DECISION OF THE PRIME MINISTER
Regarding the establishment of Securities Trading Centers
PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Decree No. 75/CP dated November 28, 1996 of the Government on the establishment of the State Securities Commission;
At the proposal of the Chairman of the State Securities Commission and the Minister, Head of the Organizational-Cadre Affairs Agency of the Government,
DECISION:
Article 1. Two Securities Trading Centers under the State Securities Commission are established, including:
1. The Hanoi Securities Trading Center.
2. The Ho Chi Minh City Securities Trading Center. The Hanoi Securities Trading Center and the Ho Chi Minh City Securities Trading Center are public service units with revenue, having legal personality, their own offices, seals, and separate accounts, with operating funds provided from the state budget. The staffing of the two Securities Trading Centers is part of the staffing of the State Securities Commission.
Article 2. The Securities Trading Center shall have the main tasks as follows:
1. Organizing, managing, and directing securities trading activities.
2. Managing and directing the securities trading system.
3. Providing support services for securities trading and securities custody services.
4. Implementing securities registration.
5. Implementing settlement and netting for securities transactions.
6. Announcing information about securities trading activities.
7. Inspecting and supervising securities trading activities.
8. Collecting listing fees, member fees, transaction fees, information service fees, and other service fees as prescribed by law.
9. Implementing reporting, statistics, accounting, and auditing systems as prescribed by the State. The Chairman of the State Securities Commission shall decide specifically on the tasks, organizational structure, and appointment and removal of the Directors and Deputy Directors of the aforementioned two Securities Trading Centers.
Article 3. This Decision shall take effect fifteen days after its date of issuance.
Article 4. The Chairman of the State Securities Commission, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Committees directly under the Central Government related to this matter are responsible for implementing this Decision.
