JOINT CIRCULAR

Amending and supplementing certain provisions of Circular Joint No. 112/2010/TTLT-BTC-BLDTBXH dated July 30, 2010 of the Ministry of Finance and the Ministry of Labor, Invalids and Social Affairs on guiding the management and use of funds for implementing the Project "Vocational Training for Rural Workers until 2020" pursuant to Decision No. 1956/QD-TTg dated November 27, 2009 of the Prime Minister.

Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the Law on State Budget;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;

Pursuant to Decision No. 135/2009/QĐ-TTg dated November 4, 2009 of the Prime Minister promulgating the Regulations on Management and Implementation of National Target Programs;

Implementing Decision No. 1956/QD-TTg dated November 27, 2009 of the Prime Minister approving the Project "Vocational Training for Rural Workers until 2020";

Implementing Decision No. 2406/QD-TTg dated December 18, 2011 of the Prime Minister promulgating the List of National Target Programs for the period 2012-2015.

The Minister of Finance and the Minister of Labor, Invalids and Social Affairs issue this Circular Joint amending and supplementing certain provisions of Circular Joint No. 112/2010/TTLT-BTC-BLDTBXH dated July 30, 2010 guiding the management and use of funds for implementing the Project "Vocational Training for Rural Workers until 2020" pursuant to Decision No. 1956/QD-TT dated November 27, 2009 of the Prime Minister (hereinafter referred to as Circular Joint No. 112/2010/TTLT-BTC-BLDTBXH).

Article 1. Amending and supplementing certain provisions of Circular Joint No. 112/2010/TTLT-BTC-BLDTBXH:

1. Paragraph 3, Clause 1, Article 2 shall be amended and supplemented as follows:

"- Funds for implementing the Project will be allocated within the National Target Program on Employment and Vocational Training from 2012."

Article 4. Export Tariff according to the list of taxable goods

"1. The establishment, allocation, budgeting, management, use, accounting, and settlement of funds for the Project shall be carried out in accordance with the provisions of the Law on State Budget and related guiding documents; the regulations on managing and directing the implementation of National Target Programs issued pursuant to Decision No. 135/2009/QD-TTg dated November 4, 2009 of the Prime Minister and other guiding documents (if any). Funds for implementing the Project shall be allocated according to type and item, accounted for under the code of the National Target Program on Employment and Vocational Training 0250 and the project code for vocational training for rural workers 0256.”

3. Clause 2, Article 4 shall be amended and supplemented as follows:

"2. The establishment, approval, and assignment of plans for vocational training for rural workers:

- Each year, the Department of Labor, Invalids and Social Affairs shall take the lead and coordinate with the Department of Finance, the Department of Planning and Investment to compile plans for agricultural and non-agricultural vocational training for rural workers from relevant provincial departments and district-level People's Committees (including: list of trades to be trained; number of trainees; level of vocational training; orders for vocational training; training areas; proposals for facilities meeting the conditions to participate in vocational training for each trade; training costs for each trade; budget estimates for funding needs), and submit these plans to the provincial People's Committee for consideration, approval, and assignment to relevant agencies for implementation.

- Based on the approved plan by the provincial People's Committee and the application forms for vocational training submitted by rural workers eligible for support according to paragraph b, point 7.1, clause 7 of this Circular Joint, the agencies assigned by the provincial People's Committee to provide vocational training for rural workers shall enter into contracts for vocational training with facilities that meet the conditions and have been selected to provide vocational training for rural workers in accordance with the regulations."

4. Paragraph two, Clause 2, Article 6 shall be amended and supplemented as follows:

"The content and expenditure for activities of investigation and survey shall be implemented in accordance with Circular No. 58/2011/TT-BTC dated May 11, 2011 of the Ministry of Finance on the management, use, and settlement of funds for conducting statistical surveys."

5. Paragraph c, point 7.2, clause 7, Article 6 shall be amended and supplemented as follows:

"c) For contracts placed by localities:

The cost of placing orders for vocational training for each trade shall be determined by the Chairman of the Provincial People's Committee in accordance with the actual situation of the locality but shall not exceed the maximum amount specified in paragraph b, point 7.2, clause 7 of this Circular Joint."

Article 2. Implementation clause

1. This Circular Joint shall take effect from September 24, 2012, and shall apply from the fiscal year 2012.

2. During the implementation process, if there are any difficulties, please report them to the joint ministries for study and resolution./.
