Decision No. 13/2002/NQ-CP dated November 19, 2002 of the Government
On measures to curb the increase and gradually reduce traffic accidents and traffic congestion
On October 30, 2002, at the regular meeting of October 2002
The Government heard the report from the Minister of Transport and Chairman of the National Traffic Safety Committee on the situation of traffic accidents, traffic congestion, immediate and fundamental solutions to address these issues. After discussion, the Government resolved as follows: Traffic accidents and traffic congestion cause significant losses in terms of human lives and property for the State and people, posing urgent problems that require the Party and State, primarily the Government, relevant ministries and agencies, local Party committees and authorities, to concentrate efforts on leadership and guidance to effectively resolve this prominent issue. The increase in traffic accidents and congestion is due to many reasons, but mainly because of shortcomings and deficiencies in State management and poor awareness in complying with traffic laws among road users.
To address the aforementioned weaknesses, it is necessary to strive with comprehensive and resolute measures to achieve the goal of curbing and gradually reducing the rate of increase in road traffic accidents and urban traffic congestion, particularly in Hanoi, Ho Chi Minh City, and other cities and towns. The Government requests relevant ministries and provincial/municipal People's Committees under the Central Government to immediately implement the following measures:
1. The Ministry of Transport shall supplement and complete the strategy and planning for the development of transportation infrastructure and road vehicles, especially in Hanoi, Ho Chi Minh City, and other cities and towns; clearly reflecting appropriate development plans for various types of road transport vehicles prioritizing public transport and minimizing private vehicles, to be submitted to the Government by December 2002.
2. Relevant ministries, agencies, and local People's Committees are responsible for concentrating investment and issuing preferential policies to rapidly develop public passenger transport in urban areas, particularly focusing on bus services; Hanoi, Ho Chi Minh City, and other densely populated cities must establish state-owned enterprises capable of fulfilling public passenger transport tasks; issuing specific policies to encourage economic sectors to participate in public passenger transport according to planning and encouraging citizens to use public transport; organizations and enterprises with large numbers of employees in areas without bus routes must organize shuttle services for their staff.
Prioritize investment capital for the development of urban transportation infrastructure, first addressing traffic junctions, ring roads, and radial roads; promptly developing proposals for the development of passenger transport vehicles capable of carrying large numbers of passengers in cities such as electric trains, subway cars...
Alongside the development of public passenger transport and investment in urban transportation infrastructure, it is necessary to urgently implement comprehensive measures to curb the increase in motorcycles and scooters, aiming to gradually reduce their number circulating within city centers.
The National Traffic Safety Committee shall coordinate with the People's Committees of Hanoi and Ho Chi Minh City to formulate strict and appropriate timelines and measures to maximize the curtailment of motorcycle and scooter increases, including considering the temporary suspension of new motorcycle and scooter registrations and specifying
certain routes, areas, and times when motorcycles and scooters are not allowed to circulate to mitigate traffic congestion. 3. Firmly restore order and discipline in compliance with traffic laws. The Ministry of Public Security shall focus on directing and strengthening forces to guide and control traffic smoothly; implementing coercive measures to enforce traffic laws, prioritizing inspections and penalties for motorcyclists without licenses, firmly ending the situation of unlicensed motorcyclists; simultaneously increasing patrols, inspections, and severe penalties for violations by motorcyclists and scooter riders such as: being below the required age, illegal racing, speeding, weaving dangerously,...

To reduce casualties from head injuries caused by traffic accidents, traffic police must resolutely penalize those individuals Operating and sitting on motorcycles and motorbikes without wearing helmets on sections of roads where helmet-wearing is mandatory. The Ministry of Transport shall be responsible for reviewing and adjusting the sections of road where helmets must be worn when riding motorcycles and motorbikes to ensure compliance.
The Ministry of Transport must regularly inspect training institutions and examination procedures for issuing driving licenses, firmly revoking the training permits of institutions that do not meet the prescribed standards, suspending operations and strictly punishing Examination Boards if there are violations or if examiners engage in corrupt behavior; promulgating regulations on re-examination and replacement of driving licenses according to appropriate schedules without causing undue inconvenience to the public.
The Ministry of Public Security shall take the lead and coordinate with the Ministry of Transport to issue regulations on marking the number of traffic law violations on current driving licenses to manage drivers of motor vehicles (including motorcycle drivers); directing the assignment of traffic police officers as examiners to participate in Examination Boards to issue driving licenses for the transport sector.
The Ministry of Education and Training shall be responsible for directing the management and education of students to comply with laws on traffic safety, ensuring that students under the required age do not ride motorcycles or motorbikes to school; continuing to expand legal education on traffic safety in schools nationwide.
4. The Ministry of Public Security shall strengthen inspections and strictly handle, in accordance with the provisions of the law, cases where cars do not meet the technical safety standards for circulation on roads.
The Ministry of Transport shall organize reviews and strictly manage vehicle inspection work and severely punish inspectors who engage in corrupt behavior; submit to the Government policies to support vehicle owners who comply well with Decree No. 92/2001/NĐ-CP dated December 11, 2001 of the Government regarding conditions for operating passenger and cargo transportation by road.
5. When registering motorcycles and motorbikes, applicants must present their driving license; purchase compulsory civil liability insurance for motor vehicles; and pay various fees and charges as prescribed. The Ministry of Public Security shall provide guidance on implementing this regulation.
The Ministry of Finance shall study amendments and supplements to fee rules, increase the level of compulsory civil liability insurance for motor vehicles; raise the rate of initial registration fees, registration fees, and circulation fees for motorcycles and motorbikes in cities and towns; and simultaneously issue financial policies to support the development of public bus transportation and investment in urban traffic infrastructure.
6. The Ministry of Public Security shall submit to the Government a proposal to increase staffing and equipment for traffic police and propose appropriate policies on training and incentives for traffic police directly performing tasks to maintain traffic order and safety; regularly educate to enhance responsibility, moral character, and professional skills of traffic police; promptly reward and strictly punish officers and soldiers who engage in corrupt behavior while on duty. 7. The Ministry of Culture, Sports and Tourism shall be responsible for taking the lead and coordinating with relevant agencies to organize and mobilize central and local mass media organizations, primarily the People's Army Newspaper, Vietnam Television, Voice of Vietnam Radio, etc., to participate in propaganda and education on awareness of compliance with laws on traffic safety for all social strata and implement the measures outlined in this Resolution of the Government.
8. Ministries, relevant agencies, provincial and municipal people's committees directly subordinate to the Central Government must have programs and plans to strictly and effectively implement the above measures within their scope of responsibility and authority, viewing this as a key ongoing political task.
Provincial and municipal people's committees directly subordinate to the Central Government shall be responsible for directing the clearance of encroachments on sidewalks, road surfaces, and traffic safety corridors in their respective areas.
9. The National Traffic Safety Committee shall be responsible for urging and inspecting the implementation of this Resolution, reporting monthly to the Prime Minister on the results of its implementation.
It is requested that the Political Bureau issue directives to Party committees at all levels to adopt resolutions to strengthen leadership over traffic safety assurance work in localities.
