THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

Pursuant to Decree No. 48/2008/ND-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 37/2011/ND-CP dated May 23, 2011 of the Government amending Decree No. 48/2008/ND-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 18/2010/ND-CP dated March 5, 2010 of the Government on training and development of civil servants;

Upon the proposal of the Director of the Civil Servant Training and Development School and the Director of the Cadre Organization Department,

DECISION:

Article 1. Position and Functions

1. The Civil Servant Training and Development School (hereinafter referred to as the School) is a public service unit under the Ministry of Home Affairs, serving the State management function of the Ministry of Home Affairs.

2. The School has the function of training and developing the professional knowledge, skills, legal knowledge, and administrative management skills within the State management domain of the Ministry of Home Affairs for cadres, civil servants, officials, People's Council representatives, and village-level cadres and civil servants; conducting scientific research, technology transfer, and international cooperation in the field of training and development.

3. The School has legal personality, possesses a seal, and is entitled to open accounts at the Treasury and banks. The School operates autonomously and is responsible for its own implementation of tasks, organizational structure, staffing, and finances according to the provisions of the law.

4. The main office of the School is located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. On planning and planning.

Based on the overall plan of the Ministry, establish long-term, five-year, and annual plans for the construction and development of the School in accordance with the requirements for training and developing cadres, civil servants, and officials, submit them to the Minister of Home Affairs for approval, and implement them after approval.

2. On Training and Development

a) Develop and submit to the Minister of Home Affairs for promulgation the training programs in accordance with regulations and implement the programs after approval.

b) Develop and revise materials for training and development of clerical staff, assistant officers, senior assistant officers; materials for training and development of department-level leadership and management in accordance with the program issued by the Minister of Home Affairs and other materials for training and development of professional knowledge and skills as prescribed.

c) Based on training and development needs and requirements of the Ministry and the Home Affairs sector, coordinate with the Cadre Organization Department to develop annual training and development plans funded by the state budget, submit them to the Minister of Home Affairs for approval, and implement them after approval.

d) Train and develop programs for national administration management according to the standards of clerical staff and equivalent positions, assistant officer and equivalent positions, senior assistant officer and equivalent positions; programs for training and development according to the standards of department-level leadership and management positions; programs for training and development of professional knowledge and skills according to job positions for cadres, civil servants, and officials in the Home Affairs sector.

đ) Train and develop programs to update and enhance knowledge and skills in various fields of national administration management for cadres, civil servants, and officials in the Home Affairs sector.

e) Pre-service training; training for promotion from clerical staff to assistant officer, from assistant officer to senior assistant officer, and training and development of cadres, civil servants, and officials in the planning pool.

g) Organize courses for updating new knowledge, in-depth training, language, computer, ethnic language, and other supplementary knowledge training for cadres, civil servants, and officials.

h) Provide legal knowledge training and administrative management skills training for People's Council representatives.

i) Train and develop legal knowledge, administrative management skills, and other skills for village-level cadres and civil servants and other subjects assigned by competent authorities.

k) Train administrative skills for civil servants and officials in public service units and enterprises in performing their duties.

l) Take the lead or participate in researching, surveying, evaluating the demand and quality of training and development of cadres, civil servants, and officials in the Home Affairs sector; propose directions for innovation and improvement of training and development quality suitable for the characteristics and requirements of the Home Affairs sector.

m) Issue certificates and certificates to cadres, civil servants, and officials after completing training and development programs in accordance with regulations.

3. On Scientific Research and International Cooperation.

a) Lead, coordinate, or participate in organizing domestic and international conferences and seminars on training and development.

b) Conduct scientific research, technology transfer, provide consulting services on training and development according to the functions, tasks, and legal provisions.

c) Cooperate and link with domestic and foreign training and development institutions in accordance with the law to train and develop professional knowledge and skills, administrative management knowledge and skills for cadres, civil servants, and officials of the Ministry, the Home Affairs sector, and other agencies and units with such needs.

4. Enter into service contracts for building recruitment exams, grade promotion exams, civil servant, and official exams.

5. Take the lead or participate in building domestic and international projects on training and development of cadres, civil servants, and officials.

6. On organization, staffing, facilities, and funding.

a) Establish the Charter of the School's organization and operation in accordance with regulations and submit it to the Minister of Home Affairs for approval.

b) Implement information, statistics, and reporting systems on the activities of the School in accordance with regulations.

c) Manage the organizational structure, staffing; contracts, recruitment, management, utilization, appointment, dismissal, disciplinary actions, transfer, rotation, appointment to grades, salary increments, resignation, retirement, and other policies and benefits for civil servants and officials according to the分级任务如下:

7. Perform other tasks assigned by the Minister and as prescribed by law.

Article 3. Organizational Structure and Working Regime

1. Structure

a) The Rector and Deputy Rectors.

The Rector is appointed by the Minister of Home Affairs, and the Deputy Rectors are appointed by the Minister of Home Affairs upon the recommendation of the Rector.

b) Departments, Faculties, and Subordinate Units

- Training and Development Department.

- Science, Technology Management and International Cooperation Department.

- Organization, Administrative, and Management Department.

- Planning and Finance Department.

- State and Law Faculty.

- Public Administration, Civil Servant, and Public Service Faculty.

- Professional Training and Development Faculty.

- Cadre and Civil Servant Training and Development Faculty at Commune Level.

- Quality Assurance Center for Training and Development.

- Information and Library Center.

- Foreign Language and Computer Center.

- Training and Development Base in the South.

- Training and Development Base in the Central Region.

- Scientific Council for Training and Development; Party and Mass Organizations.

The Rector submits to the Minister of Home Affairs the Decision to establish the Training and Development Base in the Central Region and the South.

The Rector appoints heads and deputy heads of departments, faculties, and subordinate units, and defines their functions, duties, authorities, and organizational structures.

2. System and Responsibilities

The Training and Development Institute for Cadres and Civil Servants operates under the directorate system. The Rector is responsible to the Minister of Home Affairs and the law for all activities of the Institute; Deputy Rectors are responsible to the Rector for the tasks assigned to them.

Article 4. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from July 11, 2011, and replaces Decision No. 1618/QD-BNV dated December 18, 2008, of the Minister of Home Affairs on the functions, duties, authorities, and organizational structure of the Cadre and Civil Servant Training and Development Center.

2. The Director of the Office of the Ministry, Heads of the Cadre and Civil Servant Organization Department, Heads of units under the Ministry, and the Rector of the Cadre and Civil Servant Training and Development Institute are responsible for implementing this Decision.
