Considering the proposal of the Director of the Small and Medium Enterprise Development Fund;June 2024;The Minister of Planning and Investment issues the Catalogue of Priority Support Fields and Criteria for Selecting Target Beneficiaries of the Small and Medium Enterprise Development Fund.

1. This Circular stipulates the priority support fields and criteria for selecting target beneficiaries of the Small and Medium Enterprise Development Fund established pursuant to Decision No. 601/QĐ-TTg dated April 17, 2013 of the Prime Minister (hereinafter referred to as Decision No. 601/QĐ-TTg).No.2. The dossier, examination procedures, and loan decision from the Fund shall be implemented according to the guidelines of the Management Council of the Fund.

PART I

GENERAL PROVISIONS

Article 1. Scope of Application

a) Small and medium enterprises established in accordance with the law and meeting the criteria specified in Article 3 of this Circular;b) The Small and Medium Enterprise Development Fund (hereinafter referred to as the Fund);

c) Vietnam Development Bank and commercial banks meeting the conditions to act as agents for loans from the Fund (hereinafter referred to as the Bank).

Article 2. Scope of Application

Article 3. Criteria for determining small and medium enterprises

1. Small and medium enterprises eligible for support from the Fund (hereinafter referred to as Enterprises) are enterprises with scale and production and business sectors as prescribed in Clause 1, Article 3 of Decree No. 56/2009/NĐ-CP dated June 30, 2009 of the Government on assistance to small and medium enterprises.

d) Other relevant agencies, organizations, and individuals.

2. The scale and production and business sector of the Enterprise as prescribed in Clause 1 of this Article shall be determined as follows:

a) For Enterprises engaged in multiple industries and trades, the production and business sector of the Enterprise shall be determined based on the sector with the highest total capital or number of employees. For newly established Enterprises without financial statements, the production and business sector shall be determined based on the main industry or trade registered with the Business Registration Authority;

b) The total capital of the Enterprise is the total capital or total assets in the balance sheet of the latest annual financial report of the Enterprise. For newly established Enterprises without financial statements, the total capital is the registered capital recorded in the Enterprise Registration Certificate;

c) The number of employees is the average number of employees over the fiscal year, calculated as the average of the number of employees recorded on the monthly payroll of the Enterprise. For newly established Enterprises, this criterion shall not be applied.

Article 4. Principles of support from the Fund

1. The Fund prioritizes supporting Enterprises implementing investment projects and production and business plans that are effective in enhancing competitiveness and contributing to increasing income and creating jobs for workers.

2. Enterprises meeting the criteria specified in Article 3 and having investment projects or production and business plans in the fields prescribed in Articles 5 and 6 of this Circular shall all be eligible for loans from the Fund under the principles of equality, transparency, and fairness.

CATALOGUE OF PRIORITY SUPPORT FIELDS AND CRITERIA FOR SELECTING

TARGET BENEFICIARIES FOR PRIORITY SUPPORT

2. An enterprise that meets the criteria specified in Article 3 and has investment projects, production and business plans in the fields prescribed in Articles 5 and 6 of this Circular shall all be eligible for loans from the Fund on the principle of equality, transparency, and fairness.

Chapter II

LIST OF PRIORITY SECTORS FOR SUPPORT AND SELECTION CRITERIA

OBJECTS OF PRIORITY SUPPORT

Article 5. Priority Sectors for Support from the Fund

1. The Fund prioritizes lending to Enterprises with investment projects or production and business plans falling under one of the economic sectors classified according to Vietnam's Economic Classification System issued by Decision No. 10/2007/QD-TTg dated January 23, 2007 of the Prime Minister, including:

a) Agriculture, forestry, and fisheries;

b) Processing and manufacturing industry;

c) Water supply; waste management and wastewater treatment activities.

2. Based on the orientation for small and medium-sized enterprise development approved by the Prime Minister during each period, the Fund will develop a support program for Enterprises with feasible investment projects or production and business plans in the fields specified in Clause 1 of this Article.

Article 6. Conditions for Lending by the Fund

An Enterprise is eligible to borrow from the Fund if it meets the following criteria and conditions:

1. The criteria for small and medium-sized enterprises as stipulated in Article 3 of this Circular.

2. Having investment projects or production and business plans as specified in Article 5 of this Circular.

3. The conditions prescribed in Article 7 of Decision No. 601/QĐ-TTg.

Article 7. Criteria for Prioritizing Supported Entities by the Fund

1. In addition to the lending conditions stipulated in Article 6 of this Circular, the Fund prioritizes lending to Enterprises that meet at least one of the following criteria:

a) Product output: producing high-quality products, new materials, new energy sources;

b) Innovation: upgrading technical equipment to increase labor productivity; developing and using new technologies, advanced technologies;

c) Management capability: managerial capability and experience of the enterprise's managers and the enterprise's credit history and reputation;

d) Job creation and gender factors: creating many new jobs; employing a large number of female workers;

e) Environment: producing energy-efficient and environmentally friendly products or products used in environmental protection; producing or using clean technology, clean energy, renewable energy; operations with low energy consumption, low emissions, complying with environmental protection laws and having sustainable environmental protection solutions.

2. The criteria specified in Clause 1 of this Article are evaluated based on the scoring scale detailed in the Scoring Table attached as Appendix I to this Circular.

3. The Fund uses the Scoring Table as the basis for evaluating the priority level of support for small and medium-sized enterprises in descending order.

Chapter III

IMPLEMENTATION

Article 8. Responsibilities of the Small and Medium-Sized Enterprise Development Fund

1. Issuing procedures and processes for reviewing and deciding on loans from the Fund.

2. Inspecting and supervising banks in their implementation of loan activities from the entrusted capital of the Fund.

3. Cooperating with banks to perform tasks as stipulated in Clause 2 of Article 9 of this Circular.

4. Performing other tasks as prescribed in Decision No. 601/QĐ-TTg.

Article 9. Responsibilities of Banks Entrusted to Provide Loans

1. Reviewing investment projects, production and business plans, and providing loans to Enterprises as stipulated in this Circular.

2. Monitoring, inspecting, and supervising the use of borrowed funds by Enterprises.

3. Performing other tasks as prescribed in Decision No. 601/QĐ-TTg.

Article 10. Responsibilities of Enterprises Borrowing from the Fund

1. Comply with the lending conditions of the Fund and the Bank.

2. Use the borrowed capital for the intended purpose and effectively.

3. Provide complete, accurate, timely information and documents related to borrowing and the use of borrowed capital to the Fund and the Bank, and be responsible under the law for such information and documents.

4. Be subject to inspection and supervision by the Fund and the Bank regarding the use of borrowed capital to implement investment projects and production and business plans that have been approved.

Article 11. Effective Date

1. This Circular takes effect from December 13, 2015.

2. During implementation, if there are difficulties or obstacles, agencies, organizations, and individuals shall report them to the Ministry of Planning and Investment for study and resolution./.
