The Government promulgates this Decree amending and supplementing certain provisions of the Decree No. 148/2016/NĐ-CP dated October 4, 2016 of the Government guiding the implementation of certain provisions of the Market Management Ordinance.

Considering the proposal of the Director of the General Department of Teachers and Educational Management,

The Minister of Education and Training issues this Circular to regulate the standards for the positions of Director and Deputy Director of provincial education and training departments under municipal people's committees directly under the central government.No.cơ sở giáo dục và đào tạo thuộc ủy ban nhânâdân tỉnh, thành phốNo. under the central authority.

Article 1. Scope of Regulation and Applicability

1. Thông tư này quy định tiêu chuẩn chức danh Giám đốc, Phó giám đốc sở giáo dục và đào tạo thuộc ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương (sau đây gọi chung là Giám đốc, Phó giám đốc sở giáo dục và đào tạo).

2. This Circular applies to:

1. This Circular regulates the standards for the positions of Director and Deputy Director of provincial education and training departments under municipal people's committees directly under the central government (hereinafter referred to collectively as Directors and Deputy Directors of provincial education and training departments).

a) Cadres, civil servants, and public officials who are planned, trained, promoted, reappointed, or relieved from the positions of Director and Deputy Director of provincial education and training departments;

b) Agencies, organizations, and individuals with authority over the management and utilization of civil servants and public officials who implement procedures for planning, training, promoting, reappointing, or relieving from the positions of Director and Deputy Director of provincial education and training departments;

Article 2. Principles of Application

c) Agencies with authority to inspect, supervise, and audit the planning, promotion, reappointment, and relief from the positions of Director and Deputy Director of provincial education and training departments.

1. The standards for the positions of Director and Deputy Director of provincial education and training departments stipulated in this Circular serve as the basis for competent authorities to implement; inspect, supervise, and audit the planning, promotion, reappointment, and relief from the positions of Director and Deputy Director of provincial education and training departments; and train and enhance the skills of civil servants holding these positions.

2. Cadres, civil servants, and public officials must meet the general standards set forth by the Party and State when being considered for planning, promotion, or reappointment to the positions of Director and Deputy Director of provincial education and training departments, while also meeting the standards specified in this Circular.

Article 3. General Standards for Directors and Deputy Directors of Provincial Education and Training Departments

1. Profound understanding of the Party’s guidelines and policies, and the State’s laws concerning education and training and related fields, to apply them in leading, managing, and directing the education and training sector at the local level. Serving as a model in ethics, lifestyle, and compliance with the Party’s guidelines and State’s policies and laws.

2. Passionate and responsible for work, management, and leadership; scientific and democratic working style, adherence to principles; decisive and accountable for work, management, and leadership; spirit of innovation, research, creativity, and dynamism to fulfill assigned tasks; honest, modest, incorruptible, simple lifestyle; actively preventing negative phenomena in education and training at the local level.

3. Ability to forecast, strategic thinking, development orientation, and practical summary; ability to manage change; ability to process and communicate information in education and training.

4. Ability to advise the provincial People's Committee and the Chairman of the provincial People's Committee on building and implementing policies on education and training; ability to organize the implementation of tasks within the scope of state management of education by the provincial education and training department according to regulations to address issues in education and training at the local level.

5. Ability to unite the masses, internal solidarity, and promote democracy; create a cultural working environment that fosters creativity among members of the provincial education and training department and affiliated educational institutions.

6. Ability to coordinate with various levels, agencies, organizations, and individuals involved to effectively perform assigned tasks and care for the development of education at the local level.

7. Hold a certificate for training in the position of Director and Deputy Director of provincial education and training departments as prescribed by the Ministry of Education and Training.

Article 4. Criteria for the title of Director of the Department of Education and Training

1. Ensuring the criteria stipulated in Article 3 of this Circular.

2. Graduated from a bachelor's degree in education or a bachelor's degree with a teaching profession certificate.

3. Having held the position of Deputy Director of the Department of Education and Training or an equivalent position or higher.

4. Being approved by the competent authority for the planning of the title of Director of the Department of Education and Training or an equivalent title.

Article 5. Criteria for the title of Deputy Director of the Department of Education and Training

1. Ensuring the criteria stipulated in Article 3 of this Circular.

2. Graduated from a bachelor's degree or higher in a relevant field corresponding to the area of work undertaken.

3. Having held the position of Head of Division or Deputy Head of Division within the Department of Education and Training or an equivalent position or higher.

4. Being approved by the competent authority for the planning of the title of Deputy Director of the Department of Education and Training or an equivalent title.

Article 6. Provisions on Application

1. Cadres, civil servants, and public officials who are considered for planning into the positions of Director and Deputy Director of the Department of Education and Training must meet the criteria according to the Party and State’s planning guidelines and the criteria specified in Clauses 1, 2, 3, 4, 5, 6, and 8 of Article 3 of this Circular.

2. Based on the criteria for titles stipulated in this document, the competent authority shall implement planning, training, and development, and consider appointment, reappointment, and removal from the positions of Director and Deputy Director of the Department of Education and Training.

3. For female individuals aged 50 or older and male individuals aged 55 or older who were appointed to the positions of Director and Deputy Director of the Department of Education and Training before the effective date of this Circular, it is not required to fully meet the criteria set forth in this Circular.

4. In cases where females under 50 years old and males under 55 years old were appointed to the positions of Director and Deputy Director of the Department of Education and Training before the effective date of this Circular but have not yet met all the criteria, during their term of appointment, they must ensure that they fully meet the criteria set forth in this Circular.

Article 7. Effective Date

1. This Circular takes effect from October 24, 2019.

2. Decision No. 81/2008/QĐ-BGDĐT dated December 31, 2008, issued by the Minister of Education and Training regarding the criteria for the titles of Director and Deputy Director of the Department of Education and Training ceases to be effective from the date this Circular takes effect.

Article 8. Responsibility for Implementation

The Chairmen of the People's Committees of provinces and centrally governed cities, the Directors of the General Department of Teachers and Educational Management, the Ministry of Education and Training, and related organizations and individuals are responsible for implementing this Circular./.
