Regarding the establishment of the Working Group for Implementing the Enterprise Law and Investment Law

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

In order to assist the Prime Minister in timely and consistent guidance on the implementation of the Enterprise Law and the Investment Law;

Considering the proposal of the Minister of Planning and Investment.

DECISION:

Article 1. Establish the Working Group for Implementing the Enterprise Law and Investment Law, hereinafter referred to as the Working Group, to assist the Prime Minister in guiding the implementation of the Enterprise Law and the Investment Law.

Article 2. The Working Group shall have the following tasks:

1. Monitor, urge, and guide the implementation of the Enterprise Law and the Investment Law at ministries, ministerial-level agencies, government agencies, provincial people's committees under central cities, and enterprises, ensuring full and consistent implementation of the spirit and content of these laws; summarize exemplary cases and good experiences; at the same time, identify untimely actions and violations of the Enterprise Law, the Investment Law, and related decrees, report to the Prime Minister for consideration and handling.

2. Regularly assess the situation of implementing the Enterprise Law and the Investment Law every quarter; identify difficulties that limit the effectiveness and efficiency of law implementation; propose solutions to the Prime Minister.

3. Continuously review and evaluate regulations guiding the implementation of the Enterprise Law and the Investment Law and other related regulations; report and propose solutions to the Prime Minister for amending and supplementing regulations that are no longer appropriate.

4. Directly and in coordination with relevant state agencies, the Vietnam Chamber of Commerce and Industry, and other business associations, review regulations on business licenses and other business conditions to propose:

a) Abolishing unnecessary or contradictory regulations to the Enterprise Law and the Investment Law;

b) Amending and supplementing regulations that are incomplete, unclear, and not specific, unreasonable, and unforeseeable;

c) Converting business licenses to more suitable and effective non-license management forms;

d) Issuing new regulations on business conditions if deemed necessary, meeting the requirements of state management over enterprises.

5. Promote and disseminate the contents of the Enterprise Law and the Investment Law and related guiding documents to enterprise owners, managers, and relevant officials; promote exemplary cases and highlight strengths and weaknesses in law implementation, mobilize suggestions and public opinion to consistently and fully implement the spirit and content of the Enterprise Law and the Investment Law.

Article 3. The Working Group has the right to request information from ministries and local people's committees at all levels about the implementation of the Enterprise Law and the Investment Law, emerging issues during the implementation process within their sectors and regions; exchange with state management agencies, enterprises, and other related parties regarding law implementation and guiding documents.

Article 4. The Working Group shall be headed by the Minister of Planning and Investment and consist of the following members:

- Mr. Dinh Van An, Director of the Central Institute for Economic Management, Deputy Head.

- Mr. Pham Viet Muon, Deputy Director of the Government Office, Deputy Head of the Steering Committee for Enterprise Reform and Development, Deputy Head.

- Mr. Hoang The Lien, Deputy Minister of Justice, Deputy Head.

- Other members named in the list attached to this Decision.

Based on specific requirements and conditions, the Head of the Working Group may invite experts with specialized knowledge and rich experience to participate in the Working Group's activities.

Article 5. The Working Group and its members shall work according to the rules established by the Head and assigned by the Working Group.

The operating expenses of the Working Group shall be borne by the Ministry of Planning and Investment.

The Working Group shall dissolve itself upon completion of its assigned tasks.

Article 6. This Decision shall take effect from the date of signing.

Article 7. Ministers, heads of ministerial-level agencies, heads of government agencies, chairmen of provincial people's committees under central cities, and those named in Article 4 are responsible for implementing this Decision.
