CIRCULAR
Regarding the amendment and supplementation of certain points in Circular No. 97/2005/TT-BTC dated November 9, 2005 of the Ministry of Finance on financial support mechanisms for defense economic zones
guiding the financial support mechanism for defense economic zones

Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the request of the Ministry of National Defense through Document No. 4451/BQP-KT dated August 28, 2008 and Document No. 1207/BQP-KT dated March 19, 2009 regarding the request to amend and supplement the financial support mechanism for defense economic zones stipulated in Circular No. 97/2005/TT-BTC dated November 9, 2005 of the Ministry of Finance;
The Ministry of Finance guides the amendment and supplementation of certain points regarding the financial support mechanism for defense economic zones stipulated in Circular No. 97/2005/TT-BTC dated November 9, 2005 as follows:
I. AMENDMENTS AND SUPPLEMENTS TO CERTAIN POINTS IN SECTION II OF CIRCULAR NO. 97/2005/TT-BTC AS FOLLOWS:
1. Clause 2 shall be amended as follows:
“State-owned companies engaged in production and processing of agricultural and forestry products shall implement the financial support mechanism as companies producing and supplying public goods and services.”
2. Clause 3 shall be abolished.
3. Point 4.1 of Clause 4 shall be amended as follows:
“The initial investment cost for building classrooms and purchasing desks, chairs, and teaching materials shall not exceed VND 100,000,000/classroom (for facilities that have not been equipped). In cases where classrooms and teaching materials are damaged and need replacement and supplementation, the expenditure shall not exceed VND 10,000,000/classroom/year.”
4. Point 5.1 of Clause 5 shall be amended as follows:
“The initial investment cost for equipping medical facilities with physical assets shall not exceed VND 150,000,000/medical facility.”
5. Subpoint 5.2.1 of Point 5.2 of Clause 5 shall be amended as follows:
“For operating medical facilities ensuring salaries according to rank and various allowances for healthcare staff, the amount will be determined based on the actual expenditure of the previous year of the unit to ensure funding for the following year.”
6. Clause 6 shall be amended as follows:
“Financial support for social policy work, propaganda, and mobilization activities such as training and vocational education for ethnic laborers for up to six months; poverty alleviation, stable settlement, with a monthly budget of VND 300,000/person/month.”
7. Supplement to Clause 7 as follows:
“Support enterprises in paying social insurance and health insurance for ethnic laborers during a five-year period from the date they enter into employment contracts.”
II. AMENDMENTS AND SUPPLEMENTS TO CERTAIN POINTS IN SECTION III AS FOLLOWS:
1. Point 1.1 of Clause 1 shall be amended as follows:
“The initial investment cost for building classrooms and purchasing desks, chairs, and teaching materials shall not exceed VND 100,000,000/classroom (for units that have not been equipped). In cases where classrooms and teaching materials are damaged and need replacement and supplementation, the expenditure shall not exceed VND 10,000,000/classroom/year.”
2. Point 2.1 of Clause 2 shall be amended as follows:
“The initial investment cost for equipping medical facilities with physical assets shall not exceed VND 150,000,000/medical facility.
For medical facilities in areas with more than 20 beds, additional support for equipment costs including one X-ray machine (14 inches) with film processor, room for the X-ray machine, one ambulance, one ultrasound machine for division-level hospitals and equivalent, and one minor surgery set will be provided according to actual expenditures but not exceeding VND 400,000,000 for the X-ray machine, VND 400,000,000 for the room, VND 500,000,000 for the ambulance, VND 400,000,000 for the ultrasound machine, and VND 70,000,000 for the minor surgery set. Purchasing shall be carried out in accordance with Circular No. 63/2007/TT-BTC dated June 15, 2007 of the Ministry of Finance on guiding procurement to maintain regular operations of state agencies using state funds and current state guidelines.
These investment costs will only be supported if they have not yet been invested or equipped.”
3. Point 2.2 of Clause 2 shall be amended as follows:
“Funds for implementing social policy work:
+ Funds for purchasing medicines and consumable medical supplies when providing medical care to the population in remote areas far from district-level hospitals shall be based on actual expenses but not exceeding VND 50,000,000/year for medical stations with less than 10 beds; VND 60,000,000/year for medical stations with 10 to less than 20 beds; VND 70,000,000/year for medical stations and hospitals with 20 beds or more. The Ministry of National Defense will approve the list of units eligible for this support.
+ Support for food expenses for civilian patients treated at medical stations and hospitals within the defense economic zone equivalent to the food allowance of infantry soldiers at the time specified by the Ministry of National Defense.”
4. Subpoint 3.1.4 of Point 3.1 of Clause 3 shall be amended as follows:
“Fuel costs for gasoline, allocated at 400 liters/team/year.”
5. Subpoint 3.1.5 of Point 3.1 of Clause 3 shall be amended as follows:
“Fuel costs (gasoline) for running generators to provide television signals for residents to watch television (ensuring four hours/day) allocated at 1,000 liters/generator/year for units stationed in areas without television signals.”
6. Subpoint 3.1.6 of Point 3.1 of Clause 3 shall be amended as follows:
“Professional development and language training costs for ethnic languages at VND 500,000/person).”
7. Subpoint 3.1.7 of Point 3.1 of Clause 3 shall be amended as follows:
“Individuals performing propaganda tasks among the people shall receive subsistence allowances allocated at VND 6,000,000/person/year. When receiving this allowance, they shall not receive travel allowances if working in the area of their stationing.”
8. Add subpoint 3.1.8 of Point 3.1 of Clause 3 as follows:
“Maintenance and repair costs for equipment allocated at VND 3,000,000/team/year.”
9. Point 3.2 of Clause 3 shall be amended as follows:
“For higher levels of teams:
Travel and fuel allowances for conducting and directing general situation monitoring in the assigned areas shall be allocated annually as follows:
+ For brigades, battalions, and economic management departments directly managing and directing three or fewer defense economic teams and equivalent units: 15,000 liters of gasoline/year.
+ For divisions and economic management departments directly managing and directing more than three defense economic teams and equivalent units: 20,000 liters of gasoline/year.”
10. Point 3.3 of Clause 3 shall be amended as follows:
"The budget for meeting and gift-giving expenses during holidays and Tet for village elders, headmen, and policy beneficiaries, according to the allocated amount:
1. This Circular takes effect 45 days from the date of signature; The financial support levels prescribed in this Circular shall be applied from the 2009 fiscal year. Other provisions in Circular No. 97/2005/TT-BTC dated November 9, 2005, issued by the Ministry of Finance, remain in effect.
2. In the course of implementing this Circular, if there are any difficulties, they should be reported to the Ministry of Finance for timely resolution, amendment, and supplementation to ensure compliance./.
III. IMPLEMENTATION
1. This Circular takes effect forty-five days from the date of issuance; The financial support levels prescribed herein shall apply from the 2009 budget year. Other provisions of Circular No. 97/2005/TT-BTC dated November 9, 2005, issued by the Ministry of Finance, remain in effect.
2. In the course of implementing this Circular, any difficulties encountered should be reported to the Ministry of Finance for timely resolution and appropriate amendments./.
