Regarding functions, tasks, powers, and organizational structureof Industrial Safety Technology Agency

THE MINISTER OF INDUSTRY

On the basis of Decree No. 55/2003/NĐ-CP dated May 28, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry;

At the proposal of the Director of the Personnel and Organization Department and the Director of the Industrial Safety Technology Agency,

Article 1. Position and Functions

The Industrial Safety Technology Agency under the Ministry of Industry shall perform state management functions for industrial safety technology, including: machinery, metallurgy, electricity, new energy, renewable energy, oil and gas (excluding equipment and means for offshore oil exploration), mineral extraction, chemicals (including pharmaceuticals), industrial explosives, consumer industry, food industry, other processing industries, and the environment within the industrial sector as prescribed by law.

The Industrial Safety Technology Agency has legal personality; it may open accounts at the State Treasury and banks; its operating funds are provided from the state budget; it has a separate seal for operations and transactions in accordance with the law; its main office is located at No. 54 Hai Ba Trung Street, Hoan Kiem District, Hanoi City.

Article 2. Tasks and Powers of the Industrial Safety Technology Agency

1. To draft or participate in drafting normative legal documents; mechanisms and policies on industrial safety technology fields to be submitted to the Minister for issuance or to competent authorities for issuance; to guide and inspect their implementation.

2. To draft and submit to the Minister for issuance technical standards, procedures on industrial safety technology as specified in Article 1 of this Decision.

3. To guide and inspect the implementation of technical standards, regulations, and procedures on industrial safety technology.

4. To organize registration, inspection, and issue certificates on industrial safety technology for machines, equipment, materials, and substances requiring strict labor safety according to the list issued by the Ministry of Labor, Invalids and Social Affairs; machines, equipment, materials, and substances with special safety requirements according to the list issued by the Ministry of Industry.

a) To inspect the quality of electrical equipment, tools, and products according to electrical safety standards.

b) To inspect the quality of goods and products in accordance with the law.

5. To review and submit to the Minister for recognition units meeting technical safety conditions for manufacturing, installing, repairing pressure equipment, lifting equipment, and regular inspections of gas containers and liquefied gas containers of units in the industrial sector.

6. To lead the review and submit to the Minister for issuing certificates of eligibility for producing industrial explosives, business licenses, and usage permits for industrial explosives in accordance with the law; to coordinate with inter-ministerial bodies to supervise and inspect technical safety in the production, storage, transportation, and use of industrial explosives.

7. To manage radiation safety, fire prevention, and firefighting work in the industrial sector.

8. To review or participate in reviewing technical safety solutions in investment projects, technical designs, construction designs of basic construction works of units under the Ministry of Industry.

9. To lead or coordinate with relevant state management agencies to investigate causes of accidents related to technical safety in the industrial sector and propose remedial measures.

10. Regarding the environment in the industrial sector:

a) To inspect and monitor compliance with environmental laws in the industrial sector;

b) To conduct monitoring, measurement, assessment, and handling of environmental impacts in the industrial sector;

c) To develop and expand databases on environmental protection to serve state management by the Ministry and provide information to organizations, agencies, and units as required by law;

d) To advise and transfer environmental technologies to agencies and units inside and outside the sector;

đ) To organize professional guidance, propaganda, and information dissemination on environmental protection.

11. To organize training and professional guidance on industrial safety technology and environmental protection for units in the industrial sector.

12. To implement international cooperation in the field of industrial safety technology in accordance with the law.

13. To serve as the standing body of the Flood and Storm Prevention Steering Committee of the Ministry of Industry.

14. To serve as the standing body of the Occupational Safety and Health and Fire Prevention and Control Steering Committee of the Ministry of Industry.

15. To manage organizational structure, staffing, and assets assigned in accordance with the law and the Ministry of Industry.

16. To carry out other tasks and activities assigned by the Minister.

Article 3. Organizational Structure of the Industrial Safety Technology Department

1. Leadership:

a) Director;

b) Deputy Directors.

The Director of the Industrial Safety Technology Department is responsible to the Minister for all activities of the Department. Deputy Directors assist in managing specific areas of work assigned by the Director;

The Director and Deputy Directors are appointed and relieved from duty by the Minister.

2. Supporting machinery of the Director, including:

a) Office;

b) Organization, Training and International Cooperation Division;

c) Electrical Division;

d) Mines and Oil and Gas Division;

đ) Mechanical and Pressure Division;

e) Chemicals and Industrial Explosives Division;

g) Environment Division.

3. Revenue-generating units:

a) Industrial Safety Technical Inspection Center I;

b) Industrial Safety Technical Inspection Center II.

4. Service unit: Industrial Safety and Environmental Technical Support Center.

The Director of the Industrial Safety Technology Department is responsible for defining functions, tasks, and arranging and organizing staff of the Department to ensure streamlined operations and effective performance.

Article 4. Effectiveness and Responsibility for Implementation

This Decision takes effect fifteen days after its publication in the Official Gazette and replaces Decision No. 114/2003/QĐ-BCN dated July 4, 2003, issued by the Minister of Industry.

The Head of the Ministry’s Office, the Inspector General of the Ministry, Heads of Departments, Directors of Cuc, Heads of agencies and units under the Ministry, and the Director of the Industrial Safety Technology Department are responsible for implementing this Decision./.
