Pursuant to the Government Organization Law dated September 30, 1992;
To effectively implement Directive No. 853/1997/CT-TTg dated October 11, 1997 of the Prime Minister on combating smuggling under new circumstances and Directive No. 31/1999/CT-TTg dated October 27, 1999 of the Prime Minister on combating the production and sale of counterfeit goods;
Upon the proposal of the Minister of Trade and the Minister, Head of the Organization-Cadre Department of the Government,
DECISION:
Article 1. The Steering Committee for Combating Smuggling, Counterfeit Goods and Commercial Fraud shall be established with the Minister of Trade serving as the Chairman.
Members include a Deputy Minister from each of the Ministries: Public Security, Trade, Defense, Finance, Science, Technology and Environment, a Deputy Director of the Government Office, a Deputy General Director of the General Customs Department, and the Commander of the Border Guard Force.
Members of the Committee shall work on a part-time basis.
Article 2. The Steering Committee for Combating Smuggling, Counterfeit Goods and Commercial Fraud shall have the following duties and powers:
1. Assist the Prime Minister in directing and organizing coordination among ministries, sectors, and localities in the work of combating smuggling, counterfeit goods, and commercial fraud.
2. Monitor, inspect, and urge ministries, sectors, and provincial people's committees under the central government to fulfill their assigned functions and tasks; resolve complex cases involving multiple ministries, sectors, and localities in the work of combating smuggling, counterfeit goods, and commercial fraud.
3. Summarize the situation, evaluate the results of activities against smuggling, counterfeit goods, and commercial fraud by ministries, sectors, and localities, report to the Prime Minister; propose policies and measures to enhance the effectiveness of combating smuggling, counterfeit goods, and commercial fraud to the Prime Minister.
4. In necessary cases, the Steering Committee for Combating Smuggling, Counterfeit Goods and Commercial Fraud may establish working groups for direct inspections to effectively perform its tasks.
Article 3. The Steering Committee for Combating Smuggling, Counterfeit Goods and Commercial Fraud shall have a permanent office located at the Ministry of Trade (mainly utilizing the machinery of the Market Management Bureau) and some officials and civil servants from relevant ministries and sectors appointed by the members of the Committee to work on a part-time basis.
The Chairman shall coordinate with the members to issue the Operational Regulations of the Committee and its permanent office.
The Steering Committee for Combating Smuggling, Counterfeit Goods and Commercial Fraud shall use the seal of the Ministry of Trade. The operating expenses of the Committee shall be directly resolved by the Ministry of Finance based on the proposal of the Chairman.
Article 4. This Decision shall take effect fifteen days from the date of signature. Heads of ministries and sectors mentioned in Article 1 shall notify the list of personnel appointed as members to the Ministry of Trade and report to the Prime Minister.
Article 5. Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, Chairmen of provincial people's committees under the central government, the Chairman and members of the Steering Committee for Combating Smuggling, Counterfeit Goods and Commercial Fraud are responsible for implementing this Decision.
