Article 4. Objects of national technical standards and national standards
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. The objects of QCVN and TCVN are products, equipment, networks, systems, services, processes in the field of information and communication and are specifically defined within the scope of regulation of technical standards and standards.
Article 2. Applicability
2. The objects of QCVN and TCVN belong to fields assigned under Point g Clause 7 Article 1 of Decree No. 78/2018/NĐ-CP dated May 16, 2018 of the Government amending and supplementing certain articles of Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
3. The objects of QCVN and TCVN belong to other fields according to management requirements at different periods stipulated in relevant specialized laws and the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications.
Article 5. Principles for determining the objects of national technical standards
Products, equipment, networks, systems, services, processes that are objects of QCVN must comply with the following principles:
1. They have a wide scope, affecting many organizations and individuals; they relate to human safety and health; occupational safety and hygiene; environment; rights and legitimate interests of related parties.
2. They have the potential to cause harm to humans and the environment during installation, operation, and use.
3. They have the potential to adversely affect other products, equipment, networks, systems during operation and use, thereby indirectly causing harm to humans, the environment, social order and security, national defense, and security.
4. They can influence the interoperability between users' devices and operators' or service providers' devices, networks, and systems, and between different operators' or service providers' devices, networks, and systems, and government agencies.
5. They need to be regulated with technical characteristics and quality requirements to ensure sustainable development of the entire network or system or public interest objectives.
6. They need to specify quality requirements to ensure the legitimate rights of service users.
7. They need to meet special requirements serving management goals at different periods of the Ministry of Information and Communications.
1. Has a broad scope, involving many organizations and individuals; related to human safety and health; labor safety and hygiene; environment; rights and legitimate interests of relevant parties.
2. Has the potential to cause safety hazards to humans and the environment during installation, operation, and use.
3. Has the potential to adversely affect other products, equipment, networks, and systems during operation and use, thereby indirectly causing harm to humans, the environment, social order and safety, national defense, and security.
4. Has the potential to impact the interoperability between users' devices and operators', service providers' devices, networks, and systems, as well as between different operators', service providers' devices, networks, and systems, and state agencies.
5. Needs to specify technical characteristics and quality requirements to ensure sustainable development of the entire network, system, or public interest objectives.
6. Must stipulate quality requirements to ensure users' legitimate rights and interests.
7. Must meet special requirements serving management goals at each period of the Ministry of Information and Communications.
Article 6. Principles for Determining the Objects of National Standards
Products, equipment, networks, systems, services, and processes that are objects of National Technical Standards (NTS) must ensure the following principles:
1. Meeting functional objectives, utility, and quality: determining advanced and appropriate technologies and technical characteristics for application in Vietnam.
2. Meeting objectives of economy and efficiency: effectively utilizing resources; having advanced practices to apply in agencies and organizations in Vietnam.
3. Meeting information and understanding objectives: disseminating and enhancing knowledge and application of products, equipment, networks, systems, services, and processes.
4. Meeting objectives of reducing types and interchangeability: allowing the selection of an optimal number of sizes or types of products, equipment, services, and processes that can be interchangeable while still meeting the same requirements.
5. Meeting other special requirements serving management goals during each period as specified by the Ministry of Information and Communications.
Article 7. Basic Standards
1. Agencies and organizations establish basic standards in the field of information and communication based on practical needs and capabilities to meet management, production, business, and service provision requirements. Basic standards must not conflict with technical regulations and current laws.
2. National standards, international standards, regional standards, or foreign standards are encouraged to be used for building or accepting as basic standards.
3. Basic standards are applied to products, equipment, networks, systems, services, and processes of the agency or organization itself. Basic standards may be used to announce product, goods, and service quality when circulating in the market according to the Product Quality Law.
4. The procedures and formalities for establishing and announcing basic standards are stipulated in Section IV.3 of Circular No. 21/2007/TT-BKHCN dated September 28, 2007, guiding the establishment and application of standards issued by the Ministry of Science and Technology.
Article 8. Requirements for Drafts of National Technical Regulations and National Standards
1. The contents of National Technical Regulations (NTR) and National Standards (NS) must comply with the following basic requirements:
a) Adhering to the fundamental principles of activities in the standardization field and technical regulation field as prescribed in Article 6 of the Standardization and Technical Regulation Law and the principles for determining the objects of NTR and NS as prescribed in Articles 5 and 6 of this Circular.
b) Ensuring consistency, synchronization, and absence of contradictions within the system of NTR and NS.
c) Technical provisions and technical requirements must be objectively measurable and assessable; in NTR, the measurement and assessment methods must be clearly defined.
d) Technical provisions and technical requirements must be accurately, concisely, and unambiguously expressed.
2. Provisions for NTR and NS established based on acceptance of international standards:
a) Prioritizing the establishment of NTR and NS based on acceptance of widely adopted international standards, regional standards, or foreign standards (hereinafter referred to as international standards).
b) An NTR accepting an international standard is stated in the preface as "national technical regulation containing technical provisions and testing methods consistent with international standards."
c) An NS accepting an international standard retains the basic structure and content of the international standard and is fully equivalent to it, as indicated in the preface as "national standard completely equivalent to international standards" and marked with the equivalent symbol of the international standard.
d) NTR and NS accepting two or more international standards are stated in the preface as "national technical regulation and national standard established based on international standards."
3. Presentation format of NTR and NS:
a) The presentation and expression of NTR content are carried out according to the provisions in Appendix V attached to this Circular.
b) The presentation and expression of NS content are carried out according to TCVN 1-2:2008, Standardization - Part 2: Rules for Presentation and Expression of National Standard Content.
Article 9. Funding for activities in the field of national technical regulations and national standards
1. The funding is allocated in the annual state budget estimate for scientific and technological activities and other funding arranged in the annual budget of the Ministry of Information and Communications to cover the costs of developing QCVNs and TCNs; financial support and sponsorship funds (if any); and other lawful sources of income (if any).
2. The funding includes: organizing surveys, trials, drafting, reviewing draft QCVNs and TCNs, planning, reviewing, converting, drafting, promulgating, registering, disseminating, applying, inspecting, and evaluating QCVNs and TCNs.
3. The preparation, examination, and approval of the budget estimates and final accounts for the development of QCVNs and TCNs from the state budget shall be carried out in accordance with the provisions of the State Budget Law.
4. Financial support provided by organizations and individuals both domestically and internationally shall be managed and utilized in accordance with current laws and relevant regulations on sponsorship and support (if any).
Chapter II
NATIONAL TECHNICAL REGULATIONS
Article 10. Annual Plan for Developing National Technical Regulations
1. The annual plan for developing QCVNs of the Ministry of Information and Communications shall be implemented as follows:
a) In the second quarter of each year, agencies, organizations, and individuals shall submit their plans for developing QCVNs for the following year to the Ministry of Information and Communications (Science and Technology Department) using the form attached as Appendix I to this Circular;
b) The Science and Technology Department shall compile, assess the necessity, and propose the draft plan for developing QCVNs. By October 31 of each year, the draft plan for developing QCVNs shall be sent to the Ministry of Science and Technology and related organizations for comments.
c) Based on the opinions of related organizations and individuals, the Science and Technology Department shall compile, revise, and finalize the draft plan for developing QCVNs for submission to the Minister of Information and Communications for consideration and approval before December 31 of the preceding year.
2. The plan for developing QCVNs may only be adjusted or supplemented when it ensures the content, implementation timeline, and has the directive of the leadership of the Ministry of Information and Communications.
3. The Ministry of Information and Communications shall announce and publish on its official website the decision approving the annual plan for developing QCVNs so that related agencies, organizations, and individuals can implement the drafting of QCVN drafts.
Article 11. Implementation of Drafting National Technical Regulations
The entity assigned the main responsibility (hereinafter referred to as the main responsible entity) shall implement the drafting of draft QCVNs according to the procedures and requirements as follows:
1. Organize research and drafting of the draft QCVN in accordance with the content and schedule set forth in the approved plan and project for developing QCVNs.
2. Organize conferences, seminars, and seek opinions from experts and related organizations and individuals.
3. Report to the Ministry of Information and Communications (Science and Technology Department) on any changes in the content and schedule of the QCVN and report on the implementation of required tasks.
4. Report to the Ministry of Information and Communications (Science and Technology Department) to send the draft QCVN for broad comments from related agencies, organizations, and individuals; and solicit comments on the Government's official website and the Ministry of Information and Communications' official website for at least sixty days. In cases where the QCVN may create technical barriers in international trade, the draft QCVN must be submitted for international comments in accordance with the provisions of international treaties to which Vietnam is a signatory or participant.
5. Based on the comments from related agencies, organizations, and individuals, complete the draft QCVN and the draft QCVN dossier to be sent to the Ministry of Information and Communications for review. The draft QCVN dossier includes:
a) A letter requesting the review of the draft QCVN dossier from the main responsible entity to the Ministry of Information and Communications (Science and Technology Department);
b) The decision approving the plan for developing QCVNs;
c) The approved QCVN development project in the form attached as Appendix II to this Circular;
d) A report on the process of drafting the draft QCVN;
đ) An explanatory note on the draft QCVN (including the electronic version) in the form attached as Appendix VI to this Circular;
e) The draft QCVN (including the electronic version) along with copies of the original documents used as the basis for drafting the draft QCVN and other reference materials (if any);
g) A list of agencies, organizations, and individuals to whom the draft QCVN was sent for comments; a statement explaining and adopting comments along with the comment letters;
h) Other documents and materials (if any).
6. Coordinate with the Science and Technology Department to complete the draft QCVN dossier during the review and promulgation process of the QCVN.
Article 12. Examination of National Technical Regulation Documents
1. The Science and Technology Department shall submit to the Minister of Information and Communications for decision on establishing the Examination Board for the Draft National Technical Regulation Documents.
2. The Examination Board shall consist of an odd number of members, with at least seven members including:
a) The Chairman is a leader from the Science and Technology Department;
b) Other members are experts representing relevant agencies and units.
3. Responsibilities of the Examination Board:
a) Examine and evaluate the completeness and compliance with procedures of draft National Technical Regulation Document files; their conformity with approved plans;
b) Examine the content of draft National Technical Regulation Documents.
4. Principles of operation of the Examination Board:
a) In accordance with democratic, independent, objective, transparent principles, members openly discuss assigned tasks while being responsible for their opinions;
b) At least two-thirds (2/3) of the members must be present at meetings of the Examination Board, decisions are made by majority vote. The conclusions of the Examination Board are recorded in the minutes of the Examination Board meeting according to Appendix VII issued together with this Circular;
c) Members of the Examination Board are individually responsible for their evaluation opinions and conclusions recorded in the minutes of the Examination Board meeting.
5. Within fifteen (15) working days from the date of the establishment decision, the Examination Board must organize an examination meeting.
6. Based on the conclusions in the Examination Board meeting minutes, the leading unit shall revise and complete the draft National Technical Regulation Document file within no more than fifteen (15) working days and send it to the Science and Technology Department.
Article 13. Approval and Issuance of National Technical Regulations
1. The Science and Technology Department shall take the lead and coordinate with the unit drafting the National Technical Regulation Document to compile and perfect the draft National Technical Regulation Document file for reporting to the Ministry of Information and Communications, which will issue a document to the Ministry of Science and Technology (National Standardization Agency) for review.
2. After receiving the review results from the Ministry of Science and Technology:
a) If in agreement with the review opinion of the Ministry of Science and Technology, the Science and Technology Department shall take the lead and coordinate with related units to incorporate, perfect, and submit to the Minister of Information and Communications for issuance of the National Technical Regulation Document according to regulations;
b) If not in agreement with the review opinion of the Ministry of Science and Technology, the Science and Technology Department shall take the lead and coordinate with related units to issue a document to the Minister of Information and Communications for reporting to the Prime Minister for consideration and decision.
3. The Science and Technology Department shall manage and assign codes for National Technical Regulation Documents of the Ministry of Information and Communications. The code format for National Technical Regulation Documents of the Ministry of Information and Communications is QCVN xxx:yyyy/BTTTT, where:
a) QCVN is an abbreviation for National Technical Regulation;
b) xxx is the regulation number, consisting of two or three digits;
c) yyyy is the year of issuance, separated from the regulation number by a colon (:);
d) BTTTT is an abbreviation for the Ministry of Information and Communications, placed immediately after the year of issuance and separated by a forward slash (/).
Chapter III
NATIONAL STANDARD
Article 14. Annual Plan for Developing National Standards
1. The annual plan for developing TCVN of the Ministry of Information and Communications shall be implemented as follows:
a) In the second quarter of each year, agencies, organizations, and individuals shall register their plans for developing TCVN for the following year with the Ministry of Information and Communications (Science and Technology Department) in accordance with Appendix III issued together with this Circular;
b) The Science and Technology Department shall compile, assess the necessity, and propose a draft plan for developing TCVN. The plan for developing TCVN shall be submitted to the Ministry of Science and Technology before August 31 of each year;
c) Based on the Decision approving the plan for developing TCVN of the Ministry of Science and Technology, the Science and Technology Department shall review, perfect, and submit to the Minister of Information and Communications for approval to implement.
2. The plan for developing TCVN may be adjusted and supplemented according to the regulations of the Ministry of Science and Technology.
3. The Ministry of Information and Communications shall announce and publish on its website the decision approving the annual plan for developing TCVN for relevant agencies, organizations, and individuals to implement the development of draft TCVN.
Article 15. Implementation of Draft National Standard Development
The leading unit shall implement the development of the draft TCVN according to the procedures and requirements as follows:
1. Establish an Editorial Team to develop the draft TCVN.
2. Organize research and build the draft TCVN accurately in accordance with the content and schedule as approved in the plan and project for developing the TCVN.
3. Organize conferences, seminars, and seek opinions from experts and relevant organizations and individuals. In necessary cases, the Ministry of Information and Communications (Department of Science and Technology) shall organize conferences and seminars to seek opinions from experts and relevant organizations and individuals.
4. Report to the Ministry of Information and Communications (Department of Science and Technology) on any adjustments to the content and schedule of the draft TCVN and report on the implementation of the required contents.
5. Report to the Ministry of Information and Communications (Department of Science and Technology) to send the draft TCVN for broad opinions from relevant agencies, organizations, and individuals; and seek opinions on the Ministry of Information and Communications' electronic information portal for at least 60 (sixty) days.
6. Based on the comments from relevant organizations and individuals, complete the draft TCVN and the draft TCVN dossier to be sent to the Ministry of Information and Communications for review. The draft TCVN dossier includes:
a) A letter requesting the review of the draft TCVN dossier from the leading unit sent to the Ministry of Information and Communications (Department of Science and Technology);
b) Decision approving the plan for developing the TCVN;
c) The approved project for developing the TCVN according to the model attached in Appendix IV of this Circular;
d) Report on the process of developing the draft TCVN;
đ) Explanation of the draft TCVN (including the electronic version) according to the model attached in Appendix VI of this Circular;
e) The draft TCVN (including the electronic version) along with copies of original documents used as the basis for developing the draft TCVN and other reference materials (if any);
g) List of agencies, organizations, and individuals to whom the draft TCVN was sent for comments; explanation and adoption of comments accompanying the comment letters;
h) Other documents and materials (if any).
7. Coordinate with the Department of Science and Technology to complete the draft TCVN dossier during the review and assessment process and propose the publication of the TCVN.
Article 16. Review of National Standard Dossier
1. The Department of Science and Technology shall submit to the Minister of Information and Communications for decision to establish a Review Board for the draft TCVN dossier.
2. The Examination Board shall consist of an odd number of members, with at least seven members including:
a) The Chairman is a leader from the Science and Technology Department;
b) Other members are experts representing relevant agencies and units.
3. Responsibilities of the Examination Board:
a) Review to assess the completeness and procedural compliance of the draft TCVN dossier;
b) Review the content of the draft TCVN;
4. Principles of operation of the Examination Board:
a) In accordance with democratic, independent, objective, transparent principles, members openly discuss assigned tasks while being responsible for their opinions;
b) At least two-thirds (2/3) of the members must be present at meetings of the Examination Board, decisions are made by majority vote. The conclusions of the Examination Board are recorded in the minutes of the Examination Board meeting according to Appendix VII issued together with this Circular;
c) Members of the Examination Board are individually responsible for their evaluation opinions and conclusions recorded in the minutes of the Examination Board meeting.
5. Within fifteen (15) working days from the date of the establishment decision, the Examination Board must organize an examination meeting.
6. Based on the conclusions recorded in the meeting minutes of the Review Board, the leading unit shall revise and perfect the draft TCVN dossier within no more than 15 (fifteen) working days and send it back to the Department of Science and Technology.
Article 17. Assessment and Publication of National Standards
1. The Department of Science and Technology shall take the lead and coordinate with the unit developing the draft TCVN to compile the TCVN dossier and report to the Ministry of Information and Communications to send a document to the Ministry of Science and Technology (National Standardization, Metrology and Quality Control Administration) for assessment and publication of the TCVN.
2. The procedures and timeframes for assessing the TCVN (at the Ministry of Science and Technology) shall be carried out in accordance with the regulations of the Ministry of Science and Technology.
3. If the Ministry of Science and Technology has comments that the draft TCVN dossier does not meet the requirements, the Department of Science and Technology shall coordinate with the leading unit to supplement and perfect the dossier and resubmit it to the Ministry of Science and Technology within 15 (fifteen) working days from the date of receipt of the request to perfect the dossier.
4. After receiving the assessment results from the Ministry of Science and Technology:
a) Within 15 (fifteen) working days, the leading unit shall explain, adopt, and perfect the dossier and send it to the Department of Science and Technology for consideration and submission to the Ministry of Information and Communications to send to the Ministry of Science and Technology for publication of the TCVN;
b) In case there is disagreement with the assessment results of the Ministry of Science and Technology, the Department of Science and Technology shall coordinate with related units to issue a letter explaining the non-unanimous opinions and submit them to the Ministry of Information and Communications to send to the Ministry of Science and Technology.
Chapter IV
IMPLEMENTATION
Article 18. Responsibilities of units
1. Department of Science and Technology
a) Guide activities related to the development of QCVN, TCVN, and basic standards under the management domain of the Ministry of Information and Communications.
b) Aggregate and submit to the Minister for approval the annual plan for developing QCVN.
c) Aggregate and draft the annual plan for developing TCVN to submit to the Ministry of Information and Communications for forwarding to the Ministry of Science and Technology.
d) Monitor, urge, and inspect agencies, organizations, and individuals in implementing the plans for developing QCVN and TCVN.
đ) Organize the review of QCVN and TCVN documentation.
e) Submit to the Minister for issuance of QCVN; submit to the Minister for proposal to the Ministry of Science and Technology for publication of TCVN.
g) Organize inspections on QCVN activities.
h) Take the lead in coordinating with relevant units to organize publicity, dissemination, and guidance on standardization and technical regulation work.
2. Functional units under the Ministry of Information and Communications within their assigned tasks and authorities shall be responsible for:
a) Being responsible for the specialized content of QCVN and TCVN in the managed fields.
b) Coordinate with the Department of Science and Technology in the development of QCVN and TCVN as stipulated in this Circular.
c) Take the lead in proposing objects for QCVN and TCVN to serve management objectives of the Ministry implemented by the unit; propose plans to amend, supplement, replace, or abolish QCVN and TCVN within the assigned responsibility.
d) Take the lead in developing QCVN and TCVN assigned according to the approved QCVN development plan and TCVN development plan; annually assess the implementation and application of QCVN and TCVN.
đ) Take the lead or coordinate with relevant units to organize publicity, dissemination, and guidance on applying QCVN within the assigned responsibility.
e) Report periodically and promptly to the Ministry of Information and Communications (Department of Science and Technology) on the results of tasks carried out according to the approved QCVN development plan and TCVN development plan.
3. Responsibilities of the leading unit in developing QCVN and TCVN
a) The leading unit assigned to develop QCVN and TCVN shall be responsible for organizing and implementing in accordance with this Circular.
b) Be responsible for the content, quality, progress, and budget usage for developing QCVN and TCVN.
4. Encourage associations, organizations, enterprises, and individuals to participate in proposing, researching, and developing QCVN and TCVN; disseminating and applying QCVN and TCVN.
Article 19. Effective Date
This Circular takes effect from January 15, 2020, and replaces Circular No. 03/2011/TT-BTTTT dated January 4, 2011, issued by the Ministry of Information and Communications on national technical regulation development and national standard development under the Ministry of Information and Communications.
Article 20. Responsibility for Implementation
1. The Director of the Office, Heads of Departments of Science and Technology, Heads of agencies and units under the Ministry of Information and Communications, Directors of Provincial Departments of Information and Communications, and related organizations and individuals are responsible for implementing this Circular.
2. During the implementation of this Circular, if there are any issues, agencies, organizations, and individuals should promptly reflect them to the Ministry of Information and Communications for consideration and resolution, amendment, and supplementation.

1. Definitions
The explanation of the draft QCVN/TCVN is a document that provides clarification to facilitate the participants in evaluating and reviewing the draft QCVN/TCVN to make accurate comments on its content, purpose, practical significance, feasibility, and based on this, the regulatory authority makes a correct decision regarding the issuance, publication, and implementation of the QCVN/TCVN.
The explanation of the draft QCVN/TCVN is a document that assists users in studying and understanding the contents of the QCVN/TCVN after it has been issued and published.
2. Main contents of the Explanation of the Draft QCVN/TCVN
2.1. Name and symbol of the QCVN/TCVNintention 2.2. Problem statement
Summarize the characteristics, situation of standardized objects both domestically and internationally, reasons and purposes for developing the QCVN/TCVN.
2.3. Basis for establishing technical requirements
- Compilation and analysis of international standards, technical documents, research results related to the standardized object.
- Selection of documents as the basis for compiling technical requirements. In cases where an international standard is fully accepted, a detailed analysis of the applicability of the international standard in Vietnam must be provided.
2.4. Explanation of the content of the QCVN/TCVN
Summarize the main contents (or groups of contents) of the QCVN/TCVN; for each main content (or group of contents), clearly explain the connection to management objectives.
2.5. Comparison table of the content of the QCVN/TCVN with reference materials
