  CIRCULAR

Amending and supplementing some articles of Circular No. 01/2013/TT-BGTVT dated January 8, 2013 issued by the Minister of Transport on registration of transportation means On

January 1, 2013

involving railway transportation

Pursuant to the Railway Law dated June 14, 2005;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Transport Department and the Director of the Vietnam Railway Administration,

The Minister of Transport hereby promulgates this Circular amending and supplementing some articles of Circular No. 01/2013/TT-BGTVT dated January 8, 2013 issued by the Minister of Transport on registration of railway transportation means.

Article 1. Amending and supplementing some articles of Circular No. 01/2013/TT-BGTVT dated January 8, 2013 issued by the Minister of Transport on registration of railway transportation means

1. Amending and supplementing Clause 3, Clause 4 Article 6 as follows:

“3. The Vietnam Railway Administration shall receive and examine the file. In case the file is incomplete according to regulations, from the date of receipt of the file, the Vietnam Railway Administration must guide the owner of the means to complete the file within 01 working day (if the file is submitted directly) or notify in writing the owner of the means to supplement the file within 02 working days (if the file is received through postal service).

4. Within a period not exceeding 03 working days from the date of receiving the complete file according to regulations, the Vietnam Railway Administration shall issue the Certificate of Registration for the means. In case it does not issue, the Vietnam Railway Administration shall provide a written response to the owner of the means and specify the reasons.”

2. Amending and supplementing Clause 2 Article 7 as follows:

“2. Documents of the means

a) For imported, domestically produced, or assembled means: original or certified copy of the original purchase contract, production, or assembly contract of the means; original or certified copy of the original sales invoice according to the regulations of the Ministry of Finance (if the means is sold through multiple organizations or individuals, only the certified copy of the original sales invoice of the final selling organization or individual is required when registering); for imported means, an additional original or certified copy of the original customs declaration for imported goods is also required.

b) For used means

Original or certified copy of the original: purchase contract, sales invoice according to the regulations of the Ministry of Finance (if the means is sold through multiple organizations or individuals, only the original or certified copy of the original sales invoice of the final selling organization or individual is required when registering), if there are insufficient such documents, the following documents are required: original or certified copy of the original decision on the transfer of the means or list of types of means currently in use by the owner of the means (or the person authorized by the owner) according to the law.

c) In case the purchase contract, production, or assembly contract, sales invoice, customs declaration of the file includes declarations of multiple means, the owner of the means shall be responsible for providing the file for each means according to the provisions at point a and point b of Clause 2 of this Article.”

3. Amending and supplementing Clause 3 of Article 7 as follows:

“3. Original or certified copy of the original Certificate of Quality, Safety Technical Standards, and Environmental Protection of the means issued by the Vietnam Inspection Agency and still valid.”

4. Amending Point d Clause 1 Article 8 as follows:

“d) Original or certified copy of the original of the following documents: contracts, invoices for purchasing or selling the means or decisions on transferring the means.”

5. Supplementing Point d Clause 2 Article 11 as follows:

“d. For car types like M, MVT, P and cars limited by size of walls and frames, the marking of group 1, group 2, and group 3 shall be made on the same line.”

6. Amend and supplement Article 13 as follows:

“Article 13. Font style, font size, and number of the registration number of railway transportation means

1. Font style, punctuation marks, and numbers according to the Arial font;

2. Font size and number size between 120 mm and 150 mm;

3. Transportation means with additional lowercase letters (for example, the letter "n" in the symbol of soft sleeper car An) have a height equal to 50% of the height of other letters and numbers.”

7. Amend Article 16 as follows:

“Article 16. Transitional Provisions

Railway transportation means that have been issued a Certificate of Registration by the Vietnam Railway Administration from January 1, 2006 to the present shall retain their old registration numbers. In case the owner requests a new Certificate of Registration, the Vietnam Railway Administration will process the issuance of a new Certificate of Registration according to the provisions of this Circular.

8. Replacing Appendices 1, 2, 3, 4, 5, 6 promulgated together with Circular No. 01/2013/TT-BGTVT dated January 8, 2013 with Appendices 1, 2, 3, 4, 5, 6 respectively promulgated together with this Circular.

Article 2. Abolished Provisions

Abolish Clause 3 of Article 3 of Circular No. 01/2013/TT-BGTVT dated January 8, 2013, issued by the Minister of Transport regarding the registration of railway transport vehicles.

Article 3. Effectiveness

This Circular takes effect from August 15, 2016.

Article 4. Organization of Implementation

1. The Vietnam Railway Corporation shall be responsible for organizing the implementation of this Circular.

2. In case of difficulties or obstacles during the implementation process, organizations and individuals shall promptly report to the Vietnam Railway Corporation for consolidation and reporting to the Ministry of Transport for consideration and resolution.

3. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Railway Corporation, the Heads of agencies and units, and related individuals shall be responsible for implementing this Circular./.
