PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
These regulations apply to organizations and individuals in Vietnam and foreign organizations and individuals related to the training and issuance of professional certificates for ship agency personnel operating in Vietnam.
Article 2. Applicability
PROFESSIONAL CERTIFICATE FOR SHIP AGENCY
Chapter II
Article 3. Professional Certificate for Ship Agency
1. The professional certificate for ship agency is issued by the training institution to participants who complete the ship agency personnel training program.
2. The professional certificate for ship agency shall be in the form attached as Appendix to this Circular.
Article 4. Content of Training for Ship Agency Personnel
1. The volume of knowledge for the training content consists of three modules with a total of 45 (forty-five) class hours.
2. The modules include:
a) Module I (15 class hours) on maritime laws, customs, border defense, quarantine, and relevant international treaties;
b) Module II (15 class hours) on ship agency business operations;
c) Module III (15 class hours) on specialized English language.
Article 5. Training Program for Ship Agency Personnel
1. The Vietnam Maritime Administration shall develop and promulgate a framework training program for ship agency personnel based on the training content prescribed in Article 4 of this Circular.
2. Training institutions for ship agency personnel shall prepare lectures according to the framework training program for ship agency personnel issued by the Vietnam Maritime Administration.
Article 6. Responsibilities of the Vietnam Maritime Administration
Chapter III
RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS
1. To take the lead and coordinate with relevant agencies and units to organize inspections and supervision of training institutions for ship agency personnel.
2. To update information annually on training institutions for ship agency personnel and publicly announce it on the Vietnam Maritime Administration's electronic portal.
Article 7. Responsibilities of Training Institutions for Ship Agency Personnel
1. To comply with the training content and be responsible for certifying the training results.
2. To publicly announce the training program and plan for ship agency personnel at the training institution and on the training institution's website or on the Vietnam Maritime Administration's electronic portal.
3. To report annually to the Vietnam Maritime Administration on the training results and certification for ship agency personnel.
Chapter IV
IMPLEMENTING PROVISIONS
Article 8. Effective Date
1. This Circular takes effect from July 1, 2017.
The Head of the Ministry’s Office, the Inspector General of the Ministry, the Directors of Departments, the Director of the Vietnam Maritime Administration, and the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
Article 9. Implementation Organization
The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Maritime Administration, and the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
