CIRCULAR

Amending and supplementing Circular No. 23/2010/TT-BKHCN dated December 29, 2010

of the Minister of Science and Technology guiding the assurance of radiation source securityperiod

Pursuant to the Atomic Energy Law dated June 3, 2008;

Pursuant to Decree No. 20/2013/NĐ-CP dated February 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the proposal of the Director of the Radiation and Nuclear Safety Agency and the Head of the Legal Department,

The Minister of Science and Technology issues this Circular to amend and supplement Circular No. 23/2010/TT-BKHCN dated December 29, 2010 of the Minister of Science and Technology guiding the assurance of radiation source security (hereinafter referred to as Circular No. 23/2010/TT-BKHCN).

Article 1. Amend and supplement some contents of Circular No. 23/2010/TT-BKHCN as follows:

1. Supplement Clause 3 to Article 7 as follows:

"3. In cases where radiation sources are used in industrial radiographic equipment, they shall be implemented according to the provisions of Clause 2, Article 7 of Circular No. 23/2010/TT-BKHCN and must install mobile radiation source locating devices in accordance with technical requirements specified in Part I of Appendix I issued together with this Circular."

2. Amend Point a, Clause 2, Article 9 as follows:

"a) Implement the requirements stipulated at Points a, b, c, d, đ, e, g, h, and k, Clause 2, Article 7 of Circular No. 23/2010/TT-BKHCN."

3. Supplement Article 14a as follows:

"Article 14a. Responsibility for attaching radiation warning signs

1. Organizations and individuals granted permits to carry out radiation work at Security Levels A, B, C, and D must attach radiation warning signs in accordance with the provisions of Item 1 and Item 3 of Appendix II issued together with this Circular.

2. For radiation sources at Security Levels A, B, and C, organizations and individuals granted permits to carry out radiation work must also attach additional radiation warning signs in accordance with the provisions of Item 2 and Item 3 of Appendix II issued together with this Circular."

4. Amend and supplement Article 15 as follows:

"1. The Radiation and Nuclear Safety Agency shall be responsible for:

a) Organize the implementation of this Circular;

b) Building and maintaining the operation of the Mobile Radiation Source Surveillance System (hereinafter referred to as the Surveillance System) to meet the technical requirements specified in Part II of Appendix I issued together with this Circular.

c) Guiding provincial Departments of Science and Technology to operate the Surveillance System to serve radiation safety and nuclear management work in their localities.

2. The construction, maintenance, and repair activities of the Surveillance System shall be funded by the state budget.

3. Provincial Departments of Science and Technology shall be responsible for organizing the implementation of this Circular and guiding organizations and individuals with radiation sources in their localities to comply with this Circular."

Article 2. Effective Date

1. This Circular takes effect from October 1, 2015.

2. In cases where radiation sources used in industrial radiographic equipment have been granted permits to carry out radiation work before the effective date of this Circular, organizations and individuals granted permits shall be responsible for installing mobile radiation source locating devices within six months from the effective date of this Circular.

3. During the implementation process, if there are difficulties or new issues arise, organizations and individuals are requested to promptly report to the Ministry of Science and Technology for consideration and amendment./.
