thereafter becoming salary recipients, Pursuant to Decree No. 68/2007/NĐ-CP dated April 19, 2007 of the Government detailing and guiding the implementation of certain provisions of the Social Insurance Law concerning mandatory social insurance for military personnel, public security officers, and civil servants with equivalent pay to military personnel and public security officers;
The Prime Minister issues this Decision regarding the provision on additional social insurance contributions for calculating retirement benefits and death benefits as stipulated in Clause 1, Article 4 of the Social Insurance Law for individuals receiving subsistence allowances in the People's Public Security Forces during the period from January 1, 1995 to December 31, 2006, thereafter becoming salary recipients,

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Social Insurance Law dated June 29, 2006;
Non-commissioned officers, conscripts serving on a fixed-term basis in the People's Public Security Forces; students receiving subsistence allowances studying at public security schools or studying outside public security schools during the period from January 1, 1995 to December 31, 2006, thereafter becoming salary recipients, currently working or having ceased work (service) in the People's Public Security Forces, shall make additional social insurance contributions for the period they received subsistence allowances, to calculate retirement benefits and death benefits as stipulated in Clause 1, Article 4 of the Social Insurance Law, including:
Pursuant to Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
At the proposal of the Minister of Public Security,
a) Currently making mandatory social insurance contributions in the People's Public Security Forces or transferred to another sector and continuing to participate in mandatory social insurance according to the laws on social insurance.
Article 1. Scope of application
1. This Decision applies to:
b) Having ceased work (service) in the People's Public Security Forces and having their social insurance contribution periods preserved until they can enjoy benefits, or to have the conditions to continue participating in social insurance contributions as prescribed.
2. This Decision does not apply to resolve again the social insurance benefits for the subjects specified in Clause 1 of this Article who have already been resolved for one-time or monthly allowances by the Social Insurance of the People's Public Security Forces or the Social Insurance of provincial-level cities directly under the Central Government.
Article 2. Level of Additional Social Insurance Contributions and Funding
1. The level of additional social insurance contributions into the social insurance fund for the subjects specified in Clause 1, Article 1 of this Decision is as follows:
Annual additional social insurance contribution amount = Number of subjects x General Minimum Wage for each period x Contribution Rate x Number of months contributed.
The rate of additional social insurance contributions is 14% of the General Minimum Wage/person/month during the period of additional contributions.
2. The funding for additional social insurance contributions into the social insurance fund for the subjects specified in Clause 1, Article 1 of this Decision shall be guaranteed by the State budget.
1. The Ministry of Public Security is responsible for directing competent agencies to conduct statistics on the number of subjects receiving subsistence allowances and prepare a budget estimate for additional social insurance contributions for the subjects specified in Clause 1, Article 1 of this Decision to send to the Ministry of Finance.
2. The Ministry of Finance is responsible for guaranteeing and allocating funds for the Ministry of Public Security to implement additional social insurance contributions for the subjects specified in Clause 1, Article 1 of this Decision in 2014.
Article 3. Implementation Organization
3. The Vietnam Social Security is responsible for directing the Social Security of provincial-level cities directly under the Central Government to fully implement social insurance policies for the subjects specified in Clause 1, Article 1 of this Decision.
This Decision takes effect from March 26, 2014.
The Minister of Public Security, the Minister of Finance, the Minister of Labor, Invalids and Social Affairs, the Director-General of the Vietnam Social Security, and the heads of relevant agencies are responsible for implementing this Decision./.
Article 4. - Central Association of Vietnamese War Veterans;
Article 5. The Minister of Public Security, the Minister of Finance, the Minister of Labor, Invalids and Social Affairs, the General Director of the Vietnam Social Insurance, and the Heads of relevant agencies shall be responsible for implementing this Decision./.
