DECISION

Regarding the amendment and supplementation of Article 3 of the Regulation on awarding the Commemorative Medal "For the Cause of Justice" issued together with Decision No. 102/2005/QĐ-BTP dated March 2, 2005 of the Minister of JusticePursuant to the Law on Competition and Reward dated November 26, 2003;

THE MINISTER OF JUSTICE

Pursuant to Decree No. 62/2003/NĐ-CP dated June 6, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Amend and supplement Article 3 of the Regulation on awarding the Commemorative Medal "For the Cause of Justice" issued together with Decision No. 102/2005/QĐ-BTP dated March 2, 2005 of the Minister of Justice as follows:

The Minister of Industry and Trade promulgates the Circular amending and supplementing certain provisions on the delegation of administrative procedures in fields under the management of the Ministry of Industry and Trade."

DECISION:

Article 1. 1. Point a Clause 1 of Article 3 shall be supplemented with the following paragraph after the semicolon:

"Individuals who have continuously worked for at least five years in mediation and have outstanding achievements recognized by the People's Committee at the commune level;"

2. Point d Clause 1 of Article 3 shall be amended and supplemented as follows:

"d) Individuals who have served for twenty years but have been disciplined with measures below dismissal from public service or expulsion from the Party will only be eligible for the award three years after the termination of the disciplinary decision's effect by the competent state agency or the end of the Party disciplinary period, provided they have been recognized as having corrected their mistakes and shown progress. The time spent under discipline will not be counted towards eligibility for the Commemorative Medal;"

3. Point e Clause 1 of Article 3 shall be amended and supplemented as follows:

"e) Individuals who have been dismissed from public service, expelled from the Party, or criminally prosecuted shall not be eligible for the Commemorative Medal."

Members of the Competition and Reward Council of the Justice Sector, Heads of units under the Ministry, Directors of Provincial Justice Departments, Heads of local civil enforcement agencies, and Heads of military region enforcement agencies are responsible for implementing this Decision./.

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 3. The members of the Ministry of Justice’s Competition and Reward Council, Heads of units under the Ministry, Directors of Justice Departments of provinces and centrally governed cities, Heads of local civil enforcement agencies, and Heads of military zone enforcement agencies shall be responsible for implementing this Decision./.
