CIRCULAR

Regarding guidance on implementing certain provisions of Decree No. 211/2004/NĐ-CP

dated December 22, 2004, of the Government detailing the implementation of certain provisions of the Confidential Service Ordinance concerning uniform standards, leave policies, and annual public service obligations for confidential service personnel

Pursuant to Decree No. 211/2004/NĐ-CP dated December 22, 2004, of the Government detailing the implementation of certain provisions of the Confidential Service Ordinance concerning uniform standards, leave policies, and annual public service obligations for confidential service personnel; following the opinions of the Government Confidential Service Board, the Joint Ministry of Interior - Finance - Labor and Social Affairs have issued guidance on implementing certain provisions of the aforementioned decree as follows:

I. APPLICABLE OBJECTS

The subjects to whom this Circular applies are those receiving salaries according to the rank pay scale and technical profession pay scale in the confidential service sector but who are not military personnel or police officers.

Military personnel and police officers (including confidential service students studying at military and police training institutions) shall implement uniform standards, annual leave policies, and annual public service obligations as stipulated by the Ministry of National Defense and the Ministry of Public Security.

Personnel engaged in other work within confidential service organizations receiving civil servant and state employee salary scales, currently receiving national defense-security allowances and responsibility protection allowances for confidential cryptographic systems with a coefficient of 0.10, shall implement uniform standards, leave policies, and annual public service obligations as stipulated by the Ministry of National Defense for defense workers and officials.

Students studying at the Cryptographic Engineering Academy shall enjoy living expenses equivalent to the current uniform standards for lower-ranking non-commissioned officers and soldiers as specified in Appendix 1 accompanying Decree No. 123/2003/NĐ-CP dated October 22, 2003, of the Government (with attached appendices).

II. UNIFORM STANDARDS

1. The list of uniform standards for confidential service personnel is implemented in accordance with Article 5 of Decree No. 211/2004/NĐ-CP of the Government.

2. Uniform standards for confidential service personnel are implemented in accordance with Article 4 of Decree No. 211/2004/NĐ-CP of the Government, including regular uniforms, seasonal uniforms, operational uniforms, and cold weather uniforms.

3. Cold weather uniforms are prescribed for Zone 1 and Zone 2:

a) Zone 1: applicable to confidential service personnel working in border provinces in the northern region, including Son La, Dien Bien, Lai Chau, Lao Cai, Ha Giang, Tuyen Quang, Cao Bang, Bac Kan, Lang Son, Quang Ninh, and coastal islands belonging to provinces and cities from Quang Binh northward.

b) Zone 2: applicable to confidential service personnel working in the Central Highlands region and other provinces and cities from Thua Thien-Hue northward.

4. Operational uniforms include blue shirts, operational bags, outdoor training clothing, and high-top boots:

a) Blue shirts: provided to personnel directly involved in coding, decoding, research, testing, and production of cryptographic products.

b) Operational bags are provided to personnel receiving salaries according to the military officer pay scale, police officer pay scale, and confidential service rank pay scale with a responsibility protection allowance for confidential cryptographic systems with a coefficient of 0.30.

c) Outdoor training clothing is provided to personnel directly involved in training and outdoor activities.

d) High-top boots are provided to personnel directly working in border provinces and coastal islands.

The Government Confidential Service Board bases its regulations on the approved catalog, quality, and prices by the Ministry of Finance to specify the specifications, quality, and types of each type of uniform and issue standardized operational uniform models uniformly applied throughout the confidential service sector.

5. Methods of ensuring provision:

a) Provision by physical items: applicable to operational uniforms.

b) Provision by money or physical items: applicable to regular uniforms, seasonal uniforms, and cold weather uniforms.

6. Basis for determining the value of various types of uniforms: The value of various types of uniforms is determined based on the uniform standards for specific individuals corresponding to the quality and price of military uniforms.

7. Authority responsible for determining the value of various types of uniforms: The Ministry of Finance, in collaboration with the Government Confidential Service Board, will provide detailed guidance on the prices of each type of uniform specified in Part II of this Circular.

Annually, if the total value of various types of uniforms calculated at the time of review increases or decreases by 20% or more, the Ministry of Finance will adjust accordingly.

III. ANNUAL LEAVE POLICIES

1. Annual leave policies for confidential service personnel:

a) Annual leave policies for confidential service personnel are implemented in accordance with the Labor Code and Clause 2, Article 8 of Decree No. 211/2004/NĐ-CP of the Government.

b) Each year, confidential service organizations base their plans on work schedules, permanent duty tasks, and training tasks to establish specific annual leave plans for each individual in the unit with appropriate ratios, reporting to the head of the using agency or organization for approval.

c) In places where there is only one confidential service personnel, annual leave can only be taken when a replacement is assigned by the competent authority.

d) Confidential service personnel working in mountainous areas, border regions, coastal islands, or locations more than 500 kilometers away from their families shall be reimbursed for travel expenses when taking annual leave according to current regulations.

2. When confidential service personnel return home for annual leave, they must register their leave period with local authorities.

3. Authorities responsible for implementing annual leave policies are as follows:

a) The decision to grant annual leave to confidential service personnel is made by the head of the using agency or organization.

For confidential service personnel holding Bureau-level positions, after obtaining agreement from the head of the using agency or organization regarding the annual leave plan, the Confidential Service Bureaus of the Systems must report in writing to the Director of the Government Confidential Service Board.

b) When there is a declaration of a state of emergency, a partial mobilization order, or an urgent mission, the head of the agency or organization that has decided to grant annual public service labor duty leave to personnel engaged in confidential work may summon such personnel who are on leave back to their agencies or units to perform their duties.

IV. ANNUAL PUBLIC SERVICE LABOR DUTY OBLIGATIONS

Personnel engaged in confidential work within the age range for participating in annual public service labor duty are exempt from performing such obligations annually for males aged from 18 to 45 years old, and for females aged from 18 to 35 years old.

V. IMPLEMENTATION

1. This Circular shall take effect fifteen days from the date of publication in the Official Gazette.

2. The Director of the Government Confidential Work Board and the heads of agencies and organizations employing and managing personnel engaged in confidential work are responsible for organizing the implementation of this Circular.

During the implementation process, if any difficulties arise, agencies and organizations employing and managing personnel engaged in confidential work are requested to report them to the Joint Ministry and the Government Confidential Work Board for consideration and resolution./.
