Pursuant to Decree No. 02/2025/NĐ-CP dated February 18, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to the Law on Legislative Activities 2015; the Law Amending and Supplementing Certain Provisions of the Law on Legislative Activities 2020;

Pursuant to the Law on People's Police 2018;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Department for Mass Mobilization for Security and Order Protection, Ministry of Public Security;

The Minister of Public Security issues this Circular stipulating residential areas, communes, wards, towns, agencies, enterprises, educational institutions meeting the standard "Safe in Security and Order".

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Thông tư này quy định chi tiết khoản 4 Điều 38 Luật Thủy sản số 18/2017/QH14 đã được sửa đổi, bổ sung tại điểm c khoản 21 Điều 14 Luật số 146/2025/QH15.

This Circular stipulates principles, criteria, procedures, formalities, authority for reviewing and recognizing residential areas, communes, wards, towns, agencies, enterprises, educational institutions meeting the standard "Safe in Security and Order".

Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.

a) Residential areas, communes, wards, towns;

b) Agencies (excluding armed forces agencies and units), enterprises (excluding small and micro enterprises), educational institutions (excluding primary schools, kindergartens, and nurseries);

c) Agencies, organizations, individuals related to the review and recognition of residential areas, communes, wards, towns, agencies, enterprises, educational institutions meeting the standard "Safe in Security and Order".

Article 2. Interpretation of Terms

In this Circular, the following terms are understood as follows:

1. "Residential area" is a place where people and households reside collectively within a defined area, which includes villages, hamlets, settlements, neighborhoods, and equivalent community units.

2. "Agency" includes state agencies, administrative agencies, public service units, political-social organizations, and occupational social organizations established and operating according to regulations of competent authorities and having offices that operate with state budget support.

3. "Enterprise" is an organization with its own name, assets, business premises, registered for establishment under the law with the aim of production and business.

4. "Educational institution" is an organization implementing educational activities within the national education system including schools and other educational facilities.

Article 3. General Principles

1. The review and recognition of residential areas, communes, wards, towns, agencies, enterprises, educational institutions meeting the standard "Safe in Security and Order" shall be conducted once a year.

2. The review and recognition of the standard "Safe in Security and Order" must ensure accuracy, transparency, democracy, and compliance with regulations.

3. The results of recognition as "Safe in Security and Order" serve as the basis for annual evaluation and commendation regarding the mass movement for national security protection; commendation and recognition of titles related to security and order.

Chapter II

SPECIFIC PROVISIONS

Article 4. Criteria for Recognizing Residential Areas Meeting the Standard "Safe in Security and Order"

A residential area will be recognized as meeting the standard "Safe in Security and Order" when it meets all of the following criteria:

1. In the first quarter of each year, the party branch has a resolution, and the residential area registers to strive for the standard "Safe in Security and Order"; 100% of households residing in the area register to participate in building a "Safe in Security and Order" residential area.

2. Fully implement the Party's guidelines and policies, state laws, and local regulations concerning security and order work.

3. Not allowing any of the following situations to occur:

a) Activities opposing the Party, the government, and undermining the unity of the entire people;

b) Activities destroying key economic, cultural, social, and national defense-security targets;

c) Propaganda and development of beliefs and religions contrary to the law;

d) Activities exploiting beliefs, religions, ethnicity, disputes, and complaints to complicate security and order;

đ) Activities advocating secession or autonomy;

e) Complex internal conflicts and disputes among the people;

g) Inciting, urging, coercing, enticing, bribing, or recruiting others to gather in large numbers to protest, disrupt public security and order, or exploit complaints to spread anti-state propaganda; infringing upon state interests; slandering, threatening, or insulting the reputation and honor of agencies, organizations, and responsible persons handling complaints and reports.

4. Effectively participating and cooperating in crime prevention, social evils, and other law violations in residential areas, including:

a) Controlling and reducing various types of crimes, social evils, and other illegal acts compared to the previous year;

b) Not allowing serious crimes or higher to occur (except in cases of force majeure); if they do occur, they must be promptly detected, appropriate measures taken to minimize consequences, and reported immediately to competent authorities for handling;

c) Not generating complex social order hotspots; not producing new social evil cases; effectively managing, educating, and assisting various types of subjects residing in the area according to the law;

d) Not allowing serious fires, explosions, fatal workplace accidents, or serious incidents as defined by law (except in cases of force majeure).

5. Personnel involved in ensuring security and order at the grassroots level are evaluated as having completed their tasks or better, and there are no individuals disciplined for violations.

Article 5. Criteria for recognizing communes, wards, towns meeting the standard "Safe in security and public order"

Communes, wards, towns shall be recognized as meeting the standard "Safe in security and public order" when they satisfy all of the following criteria:

1. In the first quarter of each year, the Party Committee issues a resolution; the People's Committee of the commune, ward, town formulates a plan on ensuring security and public order and registers to strive for achieving the standard "Safe in security and public order"; builds, consolidates, or maintains at least one effective grassroots mass movement model for protecting national security.

2. Satisfies the criteria stipulated in Clause 2, Clause 3, and Clause 4 of Article 4 of this Circular.

3. The police station of the commune, ward, town proactively grasps the situation, timely advises and proposes to the Party committee and authorities various policies, measures, and effectively organizes the implementation of work to ensure security and public order and build the mass movement for protecting national security; there is no individual who violates discipline and is subject to disciplinary action.

4. 100% of residential areas, agencies, enterprises, educational facilities under its jurisdiction or authorized to manage on the territory register, among which 70% or more are recognized as meeting the standard "Safe in security and public order".

Article 6. Criteria for recognizing agencies and enterprises meeting the standard "Safe in security and public order"

Agencies and enterprises shall be recognized as meeting the standard "Safe in security and public order" when they satisfy all of the following criteria:

1. In the first quarter of each year, the Party organization issues a specific resolution or incorporates the work of ensuring security and public order into the annual leadership and guidance resolution (for places with a Party organization); the agency or enterprise formulates a plan on ensuring security and public order and registers to strive for achieving the standard "Safe in security and public order"; has internal regulations and rules for protecting the agency or enterprise, protecting state secrets, protecting internal political stability, labor safety, fire prevention, environmental protection in accordance with actual conditions and legal provisions; 100% of officials, civil servants, employees are familiarized and strictly implement these internal regulations and rules and the criteria for building the agency or enterprise to meet the standard "Safe in security and public order"; has at least one effective grassroots mass movement model for protecting national security.

2. Fully implements all Party guidelines, State policies and laws, regulations, programs, plans coordinated with the Public Security force (if applicable) and local regulations on work to ensure security and public order.

3. Not allowing any of the following situations to occur:

a) Propaganda and development of illegal religious beliefs;

b) Activities exploiting religion, ethnicity, disputes, complaints causing complexity in security and public order;

c) Inciting, urging, coercing, enticing, bribing, or luring others to gather in large numbers to complain, disrupt public security or take advantage of complaints to spread propaganda against the State; infringing upon the interests of the State; distorting, slandering, threatening, insulting the reputation and honor of agencies, organizations, or persons responsible for handling complaints and reports;

d) Illegal strikes or work stoppages;

đ) Serious crimes or higher (except in cases of force majeure) or if present, promptly discover and use comprehensive measures to minimize consequences and report immediately to the competent authority for handling;

e) Violations of state secret protection regulations;

g) Severe fires, explosions; fatal workplace accidents; serious incidents; violations of environmental protection and food hygiene safety causing severe consequences or higher as prescribed by law (except in cases of force majeure);

h) Officials, civil servants, employees being administratively punished for violations in the field of security and public order or addicted to social evils and subject to disciplinary action from a warning or higher.

4. The agency or enterprise security force achieves the title "Advanced Labor Collective" or is rated "Satisfactorily Completed Tasks" or higher (for those eligible for commendation), without individuals being disciplined from a warning or higher.

5. At least 70% of subordinate units (departments, teams, squads) achieve the title "Advanced Labor Collective" or are rated "Satisfactorily Completed Tasks" or higher (for those eligible for commendation), without individuals being disciplined from a warning or higher.

Article 7. Criteria for Recognizing Educational Institutions Meeting the Standard of "Safety in Security and Order"

An educational institution will be recognized as meeting the standard of "Safety in Security and Order" when it satisfies all of the following criteria:

1\. In the first quarter of each year, the Party organization shall issue a specific resolution or incorporate measures to ensure security and order into its annual leadership and guidance resolutions (for places with a Party organization); the educational institution shall have a plan for ensuring security and order and register to strive for achieving the standard of "Safety in Security and Order"; there shall be internal regulations and rules for protecting the educational institution, safeguarding internal political stability, managing student education, and preventing fires and explosions that are appropriate to the actual situation; 100% of staff, workers, teachers, and students shall be informed and made aware of these internal regulations and rules and the criteria for building an educational institution that meets the standard of "Safety in Security and Order"; there shall be at least one effective mass movement model for protecting national security.

2\. Fully implement the Party's policies and guidelines, state laws and policies, regulations, programs, and plans for cooperation with police forces (if applicable), local regulations on ensuring security and order; there shall be forms and methods of cooperation in managing students between the educational institution and the Parent-Student Council (for secondary education levels) in the work of ensuring security and order.

3\. There shall be no occurrence of any of the cases specified in points a, b, c, d, e, and g of Clause 3, Article 6 of this Circular.

4\. There shall be no occurrence of school violence, staff, workers, teachers, or students committing crimes or engaging in social vices that result in disciplinary actions from warnings and above.

5\. The security force of the educational institution (if any) shall achieve the title of "Advanced Labor Collective" or be rated as having "Successfully Completed Tasks" or higher (for places eligible for commendation), with no individual receiving disciplinary action from warnings and above.

6\. At least 70% of subordinate units (departments, offices, committees, specialized teams) shall achieve the title of "Advanced Labor Collective" or be rated as having "Successfully Completed Tasks" or higher (for places eligible for commendation), with no individual receiving disciplinary action from warnings and above.

Article 8. Time Frame for Evaluation and Classification Results for Meeting the Standard of "Safety in Security and Order"

1\. Based on the degree of achievement of the "Safety in Security and Order" criteria stipulated in this Circular and other criteria prescribed by the People's Committee of the province or centrally governed city (if any) to classify residential areas, communes, wards, towns, agencies, enterprises, and educational institutions as meeting or not meeting the standard of "Safety in Security and Order."

2\. Time frame for evaluation

a\. For residential areas: The time frame for evaluation runs from November 1 of the previous year to October 31 of the following year;

b\. For communes, wards, towns, agencies, enterprises, and educational institutions: The time frame for evaluation runs from November 16 of the previous year to November 15 of the following year.

Article 9. Procedures, Formalities, and Documentation for Applying for Recognition of Meeting the Standard of "Safety in Security and Order"

1\. Procedures and formalities for applying for recognition of meeting the standard of "Safety in Security and Order"

a\. The Head of the Residential Area shall chair a meeting with the Secretary of the Branch Party Committee, representatives of the Mass Organization Work Committee, representatives of mass organizations (if any), and representatives of the local police station to review and assess the situation and results of implementing the "Safety in Security and Order" residential area and complete the necessary documentation to submit to the Standing Office of the Crime Prevention, Social Evil Control, and Mass Movement for National Security Protection Committee of the commune, ward, town (referred to collectively as the commune level) for review and report, recommending the Chairman of the Commune People's Committee to approve and decide on recognizing the residential area as meeting the standard of "Safety in Security and Order" before November 15 each year;

b\. The Standing Office of the Crime Prevention, Social Evil Control, and Mass Movement for National Security Protection Committee at the commune level shall review and assess the situation and results of implementing the construction of communes, wards, towns meeting the standard of "Safety in Security and Order" and complete the necessary documentation to submit to the Standing Office of the Crime Prevention, Social Evil Control, and Mass Movement for National Security Protection Committee at the district, urban district, town, and centrally governed city level (referred to collectively as the district level) for review and report, recommending the Chairman of the District People's Committee to approve and decide on recognizing communes, wards, towns as meeting the standard of "Safety in Security and Order" before November 20 each year;

c\. The head of the agency, enterprise, or educational institution shall chair a meeting including representatives of the Party committee, mass organizations, security forces (if any), representatives of the local police station, and representatives of the competent authority for management to review and assess the situation and results of constructing the agency, enterprise, or educational institution to meet the standard of "Safety in Security and Order" and complete the necessary documentation to report to the competent authority (through the Standing Office of the Crime Prevention, Social Evil Control, and Mass Movement for National Security Protection Committee) for review, approval, and decision to recognize before November 20 each year;

d\. The Department of Mass Movement for National Security Protection, Ministry of Public Security shall review the file and report to recommend the Minister of Public Security to approve and decide on recognizing agencies, enterprises, and educational institutions under the supervision and guidance of business units of the Ministry of Public Security regarding security and order maintenance and mass movement for national security protection as meeting the standard of "Safety in Security and Order" before November 20 each year.

2\. Application registration documents and documents for review and recognition of meeting the standard of "Safety in Security and Order"

a\. Registration documents

- Resolution of the Party committee leading the work of ensuring security and order (for places with a Party organization);

- Plan for ensuring security and order of the People's Committee of the commune, ward, town; agency, enterprise, educational institution;

- Registration form for striving to achieve the standard of "Safety in Security and Order".

b\. Documents for review and recognition

- Petition for review and recognition of meeting the standard of "Safety in Security and Order";

- Report on the results of building residential areas, communes, wards, towns, agencies, enterprises, educational institutions to meet the standard "Safe in security and public order";

- Minutes of the meeting assessing the situation and results of implementing criteria for building residential areas, communes, wards, towns, agencies, enterprises, educational institutions to meet the standard "Safe in security and public order";

- Other related documents.

Article 10. Competence to review and decide on recognition of the standard "Safe in security and public order"

1. The People's Committee at the commune level shall review, issue decisions recognizing and issuing Certificates of Recognition for achieving the standard "Safe in security and public order" for residential areas, agencies, enterprises, educational institutions within its jurisdiction or authorized to manage.

2. The People's Committee at the district level shall review, issue decisions recognizing and issuing Certificates of Recognition for achieving the standard "Safe in security and public order" for communes, wards, towns, agencies, enterprises, educational institutions within its jurisdiction or authorized to manage.

3. The People's Committee at the provincial level shall review, issue decisions recognizing and issuing Certificates of Recognition for achieving the standard "Safe in security and public order" for agencies, enterprises, educational institutions within its jurisdiction or authorized to manage.

4. The Ministry of Public Security shall review, issue decisions recognizing and issuing Certificates of Recognition for achieving the standard "Safe in security and public order" for agencies, enterprises, educational institutions under the supervision and guidance of business units of the Ministry of Public Security regarding security and public order work and the construction of the All-People National Security Guard Movement.

5. Depending on specific conditions of each locality, the higher-level People's Committee may delegate the lower-level People's Committee to review and recognize the achievement of the standard "Safe in security and public order" for agencies, enterprises, and educational institutions located within their territory.

Chapter III

IMPLEMENTATION

Article 11. Effective Date

This Circular takes effect from February 10, 2022, and replaces Circular No. 23/2012/TT-BCA dated April 27, 2012, of the Ministry of Public Security on residential areas, communes, wards, towns, agencies, enterprises, and schools meeting the standard "Safe in security and public order".

Article 12. Responsibility for Implementation

1. Heads of public security organs at all levels shall be responsible for advising the Party committees and people's administrations at the same level to direct and organize the implementation of this Circular. At the same time, based on their functions, tasks, and authorities, they shall strictly implement it within the public security forces.

2. The competent authority issuing decisions and certificates of recognition for achieving the standard "Safe in security and public order" for each unit that meets the standard "Safe in security and public order" shall do so according to the model (annexed).

3. The Department of Building the Mass Movement for Safeguarding National Security, Ministry of Public Security shall be responsible for leading and coordinating with relevant units to advise, guide, inspect, and urge the implementation of this Circular.

During the process of organizing the implementation, if there are difficulties or obstacles, public security units and localities, and related organizations, entities, and individuals shall report or reflect to the Ministry of Public Security (through the Department of Building the Mass Movement for Safeguarding National Security) for timely guidance./.
