Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, authorities, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 36/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
Pursuant to Circular No. 148/BNV-CCVC dated January 29, 2004 of the Ministry of Home Affairs on the issuance of Professional Standards and Business Skills for Construction Sector Leadership Civil Servants at Local Levels;
CONSIDERING THE PROPOSAL OF THE HEAD OF THE ORGANIZATION AND STAFF AFFAIRS DEPARTMENT;
DECISION:
Article 1. This Decision hereby promulgates the regulations on Professional Standards and Business Skills for Construction Sector Leadership Civil Servants at Local Levels attached hereto.
Article 2. The aforementioned Professional Standards and Business Skills shall serve as the basis for the Chairpersons of People's Committees of provinces and centrally governed cities to implement planning, training, capacity building, appointment, and salary grading for Construction Sector Leadership Civil Servants at Local Levels.
Article 3. This Decision takes effect fifteen days after its publication in the Official Gazette. All previous regulations that conflict with this Decision are hereby abolished.
The Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.

PART I
GENERAL PROVISIONS
Article 1. Scope and Objects Regulated
The scope of regulation of this Provision is the Professional Standards and Business Skills for Construction Sector Leadership Civil Servants at Local Levels.
The regulated subjects include the positions of Director and Deputy Director of the Construction Departments and Director and Deputy Director of the Planning and Architecture Departments of provinces and centrally governed cities (hereinafter referred to collectively as provinces).
Article 2. General Standards
Construction Sector Leadership Civil Servants at Local Levels must meet the following standards:
1. Possess a profound sense of patriotism, dedication to serving the people; have a firm political stance, resolute in the goals of national independence and socialism, daring to think, act, and take personal responsibility; have awareness and capability to defend the Party’s viewpoints and the State’s policies and laws.
2. Set an example in morality, lifestyle, thriftiness, integrity, impartiality, and incorruptibility; firmly resist corruption; have a sense of organizational discipline, honesty, and non-partisanship; have a democratic, scientific work style, credibility, and trust from the staff and civil servants within the unit.
3. Have knowledge and understanding of political theory, the Party’s viewpoints and policies, the State’s policies and laws; possess expertise and experience in leadership science and management; have knowledge and understanding of Construction Sector professional skills, sufficient capability and health to work effectively and meet assigned tasks.
4. Have the ability to effectively implement the Party’s guidelines and policies, the State’s policies and laws, and local policies in the assigned fields of work within the province; have a learning spirit and dedication to improving knowledge about management and professional skills, and advancements in science and technology related to the development of the Construction Sector.
5. Have the ability to unite, gather, and mobilize the cadre, civil servants, and employees within the unit, and coordinate with relevant departments and units to complete assigned tasks.
Chapter II
SPECIFIC PROFESSIONAL STANDARDS AND BUSINESS SKILLS
FOR CONSTRUCTION DEPARTMENT LEADERSHIP CIVIL SERVANTS
Article 3. Director of the Department of Construction
1. Responsibilities:
The Director of the Department of Construction is a leading civil servant heading the machinery of the Department of Construction, responsible for leading, directing, and managing the activities of the Department to fulfill its advisory function and assist the People's Committee of the province in state management over areas within the scope of state management of the construction sector at the local level, specifically as follows:
1.1. In Hanoi City and Ho Chi Minh City: The Director of the Department of Construction is responsible for leading, directing, and managing the activities of the Department to fulfill its advisory function and assist the People's Committee of the city in state management over areas such as construction, building materials, housing, and public buildings;
1.2. In other centrally-administered cities: The Director of the Department of Construction is responsible for leading, directing, and managing the activities of the Department to fulfill its advisory function and assist the People's Committee of the city in state management over areas such as construction, building materials, housing, and public buildings, architecture, urban planning, rural residential area planning;
1.3. In the remaining provinces: The Director of the Department of Construction is responsible for leading, directing, and managing the activities of the Department to fulfill its advisory function and assist the People's Committee of the province in state management over areas such as construction, building materials, housing, and public buildings, architecture, urban planning, rural residential area planning, urban technical infrastructure; (streets, urban roads, water supply, drainage, lighting, parks, green spaces, urban waste, cemeteries, parking lots within urban areas).
1.4. The Director of the Department of Construction is accountable to the Chairman of the People's Committee of the province, and simultaneously accountable to the Minister of Construction in the performance of functions and tasks of state management over sectors assigned and delegated according to the regulations of the law on the provincial territory.
2. Tasks:
2.1. Leading, directing, urging, and inspecting staff members of the Department of Construction in the implementation of state management tasks of the construction sector on the provincial territory as assigned by the People's Committee of the province according to the regulations of the law and guidance from the Ministry of Construction.
2.2. Deciding issues within the authority of the Director of the Department of Construction according to the regulations of the law or by delegation from the Chairman of the People's Committee of the province.
2.3. Reporting periodically and urgently on the situation of task implementation in assigned sectors before the People's Committee of the province, the Ministry of Construction, and competent authorities according to the regulations of the law.
3. Specific criteria:
3.1. Understanding and capacity:
- Proficient in the Party's guidelines, State policies, and laws, and normative legal documents issued by the State regarding the work sectors of the Department and related sectors;
- Proficient in the situation and development orientation in sectors under the scope of state management of the construction sector at the local level;
- Possess organizational, managerial, and operational capabilities to effectively implement state management tasks of the construction sector assigned on the provincial territory;
- Possess the ability to handle, organize the implementation, and propose normative legal documents, economic-technical solutions, specialized, and vocational measures to serve the state management work of the construction sector at the local level.
3.2. Specialization and vocational qualifications:
- Graduated from university or higher in one of the following majors: construction (civil and industrial works, transportation works, hydraulic works); architecture, construction planning; building materials; construction machinery; construction economics; urban technical infrastructure and environment;
- Achieved vocational standards of senior specialist grade or above.
3.3. Political aspect: Hold a high-level theoretical political studies degree or bachelor's degree in political economy.
3.4. Foreign language: Possess proficiency in using at least one common foreign language at level C. For mountainous provinces with ethnic minorities, must know at least one ethnic minority language of the locality (instead of a foreign language).
3.5. Management experience:
Previously held at least one of the following management positions:
- Deputy Director of the Department of Construction, Department of Planning and Architecture, Department of Land Administration and Real Estate, Department of Transportation and Public Works;
- Other equivalent Deputy Director positions but previously held the position of Head of Professional Departments or Heads of Units under the Department of Construction, Department of Planning and Architecture, Department of Land Administration and Real Estate, Department of Transportation and Public Works or Directors of enterprises under the construction sector.
3.7. The initial appointment age shall not exceed 55 years old for males and 50 years old for females.
Article 4. Deputy Director of the Construction Department
1. Responsibilities:
The Deputy Director of the Construction Department is a leading civil servant assisting the Director of the Department, assigned by the Director to be responsible for one or more areas of work within the Department, and is accountable to the Director for the tasks assigned in accordance with the law.
2. Tasks:
2.1. Organize and direct the implementation of tasks in the areas assigned by the Director of the Department.
2.2. Represent the Director of the Department in managing and directing the activities of the Department and deciding issues within the scope of duties and powers of the Director when authorized by the Director.
3. Specific criteria:
3.1. Understanding and capacity:
- Be thoroughly familiar with the Party's policies, State policies and laws, and normative legal documents issued by the State concerning the areas of work assigned by the Director of the Department and related areas;
- Be thoroughly familiar with the situation and development orientation in the areas assigned on the provincial territory;
- Possess management and leadership capabilities and effectively organize the implementation of assigned tasks;
- Have the ability to handle, organize the implementation of, and propose normative legal documents, economic and technical solutions, specialized and professional measures to serve state administration in the areas assigned by the Director of the Department on the provincial territory.
3.2. Specialization and vocational qualifications:
- Graduated from university or higher in one of the following majors: construction (civil and industrial works, transportation works, hydraulic works); architecture, construction planning; building materials; construction machinery; construction economics; urban technical infrastructure and environment;
- Achieved vocational standards of senior specialist grade or above.
3.3. Political aspect: Hold a high-level theoretical political studies degree or bachelor's degree in political economy.
3.4. Regarding foreign languages: Be proficient in at least one commonly used foreign language at level C. For mountainous provinces with ethnic minorities, knowledge of at least one ethnic minority language in the locality is required (in lieu of a foreign language).
3.5. Management experience:
Previously held at least one of the following management positions:
- Head of business units or heads of public service units under the Construction Department, Planning and Architecture Department, Land Administration and Real Estate Department, Transportation and Public Works Department; Directors of construction enterprises;
- Other equivalent positions to Heads of business units of the Department but previously held positions such as Deputy Heads of business units or Deputy heads of public service units of the Construction Department, Land Administration and Real Estate Department, Planning and Architecture Department, Transportation and Public Works Department or Deputy Directors of construction enterprises.
3.6. The initial appointment age shall not exceed fifty years for males and forty-five years for females.
Chapter III
SPECIALIZED AND PROFESSIONAL STANDARDS FOR LEADING CIVIL SERVANTS OF THE PLANNING AND ARCHITECTURE DEPARTMENT
Article 5. Director of the Planning and Architecture Department
1. Responsibilities:
1.1. The Director of the Planning and Architecture Department is a leading civil servant heading the departmental machinery, responsible for leading, directing, and managing the activities of the Department to fulfill advisory and assistance functions for the People's Committee of the province in state administration over architecture, urban construction planning, and rural residential area construction planning in the locality.
1.2. The Director of the Planning and Architecture Department is accountable to the Chairman of the People's Committee of the province, and simultaneously accountable to the Minister of Construction regarding the performance of state administration functions and tasks in the assigned areas according to the law.
2. Tasks:
2.1. Lead, direct, urge, and inspect staff members of the Planning and Architecture Department in the implementation of state administration tasks in the fields of architecture, urban construction planning, and rural residential area construction planning assigned by the People's Committee of the province according to the law and guidelines from the Ministry of Construction.
2.2. Decide issues within the authority of the Director of the Planning and Architecture Department as stipulated by law or delegated by the Chairman of the People's Committee of the province.

- Have the ability to handle, research, organize the implementation of, and propose normative legal documents, economic and technical solutions, specialized and professional measures to serve state administration in the fields of architecture, urban construction planning, and rural residential area construction planning in the locality.
3.2. Specialization and vocational qualifications:
- Hold a bachelor's degree or higher in one of the following specialties: architecture, construction planning;
- Achieved vocational standards of senior specialist grade or above.
3.3. Political aspect: Hold a high-level theoretical political studies degree or bachelor's degree in political economy.
3.4. Regarding foreign languages: Be proficient in at least one commonly used foreign language at level C.
3.5. Management experience:
Previously held at least one of the following management positions:
- Deputy Director of the Planning and Architecture Department, Construction Department;
- Other equivalent positions to Deputy Directors of Departments but previously held positions such as Heads of business units or Heads of public service units of the Planning and Architecture Department, Construction Department or Directors of consulting enterprises operating in the field of architecture and construction planning.
3.7. The initial appointment age shall not exceed 55 years old for males and 50 years old for females.
Article 6. Deputy Director of the Department of Planning and Architecture
1. Responsibilities:
The Deputy Director of the Department of Planning and Architecture is a leading civil servant assisting the Director of the Department, assigned by the Director to oversee one or more areas of work within the Department, and is responsible to the Director for the tasks assigned in accordance with the provisions of the law.
2. Tasks:
2.1. Organize and direct the implementation of tasks in the areas assigned by the Director of the Department.
2.2. Represent the Director of the Department in managing and directing the activities of the Department and deciding issues within the scope of duties and powers of the Director when authorized by the Director.
3. Specific criteria:
3.1. Understanding and capacity:
- Be thoroughly familiar with the Party's policies, State policies and laws, and normative legal documents issued by the State concerning the areas of work assigned by the Director of the Department and related areas;
- Be thoroughly familiar with the situation and development orientation in the areas assigned on the provincial territory;
- Possess management and leadership capabilities and effectively organize the implementation of assigned tasks;
- Possess the ability to handle, implement, and propose regulatory legal documents, economic and technical solutions, specialized knowledge, and professional skills to serve state management work in the assigned fields on the provincial territory.
3.2. Specialization and vocational qualifications:
- Hold a bachelor's degree or higher in one of the following specialties: architecture, construction planning;
- Achieved vocational standards of senior specialist grade or above.
3.3. Political aspect: Hold a high-level theoretical political studies degree or bachelor's degree in political economy.
3.4. Regarding foreign languages: Be proficient in at least one commonly used foreign language at level C.
3.5. Management experience:
Has held at least one of the following managerial positions:
- Head of a business unit or Director of a public service unit of the Department of Planning and Architecture, Department of Construction; Director of a private consulting enterprise operating in the field of architecture and construction planning;
- Other equivalent positions to the Head of a business unit of the Department but previously held the position of Deputy Head of a business unit or Deputy Director of a public service unit of the Department of Planning and Architecture, Department of Construction, or Deputy Director of a private consulting enterprise operating in the field of architecture and construction planning.
3.7. The initial appointment age shall not exceed fifty years for males and forty-five years for females.
Chapter V
IMPLEMENTING PROVISIONS
Article 7. This provision takes effect fifteen days from the date of publication in the Official Gazette and replaces the Professional Standards for the Director of the Department of Construction and the Director of the Land Administration Department issued together with Decision No. 178/BXD-TCLĐ dated June 7, 1994 of the Minister of Construction. All previous regulations and guidelines that conflict with this provision are hereby abolished.
Article 8. This provision serves as the basis for the Chairman of the People's Committee of provinces and centrally governed cities to implement training, development, and appointment of leading civil servants in the Construction sector at the local level.
Article 9. The Chairman of the People's Committee of provinces and centrally governed cities is responsible for implementing this provision./.
