BASED ON THE LAW ON TRAFFIC ON ROADS 2008;

Article 1. Scope of Regulation
This Circular applies to agencies, units, organizations, and individuals related to military motorcycle and automobile driving training and examination work.
Article 2. Applicability

Article 3. Explanation of Terms
In this Circular, the following terms shall be understood as follows:
1. refers to agencies and units that have all the necessary professional conditions approved by competent authorities to establish them, with the function of conducting military motorcycle and automobile driving training. Driving examination

1. The Motor Vehicle Department under the General Technical Department assists the Ministry of National Defense in managing state affairs regarding military driving training and examination work throughout the military.
2. Motor vehicle departments of units with driving training facilities are subject to the guidance of the Motor Vehicle Department on military driving training and examination work.
3. Direct superior agencies and units of military driving training facilities.
4. Military driving training facilities.
5. Military driving examination boards.
6. Inspection and supervision teams for military driving training and examination work.
7. Agencies, units, and individuals related to military driving training and examination work, inspection, and supervision of such training and examination work.
Article 5. Principles of inspection and supervision
1. The Motor Vehicle Department is the leading agency organizing the inspection and supervision of military driving training and examination work throughout the military.
2. Motor vehicle departments of units with military driving training facilities are responsible for organizing the inspection and supervision of their own driving training facilities and participating in inspections and supervision according to the Motor Vehicle Department’s plan.
3. The inspection and supervision team operates independently from the examination board, not interfering with the examination schedule. When violations are discovered, they have the responsibility to propose that the examination board and competent authorities review and handle them according to regulations.
1. Inspect the implementation of training content, programs, and timeframes.
Article 6. Contents of Inspection
2. Inspect the provision of material infrastructure, technical standards, and professional qualifications of the driving training facility, as well as the number and standards of instructors, practice vehicles, meeting the requirements of assigned training tasks.
3. Inspect the storage of records and documents related to driving training and examination work in accordance with current regulations.
Article 7. Content of supervision
1. Supervise the implementation of the examination procedures and content in accordance with regulations.
2. Supervise the performance of duties and responsibilities of the examination board, secretaries, examiners; supervise the conditions to ensure the transparency, fairness, and impartiality of the examination organization process carried out by the examination board during the examination period.
2. Oversight of the performance of responsibilities and tasks of the Examination Board, secretaries, and examiners; oversight of conditions to ensure that the organization and implementation of examinations by the Examination Board are transparent, impartial, and fair during the examination process.
Article 8. Responsibilities of agencies and units under the Ministry of National Defense with military driving training facilities
1. Direct the driving training facilities under their authority to implement the provisions of the law on training and examination for driving licenses in the Military.
2. Direct and organize inspections and supervision of driving training facilities under their authority and handle violations within their jurisdiction.
3. Be responsible for managing the organization and operation of driving training facilities under their authority according to current regulations.
Article 9. Responsibilities of vehicle-machine management agencies with military driving training facilities
1. Manage, direct, guide, inspect, and supervise driving training facilities at the same level regarding vehicle-machine management business operations and contents stipulated for driving training and examination in the Military.
2. Participate in inspection and supervision rounds of driving training facilities according to plans or ad hoc inspections from higher levels.
Article 10. Responsibilities of military driving training facilities
1. Organize driving training according to prescribed programs, contents, and timeframes.
2. Organize subject examinations, stage examinations, issuance of vocational certificates or graduation certificates for trainees; implement reports on driving training, registration for examinations, and request organizations to conduct driving examinations as prescribed.
3. Store relevant records and documents related to driving training and examination activities according to current regulations.
4. Ensure sufficient conditions in terms of infrastructure, technical standards, and professional qualifications for driving training facilities. Ensure adequate numbers and standards of instructors, practice vehicles for each category, meeting the requirements of assigned driving training tasks.
5. Accept inspections and supervision of driving training and examination activities by competent authorities as prescribed.
Article 11. Responsibilities of Examination Boards
1. Implement driving examination periods as prescribed, creating conditions for inspection teams to fulfill their responsibilities.
2. Be responsible for violations by members of the Examination Board, secretaries, and examiners during examination periods.
3. Promptly handle violations by agencies, units, or individuals during examination periods within their jurisdiction or report to competent authorities for handling according to regulations.
Article 12. Responsibilities of Inspection and Supervision Teams
1. Inspect the implementation of training content, programs, and plans; ensure training support; comply with regulations and systems during training; and handle violations by training facilities as prescribed.
2. Supervise Examination Boards, secretaries, and examiners in implementing examination procedures and contents as prescribed. Supervise conditions to ensure transparent, fair, and open organization of examinations by Examination Boards throughout the examination process.
Article 13. Responsibilities of Chairpersons of Examination Boards
1. Be responsible before the Director of the Vehicle-Machine Department and the law for organizing the implementation of examination content and procedures as prescribed.
2. Convene Examination Boards and Inspection and Supervision Teams to disseminate plans and regulations for examinations.
3. Organize examination periods as prescribed; handle situations arising during examinations within their jurisdiction.
4. Take measures to promptly prevent and stop negative behaviors and violations of examination content and procedures.
5. Assign tasks to Examination Board members and create conditions for Inspection and Supervision Team activities during examination periods.
6. Be responsible for violations by Examination Board members, secretaries, and examiners during examination periods.
Article 14. Responsibilities of the Secretary of the Examination Board
1. Strictly implement examination regulations; assist the Chairman of the Board in preparing minutes and related files for the examination period.
2. Be responsible to the Chairman of the Board for the accuracy of all related files and documents for the examination period.
3. Check, receive, manage examination files and documents, and store them according to regulations.
Article 15. Responsibilities of the Examiner
1. Strictly follow examination regulations, objectively and truthfully evaluate results. Be responsible to the Chairman of the Board and under the law for performing assigned tasks.
2. Inspect necessary conditions for conducting the examination period as assigned.
Article 16. Responsibilities of the Head of the Inspection and Supervision Team and Inspection and Supervision Officers
1. The Head of the Inspection and Supervision Team:
a) Be responsible to the Director of the Motor Vehicle Bureau and under the law for inspection and supervision work in military driving training and examination;
b) Organize inspections on the implementation of training program contents and regulations at military driving training facilities; supervise the driving examination board to ensure transparency, objectivity, and compliance with procedures as prescribed;
c) Assign and urge inspection and supervision officers to perform their tasks.
2. Inspection and Supervision Officers:
Perform tasks as assigned by the Head of the Inspection and Supervision Team. Be responsible to the Head of the Supervision Team and under the law for performing assigned tasks.
Article 17. Responsibilities of the Head of the Driving Training Facility
1. Be responsible to the superior management authority and under the law for all activities of the driving training facility.
2. Comply with and ensure sufficient conditions to serve inspection and supervision work according to plans or urgent requests from competent authorities.
Article 18. Responsibilities of Driving Instructors
1. Driving instructors are responsible to the Head of the driving training facility and under the law for performing assigned teaching tasks.
2. Must have complete lesson plans when teaching; update all management records fully; teach the required number of hours according to the training schedule, program content, and prescribed textbooks; organize regular assessments and participate in organizing final subject exams as prescribed.
3. Must carry all required documents; ensure the vehicle meets all conditions for operation; ensure safety during student practical driving lessons.
Article 19. Handling Violations by Military Driving Training Facilities
If a driving training facility violates provisions in Clause 1, 2, and 4 of Article 10 of this Circular, it will be temporarily suspended from performing training duties until competent authorities review and resolve the issue. Related organizations, units, and individuals who violate will be disciplined according to the Regulations on Military Unit Management of the Vietnam People's Army and relevant laws.
Article 20. Handling Violations by Officers Performing Inspection and Supervision Tasks for Military Driving Training and Examination
Officers performing inspection and supervision tasks for military driving training and examination will be handled according to the Regulations on Military Unit Management of the Vietnam People's Army and relevant laws based on the type and degree of violation.
Article 21. Effective Date
This Circular takes effect from April 12, 2014.
Article 22. Responsibility for enforcement
1. The Chief of the General Technical Department, Heads of agencies and units, driving training facilities within the military, and related individuals are responsible for implementing this Circular.
2. The Director of the Vehicle-Motor Unit is responsible for guiding and implementing this Circular./.
