Directive No. 13/2001/CT-TTg on the Summary of Ten Years of Implementing the Law on Protection, Care, and Education of Children (1991-2000)

 DIRECTIVE

Regarding the Summary of Ten Years of Implementing the Law on Protection, Care and Education of Children (1991-2000)

The Law on Protection, Care and Education of Children was adopted at the ninth session of the eighth National Assembly on August 12, 1991, and came into effect from August 16, 1991. Over ten years of implementation, this Law has been effective, providing a legal basis for protecting, caring for, and educating children, contributing to improving their material and spiritual lives, and building well-rounded Vietnamese individuals.

However, during the process of implementing the Law, there were still some shortcomings. The coordination and attention given by relevant sectors and levels to the work of protecting, caring for, and educating children have not been adequate or consistent. Some parents still lack responsibility in raising and educating their children. The supervision and inspection of the Law's implementation have not been strict enough; the handling of violations of children's rights has not been severe...

In order to enhance the effectiveness of the Law and its implementation, to promote the advantages achieved, and to address the limitations and shortcomings in the implementation of the Law; to promptly identify deficiencies and inconsistencies in the Law's provisions, and on that basis, to propose amendments and supplements to the Law to the competent authority, the Prime Minister issues the following directive:

1. Organize a nationwide summary of the results of ten years (1991-2000) of implementing the Law on Protection, Care and Education of Children, with the main requirements as follows:

a) Summarize and evaluate the implementation of the Law; the issuance and implementation of guiding documents for the Law and Decree No. 374/HĐBT dated November 11, 1991 of the Council of Ministers (now the Government) detailing the implementation of this Law in various sectors and localities; the work of establishing mechanisms and policies to implement the Law and disseminate and publicize the Law; supervision, inspection, monitoring, and inter-sectoral coordination at the central level and in localities in the implementation of the Law.

It is necessary to clearly identify the strengths, weaknesses, specific causes, and draw lessons from the work of directing and managing the protection, care, and education of children by relevant ministries and sectors, and provincial and municipal people's committees, especially in remote areas, ethnic minority regions, and economically disadvantaged areas.

Based on the summary and evaluation, propose specific measures to continue directing the implementation of this Law, accelerate the implementation of the goals of the National Action Program for Children in Vietnam for the period 2001-2010, and the human development strategy. Link the tasks of protecting, caring for, and educating children with economic and social development tasks for the period 2001-2010.

b) Through the summary and evaluation of the implementation of the provisions of this Law, propose amendments and supplements to the Law and mechanisms and policies to better implement the Law.

2. The Minister, Chairman of the Committee for Child Protection and Care shall take the lead and coordinate with the Minister of Justice and leaders of relevant ministries and sectors to be responsible for directing:

a) Develop a plan and guide the implementation of the national summary and evaluation of the results of ten years of implementing the Law on Protection, Care and Education of Children and Decree No. 374/HĐBT dated November 11, 1991 of the Council of Ministers (now the Government) detailing the implementation of this Law.

b) Study and propose to the competent authority to amend and supplement the Law on Protection, Care and Education of Children.

c) The Population, Family and Children Commission shall cooperate with the People's Court, the People's Procuracy, and related agencies and organizations at the local level to assist provincial and municipal people's committees in summarizing and evaluating the results of ten years of implementing the Law on Protection, Care and Education of Children and Decree No. 374/HĐBT dated November 11, 1991 of the Council of Ministers (now the Government) detailing the implementation of this Law.

3. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial and municipal people's committees, within the scope of their functions and responsibilities, shall be responsible for directing the summary according to the requirements set out in point 1 of this Directive; proactively arrange and allocate funds from the state budget for 2001 to implement this task; report to the Prime Minister on the results of the summary, and send it to the Committee for Child Protection and Care by the end of the third quarter of 2001.

4. The Minister, Chairman of the Committee for Child Protection and Care shall be responsible for supervising and urging the implementation of this Directive; compiling the summary results and reporting to the Prime Minister in the fourth quarter of 2001.

5. The Prime Minister requests the Supreme People's Court, the Supreme People's Procuracy, the Central Committee of the Vietnam Fatherland Front, and member organizations of the Front to cooperate with government agencies and people's committees at all levels to effectively implement this summary phase.
