JOINT CIRCULAR
Amending and supplementing certain provisions of Circular Joint Circular No. 175/2011/TTLT-BQP-BGDĐT dated September 13, 2011, issued by the Ministry of National Defense and the Ministry of Education and Training guiding the implementation of certain provisions of Decree
No. 38/2007/NĐ-CP dated March 15, 2007 of the Government on temporary deferment from military service and exemption from military service during peacetime for male citizens of conscription age
On the basis of the Military Service Law 1981; the Law Amending and Supplementing Certain Provisions of the Military Service Law 1990; the Law Amending and Supplementing Certain Provisions of the Military Service Law 1994; the Law Amending and Supplementing Certain Provisions of the Military Service Law 2005;
On the basis of Decree No. 38/2007/NĐ-CP dated March 15, 2007 of the Government on temporary deferment from military service and exemption from military service during peacetime for male citizens of conscription age;

On the basis of Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
The Minister of National Defense and the Minister of Education and Training issue this Joint Circular amending and supplementing certain provisions of Joint Circular No. 175/2011/TTLT-BQP-BGDĐT dated September 13, 2011, issued by the Ministry of National Defense and the Ministry of Education and Training guiding the implementation of certain provisions of Decree No. 38/2007/NĐ-CP dated March 15, 2007 of the Government on temporary deferment from military service and exemption from military service during peacetime for male citizens of conscription age (hereinafter referred to as Joint Circular No. 175/2011/TTLT-BQP-BGDĐT).
Pursuant to Decree No. 104/2008/NĐ-CP dated September 16, 2008 of the Government on the Functions, Tasks, Authorities, and Organizational Structure of the Ministry of National Defense;
Article 1. Amending and supplementing certain provisions of Joint Circular No. 175/2011/TTLT-BQP-BGDĐT
1. Adding Point d to Clause 1, Article 2 as follows:
"d) Citizens studying at schools specified in Points a, b, c, and d of Clause 1 of this Article shall be counted from the date when the citizen has completed the enrollment procedures and is currently studying at the school. In case a citizen receives both the Call-up Order and the Admission Notice at the same time, they must comply with the Call-up Order and are not eligible for consideration for temporary deferment from military service."
2. Point a of Clause 3, Article 2 is amended and supplemented as follows:
"a) Studying other types of education outside the provisions of Clause 1 of this Article;"
3. Adding Point e to Clause 3, Article 2 as follows:
"e) Currently enrolled in the first concentrated training course but dropped out to transfer to another school's course."
4. Point e of Clause 1, Article 3 is amended and supplemented as follows:
"e) Accepting students who have completed their military service obligation with an Admission Notice issued before or after the enlistment period as prescribed in Clause 4, Article 56 of the Military Service Law."
5. Clause 6, Article 3 is amended and supplemented as follows:
"6. Responsibilities of citizens:
a) When registering for admission at the school, citizens must bring along the Military Service Registration Certificate issued by the Military Command Board of the district and the Absence Registration Confirmation issued by the Military Command Board of the commune where they reside;
b) Citizens who have been enlisted into the Army, if they have an Admission Notice for higher education institutions such as universities, colleges, vocational high schools, college-level vocational schools, and high school-level vocational schools issued before or after the enlistment period, must report to their management unit to inform the school (the issuing institution of the Admission Notice) to retain the admission results of the candidate until completion of their military service obligation according to Clause 4, Article 56 of the Military Service Law."
1. This Circular takes effect from March 7, 2013.
2. Chairmen of all levels of People's Committees; directors of regional universities, national universities, academies; principals of schools; institute directors; commanders of agencies and units are responsible for implementing this Circular./.
Article 2. Implementation clause
1. This Circular takes effect from March 7, 2013.
2. The Chairpersons of People's Committees at all levels; directors of regional universities, national universities, academies; principals of schools; and directors of research institutes shall be responsible for implementing this Circular./.
