DECISION
Amending and supplementing some articles of Decision No. 127/2009/QĐ-TTg
dated October 26, 2009 of the Government promulgating
Regulations on Statistical Reporting on Prevention and Control of Narcotics
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Law on Prevention and Control of Narcotics dated December 9, 2000 and the Law Amending and Supplementing Some Articles of the Law on Prevention and Control of Narcotics dated June 3, 2008;
Pursuant to the Law on Statistics dated November 23, 2015;
Pursuant to the Law on Enactment of Legal Normative Documents dated June 22, 2015;
The Government promulgates this Decree on regulations regarding entry, exit, and residence policies for foreigners at the International Financial Center in Vietnam.
The Prime Minister issues this Decision amending and supplementing some articles of Decision No. 127/2009/QĐ-TTg dated October 26, 2009 of the Prime Minister promulgating Regulations on Statistical Reporting on Prevention and Control of Narcotics.
Article 1. Amending and supplementing some articles of Decision No. 127/2009/QĐ-TTg dated October 26, 2009 of the Prime Minister promulgating Regulations on Statistical Reporting on Prevention and Control of Narcotics as follows:
1. Clause 1 of Article 2 shall be amended and supplemented as follows:
"The group of indicators regarding persons using narcotics illegally, drug addicts, drug rehabilitation, and post-rehabilitation management includes:
a) Indicators regarding persons using narcotics illegally and drug addicts:
- Indicators on the number of persons using narcotics illegally and drug addicts: total number of persons using narcotics illegally and drug addicts with management files; number of persons using narcotics illegally and drug addicts currently in temporary detention centers, holding facilities, prisons, educational institutions, and juvenile correctional schools; number of drug addicts currently in rehabilitation facilities.
- Indicators on persons using narcotics illegally and drug addicts: full name, year of birth; age (under 14 years old, from 14 to under 16 years old, from 16 to under 18 years old, from 18 to 30 years old, 30 years old and above); gender (male, female); ethnicity (Kinh, others); place of residence; level of education (illiterate; general education: grade level; college; university); occupation (employed, unemployed); time and type of narcotics used; forms and measures of rehabilitation applied; criminal record or administrative violation.
b) Indicators regarding drug rehabilitation include: number of drug addicts undergoing rehabilitation; number of individuals undergoing rehabilitation at home, in the community, in rehabilitation facilities, temporary detention centers, prisons, educational institutions, and juvenile correctional schools.
c) Indicators regarding post-rehabilitation management of drug addicts include: number of individuals managed in post-rehabilitation facilities; number of individuals managed in their place of residence by commune, ward, town people's committees; number of individuals relapsing within one year, two years, three years, four years, five years after rehabilitation.
d) Indicators regarding vocational training, job creation, and loan provision for post-rehabilitation drug addicts include: number of individuals receiving vocational training, number of individuals obtaining employment, number of individuals receiving loans, total amount of loans provided.
đ) Indicator on communes, wards, towns without drug-related social evils."
2. Points c, d, đ of Clause 2 of Article 2 shall be amended and supplemented as follows:
"c) Indicators regarding prosecution of drug-related crimes include: number of cases, number of defendants prosecuted for drug-related crimes according to charges, age (from 14 to under 16 years old, from 16 to under 18 years old, from 18 to 30 years old, 30 years old and above); gender (male, female); occupation (employed, unemployed); nationality (Vietnamese, foreign, stateless); ethnicity (Kinh, others).
d) Indicators regarding adjudication of drug-related crimes include: number of cases, number of defendants convicted of drug-related crimes according to charges, age (from 14 to under 16 years old, from 16 to under 18 years old, from 18 to 30 years old, 30 years old and above); gender (male, female); occupation (employed, unemployed); nationality (Vietnamese, foreign, stateless); ethnicity (Kinh, others) and sentence imposed.
đ) Indicators regarding enforcement of sentences for drug-related crimes include: number of cases, amount of money, quantity of narcotics, precursor chemicals, number of individuals convicted of drug-related crimes enforced according to charges, age (from 14 to under 16 years old, from 16 to under 18 years old, from 18 to 30 years old, 30 years old and above); gender (male, female); occupation (employed, unemployed); nationality (Vietnamese, foreign, stateless); ethnicity (Kinh, others) and sentence enforced."
3. Clause 4 of Article 2 shall be amended and supplemented as follows:
"a) Indicators regarding export, import, transit of narcotics, precursor chemicals, narcotic drugs, psychotropic substances, and precursor substances; combined drugs containing narcotic substances, combined drugs containing psychotropic substances, and combined drugs containing precursor substances; raw materials being narcotic substances, psychotropic substances, precursor substances, veterinary drugs containing narcotic substances, psychotropic substances, and precursor substances;
b) Indicators regarding storage, purchase, sale, production, and lawful use of narcotics, precursor chemicals, narcotic drugs, psychotropic substances, and precursor substances; combined drugs containing narcotic substances, combined drugs containing psychotropic substances, and combined drugs containing precursor substances; raw materials being narcotic substances, psychotropic substances, precursor substances, and veterinary drugs containing narcotic substances, psychotropic substances, and precursor substances;"
4. Amending and supplementing Article 7 as follows:
"Article 7. Responsibilities of the Ministry of Labor, Invalids and Social Affairs
1. To compile statistical data on drug addicts and drug rehabilitation in rehabilitation facilities, at home, and in the community according to the indicators specified in point b of Clause 1 of Article 2.
2. To compile statistical data on addressing social issues after rehabilitation according to the indicators specified in points c and d of Clause 1 of Article 2.
3. To compile statistical data on international cooperation according to the indicators specified in point a of Clause 5 and the use of funds for prevention and control of narcotics as stipulated in Clauses 7 and 8 of Article 2.
4. To compile statistical data on students, trainees, teachers, lecturers, officials, and staff who are drug addicts in vocational education institutions under the management of the Ministry of Labor, Invalids and Social Affairs according to the following indicators:
a) Indicators on students, trainees, teachers, lecturers, officials, and staff who are drug addicts by province and centrally-administered city and by each vocational education institution.
b) Indicators on students and trainees dropping out or expelled due to drug addiction.
c) Indicators regarding students, trainees, teachers, lecturers, officials, civil servants, public servants, and workers who commit drug-related crimes.
d) Indicators concerning the situation and results of anti-drug efforts in vocational education institutions.
5. Amend and supplement Article 8 as follows:
"Article 8. Responsibilities of the Ministry of National Defense
Statistics on drug crime prevention and control according to the indicators specified in points a, b, c, d, đ Clause 2, Clauses 5, 6, 7, 8 Article 2."
6. Amending and supplementing Article 9 as follows:
"Article 9. Responsibilities of the Ministry of Health
Statistics on narcotic drugs, psychotropic substances, precursor chemicals; combined preparations containing narcotic drug ingredients, combined preparations containing psychotropic drug ingredients, combined preparations containing precursor chemicals; raw materials that are narcotic drug ingredients, psychotropic drug ingredients, precursors used in the medical field, analysis, testing, and scientific research according to the indicators specified in Clause 4, Clause 8 Article 2 and the following indicators:
a) Results of researching drugs and methods to support treatment for drug addiction.
b) Number of permits for the circulation of drugs supporting treatment for drug addiction issued and revoked.
c) Data on opiate substance addicts treated with substitute drugs. Data on individuals confirmed by health authorities to be addicted.
đ) Data on projected demand for narcotic substances, psychotropic substances, and precursors in the medical field."
2. The application file for investigation of emergency measures for textile products as prescribed in Article 63 of Decree No. 86/2025/NĐ-CP must also include the following specific additional contents:
"Article 10. Responsibilities of the Ministry of Agriculture and Rural Development
1. Report on statistics of programs and projects implemented by the Ministry of Agriculture and Rural Development to serve the purpose of preventing the cultivation of plants containing narcotic substances.
2. Statistics on export, import, purchase and sale, production, storage, and use of veterinary drugs containing narcotic substances, active psychotropic substances, and precursors according to the indicators specified in Clause 4, Clause 8 Article 2."
8. Amending and supplementing Article 11 as follows:
"Article 11. Responsibilities of the Ministry of Industry and Trade
Statistics on export, import, temporary import for re-export, purchase and sale, production, storage, and use of precursors in the industrial and commercial fields according to the indicators specified in Clause 4, Clause 8 Article 2."
9. Amend and supplement Article 12 as follows:
"Article 12. Responsibilities of the Ministry of Education and Training
Statistics on students, trainees, teachers, lecturers, officials, civil servants, public servants, and workers addicted to drugs and anti-drug work in schools under the management of the Ministry of Education and Training (kindergartens, primary and secondary schools, continuing education, higher education, and teacher training colleges) according to the following indicators:
1. Indicators on students, trainees, teachers, lecturers, officials, civil servants, public servants, and workers addicted to drugs by province and city directly under the central government and by school.
2. Indicators on students, trainees dropping out or being expelled due to drug addiction.
3. Indicators on students, trainees, teachers, lecturers, officials, civil servants, public servants, and workers committing drug-related crimes.
4. Indicators on the situation and results of anti-drug efforts in schools."
10. Amend and supplement Article 17 as follows:
"Article 17. Responsibilities of the Ministry of Justice
Statistics on drug prevention and control according to the following indicators:
1. Data on enforcement of civil judgments for drug-related crimes specified in point đ Clause 2 Article 2.
2. Indicators on amending, supplementing, and promulgating new regulatory legal documents on drug prevention and control.
3. Indicators on assets executed from drug-related criminal cases.
4. Indicators on the retention, preservation, destruction, and disposal of drug substances and precursors as evidence in criminal cases at each province and city directly under the central government during the execution phase."
11. Amend and supplement Article 21 as follows:
"Article 21. Responsibilities of the Ministry of Public Security
1. Implement national statistics on drug prevention and control; manage information on drug-related crimes, specifically:
a) Aggregate and systematize statistical information on drug prevention and control from relevant ministries, departments, provincial and municipal people's committees, and organizations and individuals.
b) Develop and manage data on drug prevention and control.
c) Direct police forces at all levels to assist local people's committees in collecting and managing statistical information on drug prevention and control.
2. Statistics on drug crimes and combating drug-related crimes according to the indicators specified in points a, b Clause 2; Clauses 4, 5, 6, 7, 8 Article 2.
3. Statistics on illegal drug users, current drug addicts outside society, in temporary detention centers; drug users, drug addicts, and drug rehabilitation patients in prisons, detention centers, compulsory educational facilities, and juvenile correctional schools according to the indicators specified in points a, b Clause 1 Article 2. Coordinate with the Ministry of Labor, Invalids, and Social Affairs to unify nationwide drug rehabilitation data.
4. Serve as the coordinating body for international exchanges and cooperation on drug prevention and control statistics.
5. Statistics on communes, wards, towns without drug-related social evils."
12. Amend and supplement Clause 2 Article 29 as follows:
"2. Reporting deadline: Before the fifth day of the month following the reporting period."
13. Amend and supplement Clause 1 of Article 32 as follows:
"1. Reporting periods
a) Six-month report covering data from November 1 of the previous year to April 30 of the reporting year.
b) Annual report covering data from November 1 of the previous year to October 31 of the reporting year."
Article 2. Implementation clause
1. This Decision takes effect from April 15, 2019.
2. Ministers, heads of ministerial-level agencies, heads of governmental agencies, Chairpersons of provincial and municipal people's committees directly under the central government are responsible for implementing this Decision.
We request the Supreme People's Procuracy, the Supreme People's Court to base on the provisions of this Decision to coordinate with the Ministry of Public Security; the Ministry of Planning and Investment to organize guidance on the implementation of this Decision.
We request the Vietnam Fatherland Front Central Committee and its member organizations to supervise the implementation of this Decision.
3. The Ministry of Public Security shall take the lead, coordinate with relevant ministries, sectors, and localities to enhance the application of information technology in drug prevention and control statistics to ensure uniform implementation nationwide; guide, inspect, and enforce this Decision.
4. Ministries, sectors, and localities shall develop statistical forms and enhance the application of information technology in reporting and statistics on drug prevention and control./.
