CIRCULAR

Supplemental Guidelines for Circular No. 17/1999/TTLT-BLDTBXH-BTC-BTCCBCP dated July 21, 1999 guiding the implementation of Government Decree No. 23/1999/NĐ-CP dated April 15, 1999 on the treatment of military personnel and cadres dispatched to the B, C, K battlefields during the period of resisting America and saving the country without direct dependents to support and military personnel and cadres sent by the Party to continue activities in the South after the 1954 Geneva Agreement.

 

Implementing Government Decree No. 23/1999/NĐ-CP dated April 15, 1999 and the Prime Minister's opinion in Official Letter No. 831/CP-VX dated July 18, 2002 from the Government Office. After receiving opinions from the Ministry of Finance in Official Letter dated August 2002, the Government Cadre Organization Department (now the Ministry of Home Affairs) in Official Letter No. 96/BTCCBCP-TL dated August 6, 2002, the Ministry of Defense in Official Letter No. 2684/BQP dated August 13, 2002, the Ministry of Public Security in Official Letter No. 2375/CV-BCA dated August 7, 2002, and the Central Organization Department in Official Letter No. 1631 CV/TC TW dated August 21, 2002, the Ministry of Labor, Invalids, and Social Affairs guides the implementation as follows:

 

I. Objectives and Time Period for Application of the Treatment Regime.

The following subjects also enjoy the B, C, K treatment regime as stipulated in Government Decree No. 23/1999/NĐ-CP dated April 15, 1999, including:

1. Cadres working in Quảng Trị (south of the 17th parallel) after the 1954 Geneva Agreement who were organized to move north of the 17th parallel and then reorganized to work in the South (excluding those receiving salaries in the North). The time for enjoying the treatment regime starts from when they were assigned to work in the South.

2. Military personnel and cadres from the South, after the 1954 Geneva Agreement, moved to the North, and then returned to the battlefield (B, C, K) to perform tasks, still being non-commissioned officers or soldiers without direct dependents to support in the North. The time for enjoying the treatment regime starts from when they returned to the battlefield to perform tasks.

3. Village and ward cadres not detached before the 1954 Geneva Agreement continuing to work in their villages and wards after the agreement (from July 1954 to May 1955) in provinces and cities south of Quảng Trị. The time for enjoying the treatment regime starts from July 1954.

4. In cases where the wife and husband or only the wife or husband moved to the North, then returned to the battlefield (B, C, K) to perform tasks, if there are children left in the North under 18 years old not receiving state allowances. The time for enjoying the treatment regime starts from when they returned to the battlefield to perform tasks.

II. Implementation

1. Regarding the calculation of time, the level of one-time treatment benefits, procedures, and documentation, and organization of implementation shall be carried out according to Circular No. 17/1999/TTLT-BLDTBXH-BTC-BTCCBCP dated July 21, 1999 issued by the Joint Circular of the Ministry of Labor, Invalids, and Social Affairs, the Ministry of Finance, and the Government Cadre Organization Department guiding the implementation of Government Decree No. 23/1999/NĐ-CP dated April 15, 1999.

2. For the subject mentioned in Point 2, Section I above, if they have already enjoyed a one-time treatment benefit (as officers or those receiving salaries) according to the provisions of Government Decree No. 23/1999/NĐ-CP dated April 15, 1999, when calculating the current treatment benefit, the time already enjoyed must be excluded.

3. For the subject mentioned in Point 3, Section I above, after collecting all relevant files and biographies, the provincial or municipal B, C, K treatment review committee shall report to the Provincial or Municipal Party Committee for consideration and decision on each specific case.

4. This Circular takes effect from the date of issuance.

During the implementation process, if there are any difficulties, please report them to the relevant ministries, departments, and local agencies for examination and resolution by the Joint Ministries./.
