Announce the list of imported goods subject to specialized management by the Ministry of Transport

pursuant to Decree No. 187/2013/ND-CP dated November 20, 2013 of the GovernmentDeputy ministers of ministerial-level agencies,

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

On the basis of Decree No. 132/2008/ND-CP dated December 31, 2008 of the Government providing detailed regulations on certain provisions of the Law on Product Quality; On the basis of Decree No. 187/2013/ND-CP dated November 20, 2013 of the Government providing detailed regulations on the Law on Trade regarding international trade activities and related agency buying, selling, processing, and transiting goods with foreign countries (hereinafter referred to as Decree No. 187/2013/ND-CP)

The Minister of Transport issues this Circular to announce the list of imported goods subject to specialized management by the Ministry of Transport as prescribed in Decree No. 187/2013/ND-CP dated November 20, 2013 of the Government.

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Science and Technology Department and the Director of the Vietnam Vehicle Inspection Agency;

Article 1. Announce the list of imported goods subject to specialized management by the Ministry of Transport as prescribed in Decree No. 187/2013/ND-CP

1. The list of special-purpose vehicles (including disassembled form and those with steering wheel converted before importation into Vietnam) with right-hand drive operating in narrow areas and not participating in traffic, as specified in Appendix I attached hereto.

2. The list of prohibited imported goods includes:

a) All types of transport vehicles with right-hand drive (including disassembled form and those with steering wheel converted before importation into Vietnam), except for those specified in Appendix I attached hereto;

b) All types of automobiles and automobile assembly parts, motorcycles, motorbikes, and specialized machines that have been erased, altered, or renumbered chassis and engine numbers, as specified in Appendix II attached hereto;

c) Used equipment and machinery that have been modified to change their original function, as specified in Appendix III attached hereto;

d) Used materials and equipment, as specified in Appendix IV attached hereto.

3. The list of goods imported under permits and subject to specialized management by the Ministry of Transport, as specified in Appendix V attached hereto.

4. The Vietnam Vehicle Inspection Agency under the Ministry of Transport is the specialized management authority responsible for inspecting and certifying the quality of imported goods subject to specialized management by the Ministry of Transport as prescribed in this Circular.

Article 2. Provisions on the application of the list of goods mentioned in Article 1 of this Circular

1. The list is established based on the provisions of Decree No. 187/2013/ND-CP and the list of goods with HS codes in the Export and Import Tariff.

2. Goods with eight-digit HS codes are the objects of application.

3. Goods with six-digit HS codes are understood to include all goods within that six-digit group as the objects of application.

4. Goods with four-digit HS codes are understood to include all goods within that four-digit group as the objects of application.

Article 3. Provisions on the dossier and procedures for importing goods for scientific research as prescribed in Point a Clause 3 Article 5 of Decree No. 187/2013/ND-CP

1. Scientific research organizations and traders who need to import for product development but are subject to prohibition of importation as stipulated in Appendices I and II of this Circular (hereinafter referred to as organizations) shall submit one set of dossier directly or through postal service to the Department of Science and Technology, Ministry of Transport.

a) Decision on establishment, investment certificate confirmed and stamped with a true copy of the organization;

2. The documents include:

b) Organization's request for importation detailing the name of goods, HS code, quantity, purpose of each item, and confirmation of the authenticity of these contents: one original copy;

c) Report on the implementation of previously granted permits (except for first-time imports): one original copy.

3. The Department of Science and Technology will accept and review the dossier. If the dossier is incomplete according to the regulations, the organization will be guided to complete it immediately on the same working day (for direct submission) or within three working days from the date of receipt of the dossier (for submission through postal service). Within seven working days from the date of receiving the complete dossier, the Department of Science and Technology will examine and issue a document agreeing to the organization. In case of disagreement with the importation, the Department of Science and Technology will issue a reply document stating the reasons.

This Circular takes effect from June 10, 2016, and replaces Decision No. 19/2006/QĐ-BGTVT dated May 4, 2006 of the Minister of Transport on announcing the list of goods as prescribed in Decree No. 12/2006/ND-CP dated January 23, 2006 of the Government.

Article 4. Effective date

The Director of the Ministry's Office, the Inspector General, Heads of Departments, the Director of the Vietnam Vehicle Inspection Agency, Heads of agencies and units under the Ministry of Transport, relevant organizations, and individuals are responsible for implementing this Circular./.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Vehicle Inspection Agency, the Heads of agencies and units under the Ministry of Transport, relevant organizations and individuals are responsible for implementing this Circular./.
