Amending and supplementing provisions on appraisal services in Decree
No. 120/2011/NĐ-CP dated December 16, 2011 and Decree No. 20/2006/NĐ-CP dated February 20, 2006
The Government issues this Decree to amend and supplement provisions on appraisal services in Decree No. 120/2011/NĐ-CP dated December 16, 2011 and Decree No. 20/2006/NĐ-CP dated February 20, 2006.

Pursuant to the Law on Trade dated June 14, 2005;
At the proposal of the Minister of Industry and Trade,
Article 1. Amending and supplementing Decree No. 120/2011/NĐ-CP dated December 16, 2011 of the Government amending and supplementing administrative procedures in some Decrees of the Government detailing the Trade Law
Repealing Article 4 of Decree No. 120/2011/NĐ-CP dated December 16, 2011 of the Government amending and supplementing administrative procedures in some Decrees of the Government detailing the Trade Law.
Article 2. Amending and supplementing some Articles of Decree No. 20/2006/NĐ-CP dated February 20, 2006 of the Government detailing the Trade Law on trading in commercial appraisal services
1. Amending point b Clause 1 Article 10 as follows:
"b) A copy of the Business Registration Certificate or Investment Certificate in the following cases:
- A photograph attached with the original for comparison in the case of submitting the application directly;
- A certified copy for direct submission or submission via postal service;
- A scanned copy from the original in the case of applying administrative procedures through electronic submission."
"Within a maximum period of seven working days from the date of receiving a complete set of documents for registering business seals according to Clause 1 Article 10 of this Decree, the Department of Industry and Trade where the trader registers business shall be responsible for registering the business seal used in appraisal certificates of the trader in the Register of Business Seals and notify the trader in writing. In case of not accepting the registration of business seals, the Department of Industry and Trade must reply in writing and specify the reasons."
2. Amend Article 11 as follows:
3. Amending Clause 1 Article 4, Clause 1 Article 9, Clause 2 Article 10 as follows:
"a) Replace the phrase "Ministry of Trade" with "Ministry of Industry and Trade;"
b) Replace the phrase "Department of Trade (Department of Trade and Tourism)" with "Department of Industry and Trade."
Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under the central city and related organizations and individuals are responsible for implementing this Decree.
This Circular takes effect from December 25, 2025/.
1. This Decree takes effect from February 20, 2015.
Article 4. Effective date
2. Point b and d Clause 1 and Clause 3 Article 4; Clause 2, Clause 3 and Clause 4 Article 8; Article 9; Article 10; Article 11; Article 12; point d Clause 1 Article 19 of Decree No. 20/2006/NĐ-CP dated February 20, 2006 of the Government detailing the Trade Law on trading in commercial appraisal services continue to be applied from the date this Decree takes effect.
3. This Decree abolishes Article 22 of Decree No. 20/2006/NĐ-CP dated February 20, 2006 of the Government detailing the Trade Law on trading in commercial appraisal services.
Within three months from the date this Decree takes effect, traders trading in commercial appraisal services who have not registered business seals must complete the registration of business seals according to this Decree.
Article 5. Transitional Provisions
Within three months from the date this Decree takes effect, traders operating commercial inspection services who have not registered their business seals shall complete the procedures for registering their business seals in accordance with the provisions of this Decree.
