Announcing the port waters within the territory of Quang Binh Province

and the area under management of Quang Binh Maritime Port Office

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;

Based on Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 21/2012/NĐ-CP dated March 21, 2012 of the Government on port management and maritime channels;

Based on the opinions of the People's Committee of Quang Binh Province at Official Letter No. 1262/UBND dated October 30, 2013;

At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration,

The Minister of Transport hereby issues this Circular announcing the port waters within the territory of Quang Binh Province and the area under management of Quang Binh Maritime Port Office.

Article 1. Announcing the port waters within the territory of Quang Binh Province.

Now announces the port waters of Quang Binh within the territory of Quang Binh Province, including the following ports: Hon La, Gianh, and Song Gianh oil terminal.

Article 2. Scope of the port waters within the territory of Quang Binh Province.

The scope of the port waters of Quang Binh within the territory of Quang Binh Province is defined according to the highest tidal level as follows:

1. Scope of the port waters in the Hon La area:

a) Seaward boundary: limited by straight lines connecting points HL1, HL2, HL3, and HL4 with the following coordinates:

HL1: 17°57'40" N, 106°30'31" E;

HL2: 17°57'40" N, 106°34'10" E;

HL3: 17°53'03" N, 106°34'10" E;

HL4: 17°53'03" N, 106°27'35" E.

b) Landward boundary: from point HL4 running along the shoreline of Quang Dong commune northwards to point HL1.

2. Scope of the port waters in the Gianh Gate area:

a) Seaward boundary: limited by straight lines connecting points CG1, CG2, CG3, and CG4 with the following coordinates:

CG1: 17°44'03"N, 106°28'27"E;

CG2: 17°44'03"N, 106°34'10"E;

CG3: 17°40'03"N, 106°34'10"E;

CG4: 17°40'13"N, 106°30'28"E.

b) Landward boundary: from point CG1, point CG4 running along the coastline and both banks of the Gianh River to a transverse line across the river 200 meters upstream from the edge of the Song Gianh oil terminal wharf.

3. The boundaries of the port waters specified in Clause 1 and Clause 2 of this Article are determined on Chart IA-100-08 reprinted in 1996 of the Vietnam Navy. The coordinates of the points specified in Clause 1 and Clause 2 of this Article apply according to the VN-2000 coordinate system and are converted to corresponding systems as follows:

Article 3. Pilot reception areas, quarantine zones, anchorage areas, cargo transfer zones, storm shelters, and other related water areas.

The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception areas, quarantine zones, anchorage areas, cargo transfer zones, and storm shelters for vessels entering and leaving the Quang Binh Port, and other water areas within the scope of the port waters stipulated in Article 2 of this Circular.

Article 4. Responsibilities of the Quang Binh Maritime Port Office.

1. Implement tasks and powers as prescribed by the Vietnam Maritime Code and relevant legal regulations concerning maritime activities at the port and port waters within the territory of Quang Binh Province.

2. Based on actual conditions regarding weather, waves, draft, vessel tonnage, and cargo characteristics, designate specific positions for vessels to receive pilots, undergo quarantine, anchor, transfer cargo, and seek shelter from storms within the designated waters, ensuring maritime safety, maritime security, and environmental protection.

Article 5. The State management responsibility for maritime affairs in the marine area under the jurisdiction of Quang Binh Province.

In addition to the port water areas specified in Article 2 of this Circular, the Quang Binh Maritime Branch shall also be responsible for State management of maritime safety, maritime security, and prevention of environmental pollution in the marine area under the jurisdiction of Quang Binh Province.

Article 6. Effective Date.

This Circular takes effect from July 1, 2014. The Circular No. 22/2010/TT-BGTVT dated August 19, 2010, promulgating the port water areas under the jurisdiction of Quang Binh Province and the management area of the Quang Binh Maritime Branch, issued by the Minister of Transport, is hereby abolished.

Article 7. Implementation organization.

The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Directors of the Vietnam Maritime Administration, the Directors of the Vietnam Inland Waterways Administration, the Director of the Quang Binh Department of Transport, the Director of the Quang Binh Maritime Branch, the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
