CIRCULAR

Amending, supplementing, and revoking certain provisions of the Regulations on the certification and issuance of Measurement Inspector Cards issued together with Decision No. 21/2006/QĐ-BKHCN dated November 10, 2006, of the Minister of Science and Technology.

These Regulations amend, supplement, and revoke certain provisions of the Regulations on the certification and issuance of Measurement Inspector Cards issued together with Decision No. 21/2006/QĐ-BKHCN dated November 10, 2006, of the Minister of Science and Technology as follows:

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

On the basis of Resolution No. 67/NQ-CP dated December 24, 2010, issued by the Government regarding the simplification of administrative procedures within the scope of management functions of the Ministry of Science and Technology;

Considering the proposal of the Director General of the Standardization, Measurement, and Quality Control Department,

The Minister of Science and Technology stipulates:

Article 1. Amending, supplementing, and revoking certain provisions of the Regulations on the certification and issuance of Measurement Inspector Cards issued together with Decision No. 21/2006/QĐ-BKHCN dated November 10, 2006, of the Minister of Science and Technology as follows:

1. Unit prices for construction projects published by the People's Committee of the province in accordance with Clause 2, Article 26 of Decree No. 10/2021/NĐ-CP serve as the basis for determining and managing construction investment costs within the province. The unit prices for construction projects published by the People's Committee of the province are determined based on construction norms issued by competent authorities and the cost factors' prices specified in Clause 3, Clause 4, and Clause 5 of this Article, consistent with the time of determining the unit price for construction projects. Cost factors' prices include: material prices, labor unit prices, machinery and equipment rental prices.

"Article 8. Application Documents

1. In the case of initial certification, one (01) set of application documents shall be submitted to the General Department as follows:

a) An application for certification of a Measurement Inspector according to the form prescribed in Appendix I of Decision No. 21/2006/QĐ-BKHCN;

b) A certified copy (with confirmation of true copy from the issuing entity) of the training certificate for Measurement Inspectors as prescribed in Clause 2, Article 3 of Decision No. 21/2006/QĐ-BKHCN;

c) A certified copy (with confirmation of true copy from the issuing entity) of the certificates as prescribed in Clause 3, Article 3 of Decision No. 21/2006/QĐ-BKHCN;

2. In the case of re-certification or supplementary certification, one (01) month before the expiration date of the Certification Decision or when there is a need for supplementary certification, the inspection organization shall submit one (01) set of application documents to the General Department. The application documents shall include:

a) An application for certification of a Measurement Inspector according to the form prescribed in Appendix I of Decision No. 21/2006/QĐ-BKHCN;

b) A certified copy (with confirmation of true copy from the issuing entity) of additional training certificates as required."

2. Amend and supplement Clause 2 of Article 9 as follows:

"Within ten (10) working days from the date of receipt of complete and valid application documents, the General Department shall issue a Certification Decision for Measurement Inspectors."

3. Amend and supplement Article 12 as follows:

"Article 12. Suspension of Effectiveness of Certification Decisions

If a Measurement Inspector no longer has the task of inspecting measuring instruments or fails to fulfill their responsibilities as prescribed in Article 6 of these Regulations, the head of the inspection organization shall report this to the General Department. Based on the report from the head of the inspection organization, the General Department shall issue a decision to suspend the effectiveness of the Certification Decision for the said Measurement Inspector."

4. Repeal the provisions related to the issuance of Measurement Inspector Cards/Measurement Inspector Cards in Decision No. 21/2006/QĐ-BKHCN and the accompanying Regulations.

Article 2. The General Department of Standardization, Metrology and Quality Assurance is responsible for guiding and organizing the implementation of this Circular.

Article 3.

1. This Circular takes effect from August 20, 2011.

2. The Director of the General Department of Standardization, Metrology and Quality, the Head of the Legal Affairs Department, and relevant organizations and individuals are responsible for implementing this Circular./.
