarding means of transport for transit goods):

1 - Means of transport for transit goods and escorts, as well as transshipment and transfer of means of transport, must comply with Vietnamese laws and be consistent with international laws and practices.

2 - Means of transport for transit goods in the cases specified in Point 1, Article 1 above, the Cambodian consignor may use their own means of transport, hire from a third country, or hire from Vietnam, but must comply with Vietnamese laws.

3 - Means of transport for transit goods in other cases, the Cambodian consignor must hire from Vietnam and comply with Vietnamese laws.

Article 3 - Supplementing Point 5, Part I (regarding transit border gates):

1 - Direct transit along the Mekong River via the Cuu Long (Tien) River through the following border gates:

Vinh Phuong - Tham Mau XCham Sam No - Coc Ro Ca "5. The pre-tax weighted average cost of capital i (%) is determined according to the formula below:(An Giang - Dong Thap) (Kam Kong - Pray Eng) O2 - Direct transit via land routes through the following border gates:

2.1 - Route 22A - Route 1 GMo Cay (Tay Ninh) Bavet (Svay Rieng) - Office of the President of the State2.2 - Route 14 - Route 14 VBu Porang (Dak Lak) O Raing (Mondolkiri)

2.3 - Route 19 - Route 19

Le Thanh (Gia Lai) An Dong Pech (Ratanakiri)

2.4 - Route 13 - Route 13 BBo Nue (Song Be) Xnul (Kratie)

- The functional departments of the Ministry of Trade are responsible for disseminating and guiding enterprises to implement this Decision.

- This Decision takes effect from the date of signature./.

ANNOUNCEMENT OF THE MINISTRY OF TRADE

Regarding the correction of Article 2, Point 2 of Decision No. 123/TM/XNK dated February 27, 1995 of the Minister of Trade on the supplementation of the regime of goods of the Kingdom of Cambodia transiting through the territory of Vietnam issued together with Decision No. 01160/TM/XNK dated April 20, 1994 of the Minister of Trade d.1. Amount of taxable income in Vietnam:In Article 2, Point 2 of the aforementioned Decision, it was stated: "Means of transport for transit goods in the cases specified in Point 1, Article 1 above, the Cambodian consignor may use their own means of transport, hire from Vietnam, or hire from a third country, but must comply with Vietnamese laws." It has been corrected to read: "Means of transport for transit goods in the cases specified in Article 1, Point 1.2 above, the Cambodian consignor may use their own means of transport, hire from Vietnam, or hire from a third country, but must comply with Vietnamese laws." Therefore, this means that only goods transiting along the Mekong River via the Cuu Long (Tien) River can be transported using means of transport hired from a third country. - Office of the President of the StateOther provisions in the aforementioned Decision remain unchanged./.

2.4 - Route Number 13 - Route Number 13

Bo Ne (Small River) Xnuol (Kratie)

Article 4 - The functional departments of the Ministry of Trade shall be responsible for disseminating and guiding enterprises to implement this Decision.

Article 5 - This Decision takes effect from the date of signature./.

 

NOTICE OF THE MINISTRY OF TRADE

Regarding the correction of Article 2 Point 2 of Decision No. 123/TM/XNK dated February 27, 1995 of the Minister of the Ministry of Trade on supplementing the regulations on goods of the Kingdom of Cambodia for transit through the territory of Vietnam issued with Decision No. 01160/TM/XNK dated April 20, 1994 of the Minister of the Ministry of Trade

In Article 2 Point 2 of the above Decision, it was stated: "Transport means for goods in transit in the cases specified in Point 1 of Article 1 herein, the Cambodian consignor may use transport means of their own country, lease from a third country, or lease from Vietnam but must comply with Vietnamese laws" which is corrected to read: "Transport means for goods in transit in the cases specified in Article 1 Point 1.2 herein, the Cambodian consignor may use transport means of their own country, lease from Vietnam, or lease from a third country but must comply with Vietnamese laws." This means that only goods in transit via the Mekong River - Hau River route can the Cambodian consignor use transport means of a third country.

Other provisions in the aforementioned Decision remain unchanged./.
