Circular No. 13/2019/TT-BYT amends and supplements some articles of Circular No. 39/2018/TT-BYT dated November 30, 2018, issued by the Minister of Health, regulating uniform prices for medical examination and treatment services under health insurance between hospitals of the same level nationwide and guiding the application of prices and payment of costs for medical examination and treatment services under health insurance in certain cases.

AMENDING AND COMPLETING SOME ARTICLES OF CIRCULAR NO. 39/2018/TT-BYT DATED NOVEMBER 30, 2018 OF THE MINISTER OF HEALTH ON UNIFIED PRICES FOR MEDICAL SERVICES UNDER MEDICAL INSURANCE BETWEEN HOSPITALS OF THE SAME RANK ACROSS THE NATION AND GUIDELINES FOR APPLYING PRICES AND PAYING COSTS FOR MEDICAL SERVICES UNDER MEDICAL INSURANCE IN CERTAIN CASES

Pursuant to the Law on Medical Examination and Treatment No. 40/2009/QH12 dated November 23, 2009;

Pursuant to the Price Law number 11/2012/QH13 dated June 20, 2012;

Based on the Health Insurance Law No. 25/2008/QH12 dated November 14, 2008 amended and supplemented by Law No. 46/2014/QH13 dated June 13, 2014;

Pursuant to Decree No. 85/2012/NĐ-CP dated October 15, 2012 of the Government on mechanisms for operation and financial management for public health institutions and prices for medical services provided by public medical facilities; public hospital;

Pursuant to Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government stipulating the self-management mechanism of public service units;

Pursuant to Decree No. 149/2016/NĐ-CP dated November 11, 2016 of the Government amending and supplementing some articles of Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices;

Pursuant to the Government's Decree No. 75/2017/NĐ-CP dated June 20, 2017 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Resolution No. 70/2018/QH14 of the National Assembly on the state budget plan for 2019;

Based on Decree No. 38/2019/NĐ-CP dated May 9, 2019 of the Government on the basic salary for civil servants, public officials, and members of the armed forces;

Pursuant to Notification No. 226/TB-VPCP dated July 4, 2019 of the Office of the Government on the conclusions of Deputy Prime Minister Vu Dinh Hue - Head of the Steering Committee for Price Management at the Steering Committee for Price Management meeting held on July 3, 2019;;

The Minister of Health issues this Circular amending and supplementing some articles of Circular No. 39/2018/TT-BYT dated November 30, 2018 of the Minister of Health on unified prices for medical services under medical insurance between hospitals of the same rank across the nation and guidelines for applying prices and paying costs for medical services under medical insurance in certain cases (hereinafter referred to as Circular No. 39/2018/TT-BYT).

Article 1. Amending and supplementing Article 2 as follows:

1. Replacing the annexes issued together with Circular No. 39/2018/TT-BYT with the annexes issued together with this Circular:

a) The level of price for outpatient medical service as stipulated in Annex I issued together with this Circular;

b) The level of price for daily bed charge for treatment as stipulated in Annex II issued together with this Circular;

c) The level of price for technical and laboratory services as stipulated in Annex III issued together with this Circular;

2. Adjusting the notes of the following items: Item 61 on endoscopic valve replacement surgery; Item 62 on endoscopic valve replacement surgery; Item 63 on endoscopic closure of atrial septal defect and adding notes for some services at Items 64, 65, 66 of Annex IV issued together with this Circular.

Article 2. Amending Point a Clause 4 Article 3 as follows:

"a) Salary grade, position, allowances, contributions according to the regulations of the State for public institutions and the basic salary level prescribed in Decree No. 38/2019/NĐ-CP dated May 9, 2019 of the Government on the basic salary level for civil servants, public officials, and armed forces personnel;"

Article 3. Amending and supplementing Article 6 as follows:

1. Amending Point b Clause 5 as follows:

"b) In case there are beds in the Emergency Department or Intensive Care Unit used for intensive care; postoperative beds of special category surgeries that meet the requirements of intensive care beds as stipulated in the Regulations on Emergency, Intensive Care, and Poison Control issued together with Decision No. 01/2008/QĐ-BYT dated January 21, 2008 of the Minister of Health.";

2. Supplementing Clause 17 as follows:

"17. Daily bed charge for postoperative ophthalmic surgery "Phaco" shall apply the level of price for "Daily bed charge for surgical and burn patients" of type 3 corresponding to the hospital level as stipulated in Annex II issued together with this Circular."

Article 4. Implementation provisions

This Circular takes effect from August 20, 2019.

Article 5. Transitional Provisions

1. Continue to apply the list of medical techniques for examination and treatment classified as equivalent in terms of procedures and costs as prescribed in Decision No. 7435/QĐ-BYT dated December 14, 2018 of the Minister of Health on the issuance of the List of Medical Techniques for Examination and Treatment Classified as Equivalent in Terms of Procedures and Costs implemented according to Circular No. 39/2018/TT-BYT.

2. Patients who are undergoing treatment at medical facilities before the effective date of the prices prescribed in this Circular and are discharged or conclude their outpatient treatment after the effective date of the prices prescribed in this Circular shall continue to apply the prices approved by the competent authority before the effective date of the prices prescribed in this Circular until discharge or conclusion of outpatient treatment.

Article 6. Reference Provisions

In case the legal normative documents and regulations cited in this Circular are amended, supplemented, or replaced, they shall be applied according to the new legal normative documents.
