Issuing the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam

Pursuant to the Law on Quality of Products and Commodities dated November 21, 2007;

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP of the Government;

Pursuant to Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production, business, and use; Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production, business, and use;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Quality of Products and Commodities;

Considering the proposal of the Director of the Crop Production Department at Report No. 306/TTr-TT-ĐPB dated March 1, 2012;

The Ministry of Agriculture and Rural Development promulgates the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam.

Article 1. Attached hereto is the Supplementary List of fertilizers permitted for production, business, and use in Vietnam including:

1. The Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam includes 340 types of fertilizers, divided into:

a) Simple fertilizers: 03 types;

b) Traditional organic fertilizers: 01 type;

c) Organic fertilizers: 07 types;

d) Biofertilizers: 11 types;

đ) Combined organic-biofertilizers: 30 types;

e) Biological organic fertilizers: 15 types;

g) Mineral-organic fertilizers: 27 types;

h) Foliar fertilizers: 246 types;

2. The List of Fertilizers Replacing Existing Types in the List of Fertilizers Permitted for Production, Business, and Use in Vietnam includes 71 types, specifically:

a) Combined organic-biofertilizers: 03 types;

b) Biological organic fertilizers: 06 types;

c) Mineral-organic fertilizers: 07 types;

d) Foliar fertilizers: 54 types;

đ) Soil amendment materials: 01 type.

Article 2. Organizations and individuals are permitted to produce, trade, and use the types of fertilizers specified in Article 1 when they meet the conditions stipulated in Article 5 of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production, business, and use; and stipulated in Clause 4, Article 1 of Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production, business, and use.

Article 3. This Circular shall take effect forty-five days from the date of issuance.

Article 4. The Head of the Ministry's Office, the Director of the Crop Production Department, the Director of the Science, Technology, and Environment Department, the Directors of the Departments of Agriculture and Rural Development of provinces and centrally-administered cities, and the Heads of relevant units are responsible for implementing this Circular./.
