Supplementing Circular No. 17/1999/TTLT-BLDTBX-MOF-BCMCPP dated July 21, 1999 guiding the implementation of Government Decree No. 23/1999/NĐ-CP dated April 15, 1999 on the regime for military personnel and cadres who went to the B, C, K battlefields during the period of fighting against the United States to save the country without direct dependents to support and military personnel and cadres sent by the Party to stay in the South to operate after the Geneva Agreement in 1954

Implementing Government Decree No. 23/1999/NĐ-CP dated April 15, 1999 and the opinion of the Prime Minister in Official Letter No. 831/CP-VX dated July 18, 2002 of the Government Office. After receiving the opinions of the Ministry of Finance in Official Letter No... dated... August 2002, the Government Cadre Organization Board (now the Ministry of Home Affairs) in Official Letter No. 96/BTCCBCP-TL dated August 6, 2002, the Ministry of Defense in Official Letter No. 2684/BQP dated August 13, 2002, the Ministry of Public Security in Official Letter No. 2375/CV-BCA dated August 7, 2002 and the Central Organization Department in Official Letter No. 1631 CV/TCTW dated August 21, 2002, the Ministry of Labor, Invalids and Social Affairs guides the implementation as follows:

I- SUBJECTS AND TIME PERIOD FOR APPLICATION OF THE REGIME

The following subjects also enjoy the B, C, K regime as stipulated in Government Decree No. 23/1999/NĐ-CP dated April 15, 1999, including:

1- Cadres working in Quang Tri (south of the 17th parallel) after the 1954 Geneva Agreement, who were organized to move north of the 17th parallel, then were organized to return to the South to operate (excluding those receiving salaries in the North). The time for enjoying the regime is calculated from when they were assigned to operate in the South.

2- Cadres and military personnel from the South, after the 1954 Geneva Agreement, moved north, then returned to the battlefield (B, C, K) to perform tasks, still being non-commissioned officers or soldiers without direct dependents to support in the North at the time of departure. The time for enjoying the regime is calculated from when they returned to the battlefield to perform tasks.

3- Village and ward cadres who did not evacuate before the 1954 Geneva Agreement, continuing to operate in villages and wards in provinces and cities south of Quang Tri from July 1954 to May 1955. The time for enjoying the regime is calculated from July 1954.

4- In cases where the wife and husband or only the wife or husband moved north, then returned to the battlefield (B, C, K) to perform tasks, if there are children left in the North under 18 years old who do not receive state allowances. The time for enjoying the regime is calculated from when they returned to the battlefield to perform tasks.

II. IMPLEMENTATION

1- Regarding the method of calculating time, the amount of one-time benefit; procedures and organization of implementation shall be carried out according to the provisions of Circular No. 17/1999/TTLT-BLDTBX-MOF-BCMCPP dated July 21, 1999 of the Joint Circular of the Ministry of Labor, Invalids and Social Affairs, the Ministry of Finance, and the Government Cadre Organization Board guiding the implementation of Government Decree No. 23/1999/NĐ-CP dated April 15, 1999.

2- For the subjects specified in Point 2, Section 1 above, if they have already enjoyed a one-time benefit (as officers or those receiving salaries) according to the provisions of Government Decree No. 23/1999/NĐ-CP dated April 15, 1999, the time already enjoyed must be deducted.

3- For village and ward cadres specified in Point 3, Section I above, the Provincial Party Committee, Municipal Party Committee directly under the Central Government shall instruct relevant departments, levels of party committees and local authorities to examine and decide each case of village and ward cadres entitled to the policy stipulated in Government Decree No. 23/1999/NĐ-CP. After the Provincial Party Committee, Municipal Party Committee has made specific decisions, the Implementation Steering Committee for the B, C, K regime shall be responsible for helping the People's Committee complete all necessary files and procedures according to the provisions of Circular No. 17/1999/TTLT-BLDTBX-MOF-BCMCPP dated July 21, 1999 mentioned above.

This circular takes effect from the date of signature.

During the implementation process, if there are difficulties, please report them to the Joint Ministries for consideration and resolution.
