Article 24regulating the procedures and formalities for registration and examination,

health check-ups for military service obligations

pursuant to the Law on Professional Military Personnel and Defense Industry Workers and Civil Servants dated February 26,

Pursuant to the Law on Government Organization dated February 18, 2025;"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."hereinafter referred to as the DecreeDeputy ministers of ministerial-level agencies, dated June 19, 2015;

Based on the Law on National Defense dated June 14, 2005;

and the Law on Military Service dated June 19, 2005to regarding the reserve forcestodated August 27, 2004 11 2015;

The Government issues this Decree to regulate the procedures and formalities for registration and examination, health check-ups for military service obligations.15;

The military service registration file shall be established in one set and managed at the Military Command of the district, town, city under province, or equivalent administrative unit (hereinafter referred to as the Military Command of the district). 1996;

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 4. First-time military service registration

Article 2. Applicability

This Decree applies to agencies, organizations, and individuals related to the registration, medical examination, and health check-up for military service obligations.

Chapter II

PROCEDURES AND FORMALITIES FOR REGISTERING FOR MILITARY SERVICE

Article 3. Documents and Forms for Registering for Military Service

1. The Commander of the Military Command of the district, town, city under province, or equivalent administrative unit (hereinafter referred to as the Commander of the Military Command of the district) shall sign the call-up order for military service registration, the certificate of military service registration, and hand them over to the Military Command of the commune, ward, town, agency, or organization (hereinafter referred to as the Military Command of the commune) for implementation.

2. The Minister of National Defense shall prescribe the system of forms for registering for military service, including:

b) A copy of the national identity card or birth certificate (the original must be brought for verification).

b) Health declaration form for military service;

c) Reserve soldier record;

d) Certificate of registration for military service;

a) Ten days prior to the date of military service registration, the Military Command of the commune has the responsibility to transfer the call-up order for military service registration to the citizen. In cases where the agency or organization does not have a Military Command, the head or legal representative of the agency or organization has the responsibility to transfer the call-up order for military service registration to the citizen;

e) Introduction letter for transferring registration for military service;

g) Introduction letter for transferring reserve soldiers;

h) List of male citizens aged 17 in the year;

i) Registration book of citizens ready for conscription;

k) Registration book of reserve soldiers.

b) After receiving the call-up order for military service registration from the Commander of the Military Command of the district, the citizen who falls within the scope defined in Article 12 of the Law on Military Service has the responsibility to go directly to the Military Command of the commune to register for military service. In cases where the agency or organization does not have a Military Command, the head or legal representative of the agency or organization has the responsibility to transfer the call-up order for military service registration to the citizen and organize the first-time military service registration for the citizen at their place of residence;

c) Within one day, the Military Command of the commune has the responsibility to verify the original national identity card or birth certificate; guide the citizen to fill out the Self-reporting Health Form for Military Service, register necessary information of the citizen in the List of Male Citizens Aged 17 Years Old in the Year, the Registration Book of Citizens Ready for Conscription, and issue the Certificate of Military Service Registration to the citizen immediately after registration;

2. Documents

a) Health declaration form for military service;

d) Within ten days, the Military Command of the commune has the responsibility to compile the results and report to the Military Command of the district; the Military Command of the district manages the files of citizens who have registered for military service for the first time. Compile the results and report to the Military Command of the province, the Central Military Command of Hanoi City, the Central Military Command of Ho Chi Minh City (hereinafter referred to as the Military Command of the province).

3. Implementation Procedures

a) Ten days prior to the date of military service registration, the Military Command Board of the commune has the responsibility to transfer the Military Service Call Order to the citizen. In cases where agencies or organizations do not have a Military Command Board, the head or the lawful representative of the agency or organization shall be responsible for transferring the Military Service Call Order to the citizen;

b) After receiving the Military Service Call Order from the Commander of the Military Command Board of the district, citizens falling within the scope defined in Article 12 of the Law on Military Service shall be responsible for directly registering their military service at the Military Command Board of the commune. In cases where agencies or organizations do not have a Military Command Board, the head or the lawful representative of the agency or organization shall be responsible for transferring the Military Service Call Order to the citizen, organizing for the citizen to register their initial military service at their place of residence;

c) Within one day, the Military Command Board of the commune has the responsibility to verify the original identity card or birth certificate; guide the citizen to fill out the Military Service Health Declaration Form; register necessary information of the citizen in the List of Male Citizens Aged 17 Years Old in the Year, the Military Service Registration Book, and issue the Military Service Registration Certificate to the citizen immediately after registration;

d) Within ten days, the Military Command Board of the commune compiles the results and reports to the Military Command Board of the district; the Military Command Board of the district manages the files of citizens who have registered their initial military service. Compile the results and report to the Military Command Board of the province, centrally governed city, Command of the Capital City of Hanoi, Command of Ho Chi Minh City (hereinafter referred to collectively as the Military Command Board of the province).

Article 5. Registration for service in the reserve cadre

1. The Commander of the Military Command Board at the district level shall issue the Order to register for compulsory military service for citizens who fall under the categories specified in Clause 1 and Clause 2, Article 18 of the Law on Compulsory Military Service for service in the reserve cadre, and shall issue the Certificate of registration for reserve military personnel, and hand them over to the Military Command Board at the commune level to implement.

2. Documents

a) Reserve military personnel form;

b) A copy of the decision to discharge from military service, to terminate employment in the People's Army, or to cease service in the People's Public Security force (to be accompanied by the original for verification) for non-commissioned officers, soldiers; professional military personnel; defense workers and civil servants discharged from military service, terminated employment in the People's Army, the Coast Guard force, and citizens ceasing service in the People's Public Security force.

3. Implementation Procedures

a) Ten days prior to the date of registration for service in the reserve cadre, the Military Command Board at the commune level shall be responsible for delivering the Order to register for compulsory military service to citizens who fall under the categories specified in Clause 1 and Clause 2, Article 18 of the Law on Compulsory Military Service each April. In cases where agencies or organizations do not have a Military Command Board, the head or the authorized representative of the agency or organization shall be responsible for delivering the Order to register for compulsory military service to the citizens.

Within fifteen working days from the date when citizens who fall under the category specified in Clause 3, Article 18 of the Law on Compulsory Military Service return to their place of residence, they shall be responsible for directly registering for service in the reserve cadre at the Military Command Board at the commune level on designated days throughout the year (according to the schedule of the Military Command Board at the commune level).

b) Within one day, the Military Command Board at the commune level shall be responsible for establishing the Reserve Military Personnel Registration Form, entering it into the Reserve Military Personnel Registration Book, and transferring the Certificate of registration for reserve military personnel to the citizen who has registered for service in the reserve cadre. In cases where agencies or organizations do not have a Military Command Board, the head or the authorized representative of the agency or organization shall be responsible for organizing the registration for service in the reserve cadre for citizens at their place of residence.

c) Within ten days, the Military Command Board at the commune level shall compile and report to the Military Command Board at the district level. The Military Command Board at the district level shall be responsible for compiling the information into the Reserve Military Personnel Registration Book.

Article 6. Supplementary Registration for Compulsory Military Service

1. Documents

a) A copy of the Certificate of registration for compulsory military service or the Certificate of registration for reserve military personnel (to be accompanied by the original for verification).

b) A copy of relevant documents related to changes in job position, educational qualifications, professional qualifications, health status, and other information related to compulsory military service (to be accompanied by the original for verification).

2. Procedures for Implementation

a) Within ten days from the date of change in job position, educational qualifications, professional qualifications, health status, and other information related to compulsory military service, citizens must directly go to the Military Command Board at the commune level to register for supplementary compulsory military service.

b) Within one day, the Military Command Board at the commune level shall carry out the supplementary registration for compulsory military service; amend and supplement the changed information of the citizen in the Book of Citizens Ready for Military Service, the Reserve Military Personnel Registration Book, and the Reserve Military Personnel Registration Form. In cases where agencies or organizations do not have a Military Command Board, the head or the authorized representative of the agency or organization shall be responsible for organizing the supplementary registration for compulsory military service for citizens at their place of residence.

c) Within ten days, the Military Command Board at the commune level shall compile and report to the Military Command Board at the district level on the supplementary registration for compulsory military service. The Military Command Board at the district level shall supplement the changed information of the citizen in the Book of Citizens Ready for Military Service, the Reserve Military Personnel Registration Book, and the Reserve Military Personnel Registration Form.

Article 7. Registration of Military Service Obligations when Changing Place of Residence or Workplace, or Place of Study

1. Military service registration for transfer out

a) Documents

- A letter of introduction for transferring military service registration or a letter of introduction for transferring reserve military personnel;

- A copy of the Certificate of Military Service Registration or the Certificate of Reserve Military Personnel Registration (bring the original for verification);

- A copy of the letter of introduction for transferring household registration issued by the police agency of the district, town, city under province, or equivalent administrative unit regarding the change of place of residence, or a decision by the head of the organization regarding the change of workplace or place of study (bring the original for verification).

b) Procedure

Citizens who have registered their military service obligations when changing place of residence or workplace, or place of study shall directly go to the People's Militia Committee at the commune level to complete the procedures for transferring military service registration. In cases where organizations do not have a People's Militia Committee, the head or the authorized representative of the organization shall be responsible for organizing citizens to complete the procedures for transferring military service registration at their place of residence.

Within one day, the People's Militia Committee at the commune level shall be responsible for completing the procedures for citizens to transfer their military service registration and issuing a letter of introduction for transferring military service registration or a letter of introduction for transferring reserve military personnel to the citizen, and the Reserve Military Personnel Form; removing them from the Register of Citizens Ready for Conscription or the Register of Reserve Military Personnel.

Within ten days, the People's Militia Committee at the commune level shall compile the results and report to the People's Militia Committee at the district level. The People's Militia Committee at the district level shall compile and remove citizens who have changed their place of residence or workplace, or place of study outside the district from the Register of Citizens Ready for Conscription or the Register of Reserve Military Personnel.

2. Military service registration for transfer in

a) Documents

- A letter of introduction for transferring military service registration or a letter of introduction for transferring reserve military personnel;

- The Reserve Military Personnel Form.

b) Procedure

Within ten days from the date of arrival at the new place of residence or workplace, or place of study, citizens shall be responsible for going directly to the People's Militia Committee at the commune level to complete the procedures for transferring military service registration. In cases where organizations do not have a People's Militia Committee, the head or the authorized representative of the organization shall be responsible for organizing citizens to complete the procedures for transferring military service registration at their place of residence.

Within one day, the People's Militia Committee at the commune level, or the organization shall be responsible for guiding citizens to complete the procedures for transferring military service registration; entering them into the Register of Citizens Ready for Conscription or the Register of Reserve Military Personnel; and preparing the Reserve Military Personnel Form.

Within ten days, the People's Militia Committee at the commune level shall compile the results and report to the People's Militia Committee at the district level. The People's Militia Committee at the district level shall compile and manage the list of citizens who have completed the procedures for transferring military service registration, the Reserve Military Personnel Form; and enter them into the Register of Citizens Ready for Conscription or the Register of Reserve Military Personnel.

Article 8. Temporary Absence Registration of Military Service Obligations

1. Documents

A copy of the Certificate of Military Service Registration or the Certificate of Reserve Military Personnel Registration (bring the original for verification).

2. Procedures for Implementation

a) Citizens who have registered their military service obligations, when leaving their place of residence or workplace, or place of study for three months or more, must go directly to the People's Militia Committee at the commune level where they have registered their military service obligations to complete the procedures for temporary absence registration of military service obligations. In cases where organizations do not have a People's Militia Committee, the head or the authorized representative of the organization shall be responsible for organizing citizens to complete the procedures for temporary absence registration of military service obligations at their place of residence.

Within ten days from the date of returning to their place of residence or workplace, or place of study, citizens who have completed the procedures for temporary absence registration of military service obligations must go directly to the People's Militia Committee at the commune level to re-register.

b) Within one day, the People's Militia Committee at the commune level shall be responsible for completing the procedures for temporary absence registration of military service obligations; updating information in the Register of Citizens Ready for Conscription or the Register of Reserve Military Personnel; and compiling a list of citizens who have completed the procedures for temporary absence registration of military service obligations or re-registration (in cases where citizens return).

c) Within ten days, the People's Militia Committee at the commune level shall compile the results and report to the People's Militia Committee at the district level.

Article 9. Registration for Exemption from Military Service during War Time

1. Documents

A copy of the Decision on Appointment to Position (the original must be brought for verification) or a confirmation letter from the head of the agency or organization regarding the position exempted from military service during war time.

2. Procedures for Implementation

a) Within ten days from the date when the citizen who has registered for military service receives the appointment decision or is assigned to a position exempted from military service during war time, the agency or organization where the citizen works shall send a representative with the appointment decision or confirmation letter of the position exempted from military service during war time to the People's Military Command at the commune level to process the removal from the list of registered military service. If the citizen is removed from the list of registered military service and no longer holds a position exempted from military service during war time, the agency or organization where the citizen works shall send a representative to the People's Military Command at the commune level to re-register for military service.

b) Within ten days, the People's Military Command at the commune level shall compile the results and report to the People's Military Command at the district level; the People's Military Command at the district level shall compile the list for separate management.

Article 10. Military Service of Female Citizens during Peace Time

1. When the Army has a need to recruit women citizens for military service during peacetime, the Minister of National Defense shall report to the Prime Minister for a decision to allocate quotas for recruiting women citizens for military service as stipulated in Clause 2, Article 6 of the Law on Military Service Obligation.

2. Based on the Prime Minister's Decision, the Chairman of the Provincial People's Committee, the People's Committee of the centrally governed city shall allocate quotas for recruiting women citizens for military service to the People's Committees of the districts, towns, cities under provinces, and equivalent administrative units (hereinafter referred to as the People's Committee at the district level) to implement.

The People's Committee at the district level shall notify women citizens of conscription age; women citizens must submit a voluntary enlistment application with the confirmation of the People's Committee of the commune, ward, town where they reside.

3. The People's Committee at the district level shall implement the recruitment and call-up of women citizens for military service according to the quota, standards, and time specified in the annual recruitment and call-up regulations.

Chapter III

REGIME AND POLICY OF CITIZENS DURING THE TIME REGISTERING FOR MILITARY SERVICE, MEDICAL EXAMINATION, AND HEALTH CHECK

Article 11. Regime and Policy of Citizens During the Period of Military Service Obligation Registration

1. Citizens working at agencies and organizations receiving salaries from the state budget, state-owned enterprises during the period of registering for military service shall enjoy their full salary, allowances, and travel expenses according to the current legal provisions.

2. Citizens not working in agencies and organizations receiving salaries from the state budget, state-owned enterprises during the period of military service obligation registration shall be guaranteed the following regimes:

a) Food allowance equivalent to the daily basic food allowance of infantry non-commissioned officers and soldiers;

b) Reimbursement of travel expenses for going and returning home as prescribed by current laws.

3. The regime and policy stipulated in Clause 1 and Clause 2 of this Article shall apply to cases of citizens during the first registration for military service, and registration for reserve service.

Article 12. Regime and Policy of Citizens During the Time of Medical Examination and Health Check for Military Service Obligation

1. Citizens working at agencies and organizations receiving salaries from the state budget, state-owned enterprises during the period of medical examination and health check according to the call-up order of the Commander of the People's Military Command at the district level shall enjoy their full salary, allowances, and travel expenses according to the current legal provisions.

2. Citizens not belonging to agencies and organizations receiving salaries from the state budget, state-owned enterprises during the period of medical examination and health check according to the call-up order of the Commander of the People's Military Command at the district level shall be guaranteed the following regimes:

a) Food allowance equivalent to the daily basic food allowance of infantry non-commissioned officers and soldiers;

b) Reimbursement of travel expenses for going and returning home as prescribed by current laws.

Article 13. Implementation of payment for benefits

1. Principles of benefit entitlement

Time spent traveling to and from registration for military service or health examination lasting four hours or more on the same day shall be counted as a full day; less than four hours shall be counted as half a day.

2. Responsibility for payment

a) Citizens working at agencies and organizations receiving salaries from the state budget, state-owned enterprises during the period of registering for military service and medical examination and health check according to the call-up order of the Commander of the People's Military Command at the district level shall be paid by the agency, organization, or enterprise.

b) Citizens not belonging to agencies and organizations receiving salaries from the state budget, state-owned enterprises during the period of registering for military service shall be paid by the People's Military Command at the commune level and settled with the People's Military Command at the district level.

c) Citizens not belonging to agencies and organizations receiving salaries from the state budget, state-owned enterprises during the period of medical examination and health check according to the call-up order of the Commander of the People's Military Command at the district level shall be paid by the People's Military Command at the district level.

Article 14. Budget Sources

1. The funds for implementing the registration for military service and medical examination and health check according to the call-up order of the Commander of the People's Military Command at the district level for citizens working at agencies and organizations receiving salaries from the state budget, state-owned enterprises as stipulated in Point a, Clause 2, Article 13 of this Decree shall be guaranteed by the state budget according to the current state budget classification.

2. The funds for implementing the registration for military service for citizens not belonging to agencies and organizations receiving salaries from the state budget, state-owned enterprises as stipulated in Point b, Clause 2, Article 13 of this Decree shall be guaranteed by the local budget.

3. The funds for implementing the medical examination and health check for military service according to the call-up order of the Commander of the People's Military Command at the district level for citizens not belonging to agencies and organizations receiving salaries from the state budget, state-owned enterprises as stipulated in Point c, Clause 2, Article 13 of this Decree shall be guaranteed by the state budget allocated to the Ministry of National Defense.

Chapter IV

RESPONSIBILITIES OF AGENCIES AND ORGANIZATIONS

Article 15. Ministry of National Defense

1. Shall be responsible before the Government, take the lead, and coordinate with relevant ministries and sectors to organize the implementation uniformly throughout the country of the provisions of this Decree.

2. Direct and guide local military agencies to cooperate with relevant agencies and sectors at the same level to organize the registration for military service.

3. Inspect, audit, and handle issues arising during the process of implementing registration for military service.

Article 16. Ministry of Finance

1. Direct and guide local financial agencies and organizations to implement the regime and policy for citizens during the period of registering for military service and medical examination and health check according to the provisions of this Decree.

2. Direct local financial agencies and organizations within their functional responsibilities to cooperate with local military agencies to ensure funding sources, regime, and policy for citizens during the period of registering for military service and medical examination and health check, and implement settlement and finalization according to the law.

Article 17. Ministry of Public Security

1. Direct, guide local public security agencies to coordinate with local military agencies at the same level to implement the regulations on procedures and formalities for registering military service obligations for citizens of conscription age as stipulated in this Decree.

2. Direct local public security agencies within their duties and powers to have the responsibility:

a) Public Security Departments of counties, districts, towns, and cities under provinces shall, from the 25th to the 30th day of the last month of each quarter, notify the Military Command Board of the county where the citizen has registered their military service obligation if they have been temporarily detained, temporarily imprisoned, or released; notify the Military Command Board of the county the list of citizens subject to military service who have transferred their permanent or temporary residence registration or have been granted a permanent or temporary residence registration.

b) Police stations, wards, and towns shall regularly, from the 25th to the 30th day of each month, exchange information and provide data to the corresponding military agencies regarding the registration and management of population and household registration within their jurisdiction.

Coordinate with local military agencies and related agencies to inspect and handle violations by agencies, organizations, and individuals of the regulations on procedures and formalities for registering military service obligations as prescribed in this Decree and other legal documents.

Article 18. Ministry of Health

1. Direct and guide health agencies of localities to coordinate with local military agencies at the same level to implement the regulations on medical examination and health check-up for military service registration as stipulated in this Decree.

2. Direct health agencies of counties, districts, towns, and cities under provinces (hereinafter referred to as county-level health agencies); health agencies of wards, towns, and towns (hereinafter referred to as ward-level health agencies) shall be responsible for:

a) County-level health agencies organize and implement medical examinations and health checks for citizens ready for enlistment and reserve military personnel according to the provisions of the law.

b) Ward-level health agencies guide citizens to fill out the Self-Health Declaration Form when implementing the procedures and formalities for first-time military service registration.

Article 19. Ministry of Education and Training, Ministry of Labor, Invalids and Social Affairs

1. Popularize, disseminate, and educate the law to students and trainees related to registration for compulsory military service.

2. Direct and guide educational institutions to coordinate with local military agencies where the educational institution is located to implement the regulations on procedures and formalities for military service registration for citizens when called upon to study at schools. Direct principals of secondary schools and high schools, directors of regular education centers to be responsible for compiling lists and notifying male citizens aged 17 years old in that year who are studying and implementing the procedures and formalities for first-time military service registration with local military agencies.

Article 20. Other Ministries and Sectors

Based on their functions, tasks, and authorities, coordinate with the Ministry of National Defense to direct and guide subordinate agencies and units to implement the regulations on procedures and formalities for registration and policies for citizens during the registration period and medical examination and health check-up for military service as stipulated in this Decree and guiding documents.

Article 21. People's Committees at all levels

Direct local military agencies under their own authority and related agencies in the locality to organize and implement procedures and formalities for registration and policies for citizens during the registration period and medical examination and health check-up for military service as stipulated in this Decree and regulations of the Ministry of National Defense on military service registration.

Article 22. Military Region, Provincial Military Command, District Military Headquarters, Commune Military Headquarters

1. The Military Region Command and the Provincial Military Command shall be responsible for directing, guiding, inspecting the registration of military service obligations by the district-level military agencies according to the provisions of this Decree.

2. The District Military Headquarters shall directly direct, guide, organize the implementation, and compile the registration and management of citizens fulfilling their military service obligations.

3. The Commune Military Headquarters shall implement the procedures and formalities for registering military service obligations according to the provisions of this Decree and the guidance documents issued by higher levels.

Chapter V

IMPLEMENTING PROVISIONS

Article 23. Effectiveness of Implementation

1. This Decree takes effect from April 8, 2016. The provisions regarding professional military personnel and defense workers and officials registering for reserve positions take effect from July 1, 2016, the date when the Law on Professional Military Personnel and Defense Workers and Officials comes into force.

2. Decree No. 83/2001/ND-CP dated November 9, 2001 of the Government on registration for compulsory military service ceases to be effective from the date this Decree takes effect.

Article 24. Responsibility for Implementation

The Minister, Heads of Ministries, Heads of Government Agencies, Chairpersons of People's Committees of provinces and centrally governed cities, organizations, and individuals concerned are responsible for implementing this Decree./.
