I. ELIGIBILITY
1. Scope of application:
1.1 Teachers:
1.1.1 Teachers within the State's establishment who are directly teaching at public schools within the national education system, including kindergartens, primary and secondary schools, vocational training centers, universities, colleges, specialized secondary schools, teacher training institutes, technical and vocational education centers, and other centers established and operating under the regulations of the Ministry of Education and Training, and adult education centers.
1.1.2 Teachers within the State's establishment receiving salaries from the State budget who are teaching at semi-public schools.
1.1.3 Contract teachers, temporary teachers, and probationary teachers at public schools.
1.1.4 Teachers specified in points 1.1.1, 1.1.2, and 1.1.3 above who are on maternity leave, sick leave, annual leave, or other leaves with salary as prescribed by law, and teachers attending short-term professional development courses pursuant to a summons from a competent authority.
1.1.5 Teachers who do not meet the conditions stipulated in point 1, Part II of this Circular but are currently working in difficult areas such as mountainous regions, border areas, ethnic minority regions, remote areas, and islands shall still be entitled to this preferential allowance.
The geographical boundaries of mountainous regions, border areas, islands, and ethnic minority regions shall be implemented according to the regulations of the Committee for Ethnic Minorities and Mountainous Areas. Remote areas shall be determined based on local characteristics, decided by the Provincial People's Committee after consultation with the Joint Ministry of Organizational Affairs - Civil Service of the Government - Finance - Education and Training.
1.2 Management staff within the State's establishment at educational institutions who teach according to the number of hours prescribed in the State's labor norms and teacher work regulations.
II. NON-ELIGIBLES
2.1 Teachers who do not meet the standard teaching hours (except those specified in point 1.1.5, Part I of this Circular).
2.2 Teachers who are not eligible for salary grade adjustment under Decree No. 25/CP dated May 23, 1993 of the Government.
2.3 Teachers and management staff who exceed the health leave standards set forth in the Labor Code and management staff without teaching hours.
2.4 Teachers and management staff disciplined with a decision of reprimand or higher shall not be entitled to this allowance during the period the disciplinary decision remains effective.
2.5 Staff and teachers in state administrative agencies.
II. CONDITIONS, AMOUNTS OF ALLOWANCES, AND CALCULATION METHODS:
1. Conditions for Entitlement to Preferential Allowances:
1.1 Meeting the professional and vocational standards established to transfer to new salary grades under Decree No. 25/CP dated May 23, 1993 of the Government.
1.2 Teaching according to the standard hours prescribed by the Ministry of Education and Training and the Ministry of Organizational Affairs - Civil Service of the Government, initially implemented according to the following main documents:
- For kindergarten teachers, Decision No. 304/CP dated August 24, 1979 of the Council of Ministers on the organizational structure and staffing of state-owned kindergartens, and Circular No. 3CB/UB dated March 7, 1980 of the Committee for Women and Children.
- For primary school teachers, Decree No. 17/HĐBT dated January 30, 1984 of the Council of Ministers on the organizational structure and staffing of primary schools, and Circular No. 8GD-TT dated February 28, 1986 on the working conditions of primary school teachers.
- For secondary school teachers and technical and vocational education centers, Decision No. 243/CP dated November 28, 1979 of the Council of Ministers on the organizational structure and staffing of secondary schools, and Circular No. 49/GD-TT dated November 29, 1979 of the Ministry of Education on the working conditions of secondary school teachers.
- For vocational school teachers and vocational training centers, Circular No. 16/LĐ-TT dated August 27, 1977 of the Ministry of Labor.
For teachers at specialized secondary schools, Decision No. 1659/QĐ dated November 15, 1976 of the Ministry of Higher Education and Specialized Secondary Schools.
Teachers at teacher training colleges implement Decision No. 15/GD-TT dated May 11, 1981 of the Ministry of Education.
Teachers at universities and colleges implement Decision No. 1712/QĐ-BĐH dated December 18, 1978 of the Ministry of Higher Education and Specialized Secondary Schools.
Teachers at normal universities and normal colleges implement Circular No. 37/GD-TT dated November 14, 1980 of the Ministry of Education.
Teachers at cultural and information schools implement Decision No. 238/VH dated February 26, 1981 of the Ministry of Culture on the working conditions of university and middle-level cultural and information teachers.
1.2.1 The standard hours referred to herein are the total hours assigned to teachers, including teaching hours and hours spent on concurrent duties that have been converted into standard hours.
1.2.2 The teaching standard hours mentioned in this Circular do not include hours for which teachers have already received remuneration from any source within the unit (for example, public school teachers who also teach part-time at semi-public schools or other educational centers and have received remuneration for such additional teaching will not be counted towards the preferential allowance).
1.3 Amounts of Allowances and Calculation Methods:
1.3.1 The amount of the allowance is 20% of the current salary grade, excluding other allowances (except leadership position allowances) when calculating this allowance.
1.3.2 Calculation Method:
120,000 VND x {Salary Scale Factor + Position Allowance Factor (if applicable)} x 20%
Example: A high school teacher (C3) is transferred to a salary grade according to Decree No. 25/CP with code number 15113, having a coefficient of 2.14, and is required to teach 18 hours per week. The teacher taught 14 hours in class, supervised weekly student labor for one class, which is converted to 2 standard hours per week of supervision, and served as the class advisor for one class, which is converted to 4 standard hours per week.
The total number of standard hours is:
14 hours + 2 hours + 4 hours = 20 hours/week.
The teacher has fulfilled the assigned tasks of the school and is entitled to a preferential allowance equal to 20% of the salary grade:
120,000 VND x 2.14 x 20% = 51,360 VND/month.
III- METHODS OF PAYMENT:
3.1- For kindergarten and primary school teachers, the preferential allowance is paid together with the monthly salary.
3.2- For teachers at other institutions eligible for this allowance, based on the teaching load and work volume for the year, if they meet the conditions specified in Point 1 of Part II, they will be temporarily paid this allowance together with their monthly salary and will be settled at the end of the academic year.
3.3- This allowance is recorded under Item 65 of the corresponding type, item, and category and is included in the annual education and training budget.
IV- IMPLEMENTATION
1- Each year, the Ministry of Education and Training and relevant ministries and sectors with schools prepare the funding for this allowance within the total expenditure for educational and training services and submit it to the Ministry of Finance for inclusion in the annual plan and issuance (Form No. 3).
2- The heads of educational and training institutions base the preparation of the funding for this allowance on the teaching workload of the institution, and are responsible for reviewing the eligibility of those entitled to the allowance (using Form No. 1). The review process must be transparent, democratic, fair, and comply with state regulations. The results of the review (using Form No. 2) must be submitted to the direct management authority of the institution no later than June each year.
3- Schools are responsible for using the preferential allowance for teachers in accordance with its intended purpose, effectively, and settling accounts according to the current financial system.
4- The Government's Personnel Department, the Ministry of Finance, and the Ministry of Education and Training have the responsibility to inspect the implementation of Decision 779/TTg of the Prime Minister in ministries, sectors, and localities.
5- Ministries issue decisions for those entitled to this allowance in subordinate units. Departments of Education and Training issue decisions for those entitled to this allowance in units directly managed by them. Schools and centers not directly managed by Departments of Education and Training are decided upon by the direct management authority after consulting the Department of Education and Training. The review process at higher-level management authorities (Ministries, Departments) must be completed no later than October each year.
This Circular takes effect from January 1, 1996. During implementation, any difficulties should be reported to the Joint Ministry for study and resolution.
