Regarding the establishment of the Military People's Procuracy of Hanoi Capital

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
SOCIALIST REPUBLIC OF VIET NAM
BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10;
Pursuant to the Law on the Organization of the People's Procuracy, No. 34/2002/QH10;
Pursuant to the Ordinance on the Organization of the Military People's Procuracy, No. 05/2002/PL-UBTVQH11; Considering the proposal of the Chief Prosecutor of the Supreme People's Procuracy;
RESOLUTION:
Article 1
1. Establish the Military People's Procuracy of Hanoi Capital based on the merger of the Military People's Procuracy under the Ministry of National Defense and the Military People's Procuracy of Hanoi Capital (currently in operation).
2. Establish the Military People's Procuracy region subordinate to the Military People's Procuracy of Hanoi Capital based on the merger of the Military People's Procuracy Region 1, Military People's Procuracy Region 2 under the Military People's Procuracy of the Ministry of National Defense and the Military People's Procuracy Region subordinate to the Military People's Procuracy of Hanoi Capital (currently in operation).
3. The Chief Prosecutor of the Supreme People's Procuracy shall coordinate with the Minister of National Defense to define the jurisdiction and operational area of the Military People's Procuracy of Hanoi Capital, the newly established Military People's Procuracy Region subordinate to the Military People's Procuracy of Hanoi Capital, the Military People's Procuracies of Military Regions, and the Military People's Procuracy Regions subordinate to the Military People's Procuracies of Military Regions.
Article 2
1. This Resolution takes effect from January 1, 2012.
2. Clause 8 and Clause 16 Article 1, Point h and Point q Clause 1 Article 2 of Resolution No. 386/2003/NQ-UBTVQH11 dated March 17, 2003 of the Standing Committee of the National Assembly regarding the establishment of the Military People's Procuracy of Military Regions and equivalent entities, and Military People's Procuracy Regions, and Resolution No. 708/2008/UBTVQH12 dated November 21, 2008 of the Standing Committee of the National Assembly regarding amendments and supplements to certain provisions of Resolution No. 386/2003/NQ-UBTVQH11 dated March 17, 2003 of the Standing Committee of the National Assembly shall cease to be effective from the date this Resolution takes effect.
3. The Chief Prosecutor of the Supreme People's Procuracy and the Minister of National Defense within their respective duties and authorities are responsible for implementing and guiding the implementation of this Resolution./.
