Regulations on the functions, tasks, powers, and organizational structure of the Cadre and Civil Servant Organization Department

MINISTER OF INFORMATION AND COMMUNICATIONS

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;

At the proposal of the Director of the Cadre and Civil Servant Department,

DECISION:

Article 1. Position and Functions

The Cadre and Civil Servant Organization Department is the advisory body assisting the Minister in performing state management functions regarding organization work, cadres, civil servants, public officials, performance of official duties, training, human resource development, salary, promotion of civil servant ranks, commendation and reward for fields under the Ministry's jurisdiction as prescribed by law; protecting internal political security according to the law.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

Take the lead in drafting and guiding the implementation of normative legal documents on organization work, cadres, civil servants, public officials, performance of official duties, utilization, training, human resource development, salary, commendation, and reward within the fields under the Ministry's jurisdiction;

Take the lead or coordinate in researching and implementing policies and measures on building and developing organization work, cadres, civil servants, public officials, and performance of official duties;

Draft and guide the implementation of regulations on functions, tasks, powers, organizational structure, and activities of units under the Ministry; regulations on hierarchical management of organization and cadres within the Ministry;

Organize research and build plans and programs on organization work; uniformly manage the construction of the organizational apparatus of the Ministry;

Draft, organize the implementation, and inspect rules and procedures for recruitment, utilization, transfer, and rotation of cadres, civil servants, and public officials under the Ministry according to the law and the Minister's delegation;

Take the lead and guide the implementation of evaluations and assessments of cadres, civil servants, and public officials as prescribed; guide and direct inspection and audit activities of civil servants;

Research and build cadre planning; implement procedures for appointment, removal, resignation, and retirement of cadres under the Ministry's management;

Implement systems and policies on grading, salary increment, rank promotion, job transfer, social insurance, health care, incentives, and disciplinary actions for cadres, civil servants, and public officials under the Ministry's management; manage cadres' and civil servants' files according to the law; organize statistical work on civil servant grades under the Ministry;

Take the lead in establishing professional standards for civil servant grades in sectors and fields assigned and delegated to the Ministry for the Ministry of Home Affairs to promulish; draft and guide the implementation of staffing, salary funds, technical and vocational standards in fields under the Ministry's jurisdiction; allocate quotas and manage staffing of the Ministry; review unit wage rates according to authority;

Draft and submit to the Minister for promulgation professional standards for public official grades in sectors and fields assigned and delegated to the Ministry after receiving the Ministry of Home Affairs' review opinion; take the lead and coordinate with units under the Ministry and relevant agencies to organize examinations for grade promotion of specialized public officials in information and communication;

Draft and submit to the Minister for promulgation professional standards for heads of specialized administrative bodies of provincial People's Committees directly under the Central Government in sectors and fields managed by the Ministry;

Organize the drafting of plans and programs for training, upgrading, and enhancing professional knowledge and skills of cadres, civil servants, and public officials, submit them to the Minister for approval, and guide units in their implementation;

Guide and inspect the implementation of regulations on training and upgrading activities of schools under the Ministry; manage the issuance of training and upgrading certificates according to the Government's regulations;

Take the lead in organizing research to develop mechanisms and policies to promote and support training, upgrading, and human resource development in fields under the Ministry's national administration, submit them to the Minister for approval, and organize their implementation after obtaining approval from competent authorities;

Organize the implementation of commendation and reward work and the history and tradition of the Ministry according to the law; perform the standing committee tasks of the Ministry's Commendation and Reward Council;

Research and build specific measures and guide the implementation of service operation mechanisms for organizations in the information and communication sector according to the law; manage and direct the activities of affiliated organizations under the Ministry according to the law;

Regarding the representation of state ownership in state-owned enterprises:

a) Organize the review of proposals for establishment, restructuring, reorganization, and ownership conversion of enterprises to be submitted by the Minister;

b) Advise the Minister to propose to the Prime Minister for the appointment, reappointment, removal, or appointment according to authority of leadership and management positions, chief accountants of unlisted state-owned enterprises;

c) Organize the review and submit to the Minister for approval according to authority or propose to the Prime Minister for approval the charter of organization and operation of unlisted state-owned enterprises;

Coordinate in drafting and organizing the implementation and guidance of the plan to implement the program of administrative reform of the Ministry according to the goals and content of state administrative reform approved by the Prime Minister;

Take the lead in organizing the review of association and non-governmental organization establishment files; submit to the Minister for recognition of association formation committees; participate in managing the activities of associations and non-governmental organizations within the Ministry's jurisdiction;

Regarding the management of press and publishing agencies:

a) Take the lead and coordinate with units under the Ministry and relevant agencies to draft and submit to the Minister for promulgation professional standards for heads of press and publishing agencies;

b) Submit to the Minister for approval the appointment, removal of directors and general editors of publishing houses under the Ministry; the appointment, removal of deputy general editors, general managers, deputy general managers, directors, and deputy directors of press agencies under the Ministry;

Manage the reserve, mobilization, self-defense militia, military rear policy, and revolutionary merit policy of the Ministry; 

Participate in research and provide comments on draft regulations and normative legal documents of other ministries and sectors in the fields of organization, cadres, training, capacity building, human resource development, salary, social policies, commendation and reward, and traditional history;

Carry out tasks assisting the Party Cadre Affairs Committee and internal political security work;

Manage the organization, cadres, civil servants, officers, assets, and documents of the Department in accordance with the provisions of the law and the delegation of the Minister;

Perform other tasks assigned by the Minister;

Article 3. Organizational Structure

The Organization and Cadre Department has a Director and Deputy Directors. The Director is responsible to the Minister for organizing and implementing the functions, tasks, and authorities delegated. The Deputy Directors assist the Director in directing and managing all aspects of the Department's work and are responsible to the Director for the tasks assigned to them;

Organizational structure:

- Training Division;

- Commendation and Reward Division;

- Professional staff directly assisting;

The functions, tasks, and authorities of the Divisions are established by the Director of the Organization and Cadre Department and submitted to the Minister for decision;

The tasks and authorities of professional civil servants in the Department are stipulated by the Director;

Article 4. Effective date

This Decision takes effect fifteen days from the date of publication in the Official Gazette. Decree No. 18/2003/QĐ-BBCVT dated February 18, 2003 of the Minister of Posts and Telecommunications is hereby repealed;

Article 5. Responsibilities for Implementation

The Head of the Office, the Director of the Organization and Cadre Department, and the Heads of agencies and units under the Ministry are responsible for implementing this Decision./.
