Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Law on Dikes dated November 29, 2006;

Pursuant to the Law on Natural Disaster Prevention and Control dated June 19, 2013;

Pursuant to the Law on Irrigation dated June 19, 2017;

Pursuant to the Fisheries Law dated November 21, 2017;

GENERAL PROVISIONS

Article 1. This Circular provides general regulations ensuring requirements for disaster prevention and control concerning the management, operation, and use of mineral extraction areas and other natural resource extraction areas; urban areas; tourist attractions, tourism zones; industrial zones; historical sites; rural residential areas; disaster prevention and control works, transportation, power, telecommunications and other technical infrastructure.

Article 2. This Circular provides specific regulations ensuring requirements for disaster prevention and control concerning the management, operation, and use of disaster prevention and control works under the agriculture and rural development sector, including dike works; landslide prevention and control along riverbanks and coastlines; water reservoirs and irrigation dams; flood control; drought control; saltwater intrusion control; fishing boat anchorage zones and specialized systems for monitoring, warning, tracking, and supervising disasters. This Circular applies to agencies, organizations, and individuals within the country and foreign organizations and individuals involved in activities related to ensuring requirements for disaster prevention and control in the management, operation, and use of mineral extraction areas and other natural resource extraction areas; urban areas; tourist attractions, tourism zones; industrial zones; historical sites; rural residential areas; disaster prevention and control works, transportation, power, telecommunications and other technical infrastructure in Vietnam. PART I

1. Works include: disaster prevention and control works, transportation works, power works, telecommunications works, and other technical infrastructure works.

Article 1. Scope of Regulation

2. Infrastructure projects consist of works serving the process of mineral extraction, other natural resource extraction, industrial production, tourism exploitation, historical site preservation; housing, technical infrastructure works, social infrastructure works in mineral extraction areas, other natural resource extraction areas, tourism zones, tourist attractions, historical sites, industrial zones, urban areas, and rural residential areas.

3. Landslide prevention and control works along riverbanks and coastlines are embankments protecting riverbanks and coasts, reducing wave action, promoting sedimentation, and channel rectification.

Article 2. Applicability

4. Flood control, drought control, and saltwater intrusion control works are technical infrastructure works serving flood control, drought control, and saltwater intrusion control.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

Fishing boat anchorage zones for typhoon sheltering are areas limited by land and water areas designated for anchorage, including breakwaters, sand barriers, channels, mooring piles, buoys, maritime navigation aids, communication systems, storage facilities, management offices, and other auxiliary works.

6. Specialized monitoring, warning, tracking, and supervising disaster systems are automatic and semi-automatic systems for monitoring, warning, and tracking various types of disasters and warning about potential disaster risks affecting affected objects.

Ensuring requirements for disaster prevention and control in the management, operation, and use of mineral extraction areas and other natural resource extraction areas, urban areas, tourism zones, industrial zones, historical sites; tourist attractions; rural residential areas; disaster prevention and control works, transportation, power, telecommunications and other technical infrastructure involves activities aimed at ensuring safety for people, works, and property, minimizing losses caused by disasters, not increasing disaster risks, and preventing new disasters from occurring.

4. Flood prevention works, drought prevention works, and saline intrusion prevention works are technical infrastructure projects serving to prevent flooding, droughts, and saline intrusion.

5. A fishing vessel anchorage area for typhoon shelters is a designated area limited by land and water within the anchorage zone, including breakwater structures, sediment barriers, channels, mooring piles, floating moorings, maritime buoy systems, communication facilities, storage areas, management offices, and other auxiliary structures.

6. Specialized disaster monitoring, warning, surveillance, and supervision systems are systems designed to automatically or semi-automatically monitor, supervise, and warn about various types of disasters and to alert on the risk of accidents caused by disasters affecting affected entities.

7. Ensuring disaster prevention and mitigation requirements in the management, operation, and use of mineral extraction zones and other natural resource extraction zones, urban areas, tourist sites, industrial zones, historical monuments; tourist spots; rural residential areas; disaster prevention and mitigation works, transportation, power, telecommunications, and other technical infrastructure is a set of activities aimed at ensuring safety for people, structures, and property, minimizing damage from disasters, not increasing disaster risks, and preventing new disasters from occurring.

Article 4. Principles for ensuring requirements for disaster prevention and control in the management, operation, and use of mining areas, other natural resource extraction areas, urban areas, tourism sites, industrial zones, historical relics; tourist spots; rural residential areas, and infrastructure works.

1. Organizations and individuals responsible must comply with and fully implement all contents ensuring requirements for disaster prevention and control in the management, operation, and use of infrastructure works.

2. Disaster prevention and control activities must be proactively carried out continuously, promptly, and effectively to ensure safety for people, property, infrastructure works, and components thereof, without increasing disaster risks or causing new disasters.

3. Implement synchronously and harmoniously various measures to ensure disaster prevention and control requirements according to the principle of four localities: command at the spot; forces at the spot; equipment and materials at the spot; logistics at the spot.

Chapter II

GENERAL PROVISIONS FOR ENSURING REQUIREMENTS FOR DISASTER PREVENTION AND CONTROL IN THE MANAGEMENT, OPERATION, AND USE OF MINING AREAS, OTHER NATURAL RESOURCE EXTRACTION AREAS, URBAN AREAS, TOURISM SITES, INDUSTRIAL ZONES, HISTORICAL RELICS; TOURIST SPOTS; RURAL RESIDENTIAL AREAS, AND INFRASTRUCTURE WORKS

Article 5. Contents for ensuring requirements for disaster prevention and control in the management, operation, and use of mining areas, other natural resource extraction areas, urban areas, tourism sites, industrial zones, historical relics; tourist spots; rural residential areas, and infrastructure works.

1. Establish, improve, train, and enhance the professional skills of personnel involved in disaster prevention and control work, provide sufficient tools, equipment, communication devices, protective gear meeting disaster prevention and rescue requirements.

2. Review, establish, and promulgate internal regulations and operational rules for the management, operation, and use of mining areas, other natural resource extraction areas, urban areas, tourism sites, industrial zones, historical relics; tourist spots; rural residential areas, and infrastructure works that meet disaster prevention and control requirements.

3. Review and complete national standards and technical regulations for the management, operation, and use of infrastructure works and components thereof to ensure disaster prevention and control requirements.

4. Apply advanced technology in the management, operation, and use of mining areas, other natural resource extraction areas, urban areas, tourism sites, industrial zones, historical relics; tourist spots; rural residential areas, and infrastructure works.

5. Guide, disseminate, train, and conduct drills on disaster prevention and control skills for officials, workers, employees, and communities to enhance local response capabilities and proactively implement preventive and mitigating measures against disasters.

6. Establish, review, approve according to authority or submit to competent authorities for approval and implement operational procedures for infrastructure works and components thereof to ensure safety from disasters as prescribed by law.

7. Monitor, track, and supervise meteorological, hydrological, and engineering hydrological data, and other disaster-related data within the management scope; warn of potential disaster-induced accidents for infrastructure works and components thereof and nearby areas that may increase disaster risks.

8. Construct, expand, upgrade infrastructure components; maintain and repair infrastructure works and components thereof, and control activities reinforcing and upgrading infrastructure works to ensure disaster prevention and control requirements without increasing disaster risks or causing new disasters.

9. Regularly, periodically, and urgently inspect and evaluate the current status and level of safety for disaster prevention and control of infrastructure works and components thereof:

a) Inspect, identify, and promptly prevent and handle situations and activities increasing disaster risks; accidents or potential accidents for infrastructure works and components thereof.

b) Inspect, identify, and promptly implement response measures for accidents or potential accidents caused by disasters in nearby areas that may affect mining areas and other natural resource extraction areas, urban areas, tourism sites, industrial zones, historical relics; tourist spots; rural residential areas, and infrastructure works.

c) Identify and compile critical and weak areas regarding disaster prevention and control; develop emergency protection plans for infrastructure works and components thereof before each flood season.

d) When discovering accidents or potential accidents, situations, or activities increasing disaster risks beyond handling capacity, immediately implement response measures to minimize damage while promptly reporting to competent authorities for support.

10. Provide timely and comprehensive information to officials, workers, and employees about disaster developments, critical and weak areas regarding disaster prevention and control for infrastructure works and components thereof, and nearby areas at risk of accidents affecting safety.

11. Develop and implement emergency response and recovery plans for disaster aftermaths.

a) Establish, review, and approve emergency response plans for disasters as prescribed by disaster prevention and control laws.

b) Proactively prepare forces, materials, equipment, supplies according to the "four localities" principle and organize drills consistent with approved emergency response plans.

c) Organize the implementation of emergency response plans suitable for disaster scenarios; promptly address consequences caused by disasters.

12. Record and store information and data on disasters and files on the management, operation, and use of infrastructure works and components thereof.

Article 6. Responsibilities for Ensuring Requirements for Disaster Prevention and Control

1. Responsibilities of the Sectoral Management Ministries

a) The Minister, Head of the equivalent ministry within their scope of duties, responsibilities shall develop and promulgate specific regulations to ensure requirements for disaster prevention and control as stipulated in Article 5 of this Circular.

b) Review, develop, and promulgate national standards and technical regulations for the management, operation, and use of infrastructure works and components thereof under their management scope that include contents ensuring requirements for disaster prevention and control.

c) Organize information dissemination activities to provide knowledge, skills, and measures to ensure requirements for disaster prevention and control in the management, operation, and use of mineral extraction areas, other natural resource extraction areas, cities, tourism sites, industrial zones, historical relics; tourist spots; rural residential areas and works under their management scope.

d) Organize inspections and checks on the implementation of requirements for disaster prevention and control during the management, operation, and use of infrastructure works and components thereof under their management scope.

đ) Determine the specific tasks' contents; assign responsibilities of agencies, organizations, and individuals in managing, operating, and using infrastructure works and components thereof to ensure requirements for disaster prevention and control under their management scope.

e) Report annually on key weak points and protection plans for key weak points regarding disaster prevention and control for mineral extraction areas, other natural resource extraction areas, industrial zones, tourism sites, cities, historical relics; tourist spots; rural residential areas and works under their management scope to the National Steering Committee for Disaster Prevention and Control and the Ministry of Agriculture and Rural Development before the flood season.

g) Organize handling of situations and activities increasing disaster risks; incidents, potential incidents within their management scope when required. In cases exceeding response capacity, report to the National Steering Committee for Disaster Prevention and Control and the National Committee for Search and Rescue to coordinate in directing responses.

h) Ensure financial resources for activities ensuring requirements for disaster prevention and control in the management, operation, and use of mineral extraction areas, other natural resource extraction areas, industrial zones, cities, tourism sites, historical relics, tourist spots, rural residential areas and works under their management scope.

2. Responsibilities of People's Committees at all levels

a) People's Committees at all levels, within their scope of duties and powers, shall promulgate specific regulations to ensure requirements for disaster prevention and control as stipulated in Article 5 of this Circular.

b) Organize information dissemination activities to provide knowledge, skills, and measures to ensure requirements for disaster prevention and control in the management, operation, and use of mineral extraction areas, other natural resource extraction areas, cities, tourism sites, industrial zones, historical relics; tourist spots; rural residential areas and works under their management scope on their respective territories.

c) Inspect and check the implementation of requirements for disaster prevention and control in the management, operation, and use of infrastructure works and components thereof under their management scope.

d) Determine the specific tasks' contents and assign responsibilities of agencies, organizations, and individuals in ensuring requirements for disaster prevention and control for the management, operation, and use of mineral extraction areas, other natural resource extraction areas, cities, tourism sites, industrial zones, historical relics; tourist spots; rural residential areas and works under their management scope.

đ) Organize handling of situations and activities increasing disaster risk; incidents, potential incidents and post-disaster recovery within their management scope. In cases exceeding capacity, report to higher-level People's Committees or sectoral management ministries for resolution.

e) Provincial People's Committees shall compile and report annually on key weak points and protection plans for key weak points regarding disaster prevention and control for mineral extraction areas, other natural resource extraction areas, industrial zones, tourism sites, cities, historical relics; tourist spots; rural residential areas and works under their management scope to the National Steering Committee for Disaster Prevention and Control and the Ministry of Agriculture and Rural Development before the flood season.

g) Ensure financial resources for activities ensuring requirements for disaster prevention and control in the management, operation, and use of mineral extraction areas, other natural resource extraction areas, industrial zones, tourism sites, cities, historical relics; tourist spots; rural residential areas and works under their management scope.

3. Responsibilities of State Management Agencies for Disaster Prevention and Control

a) Monitor, urge, and guide the implementation of contents ensuring requirements for disaster prevention and control within their authority.

b) Promote and disseminate contents ensuring requirements for disaster prevention and control for the management, operation, and use of mineral extraction areas and other natural resource extraction areas; urban areas; tourist spots, tourist zones; industrial zones; historical relic areas; rural residential areas and works.

c) Review, assess, and compile reports to the directly managing People's Committee or the Ministry of Agriculture and Rural Development on key weak points and protection plans for key weak points for disaster prevention and control works under their management scope.

d) Advise competent authorities or organize inspections and assessments of current conditions and safety levels for disaster prevention and control in the management, operation, and use of infrastructure works and components thereof within their authority.

đ) Provide technical advice on handling incidents, potential incidents, situations increasing disaster risks, and post-disaster recovery for infrastructure works and components thereof and adjacent areas under their management scope.

4. Responsibilities of Agencies, Organizations, and Individuals Managing, Operating, and Using

a) Adhere to and fully implement contents ensuring requirements for disaster prevention and control in the management, operation, and use of works under their management scope.

b) Establish, improve forces, assign tasks for preventing and combating natural disasters; review, establish, issue internal regulations and operational rules in managing, operating, and using mining exploitation areas, other natural resource exploitation areas, urban areas, tourism sites, industrial zones, historical relics; tourist spots; rural residential areas and facilities within the scope of management to ensure content meeting requirements for preventing and combating natural disasters.

c) Organize the establishment, approval of emergency response plans for natural disasters; approve or submit to competent authorities for approval the operation procedures and exploitation of infrastructure projects and components within the scope of management as prescribed.

d) Organize training and skill development for preventing and combating natural disasters; provide full knowledge about natural disasters, their impacts, preventive and combative measures, and responsibilities of organizations and individuals in disaster prevention and control activities within the scope of management.

đ) Handle or coordinate with others to handle situations and activities increasing natural disaster risks; accidents or potential accidents and mitigate consequences of natural disasters affecting infrastructure projects and components within the scope of management. In cases exceeding capacity, timely report to competent authorities for resolution.

e) Review and determine key and vulnerable areas for disaster prevention and control; develop protection plans for key and vulnerable areas (if any) for infrastructure projects and components within the scope of management.

e) Implement reports as prescribed or upon request from competent authorities; comply with inspections, checks, and supervision by state management agencies regarding disaster prevention and control.

g) Ensure financial resources for activities ensuring requirements for disaster prevention and control in managing, operating, and using mining exploitation areas, other natural resource exploitation areas, industrial zones, tourism sites, urban areas, historical relics; tourist spots; rural residential areas and facilities within the scope of management.

Chapter III

SPECIFIC PROVISIONS TO ENSURE REQUIREMENTS FOR DISASTER PREVENTION AND CONTROL IN MANAGING, OPERATING, AND USING DISASTER PREVENTION AND CONTROL FACILITIES IN THE AGRICULTURAL AND RURAL DEVELOPMENT SECTOR

Article 7. Ensuring Requirements for Disaster Prevention and Control in Managing Disaster Prevention and Control Facilities Against Landslides Along Riverbanks and Seashores

1. Contents Ensuring Requirements for Disaster Prevention and Control in Managing Disaster Prevention and Control Facilities Against Landslides Along Riverbanks and Seashores

a) Establish, improve, train, enhance, and conduct advanced training to increase professional capabilities for the management force of landslide prevention and control facilities along riverbanks and seashores, providing them with adequate tools, equipment, communication devices, and protective gear to meet disaster prevention and control requirements.

b) Establish and issue operational rules for managing landslide prevention and control facilities along riverbanks and seashores that meet disaster prevention and control requirements.

c) Develop and approve emergency response plans according to the Law on Natural Disaster Prevention and Control; organize drills based on approved emergency response plans; prepare sufficient personnel, materials, means of transportation, equipment, and essential supplies consistent with approved emergency response plans.

d) Install warning signs in areas where accidents have occurred or where there is a risk of accidents; implement safety measures for facilities, people, and means of transportation operating within the scope of management of landslide prevention and control facilities along riverbanks and seashores.

đ) Survey, monitor changes, current conditions, and basic parameters of facilities; changes in riverbeds, riverbanks, and seashores; water levels, currents, waves, seepage flows, and other factors affecting facilities; track natural disaster developments impacting landslide prevention and control facilities along riverbanks and seashores.

e) Maintain and repair facilities to ensure their operational capability; monitor and inspect repairs, reinforcement, and upgrades to ensure compliance with design and construction standards for landslide prevention and control facilities along riverbanks and seashores.

g) Regularly, periodically, and urgently inspect and evaluate the current status and level of safety for disaster prevention and control of landslide prevention and control facilities along riverbanks and seashores. Timely detect, prevent, and address damages, accidents, potential accidents, and activities increasing natural disaster risks. In case of accidents or potential accidents, and activities increasing natural disaster risks beyond handling capacity, immediately implement emergency response measures to minimize damage while promptly reporting to the People's Committee directly managing the area and specialized state agencies on disaster prevention and control for support.

h) Review, assess, and identify key and vulnerable points and protection plans for landslide prevention and control facilities along riverbanks and seashores.

i) Organize implementation of approved emergency response plans suitable for occurring natural disaster scenarios and promptly mitigate losses caused by natural disasters.

k) Establish and store databases on floods, typhoons, tropical depressions, strong winds over seas, tidal surges, heavy rains, earthquakes, tsunamis, land subsidence affecting facility stability, survey, design, completion, repair, reinforcement, maintenance records; periodic inspection and evaluation reports on current status; emergency response plans, and related documents.

l) Apply advanced technology in managing landslide prevention and control facilities along riverbanks and seashores.

2. Responsibilities of Agencies and Organizations Managing Landslide Prevention and Control Facilities Along Riverbanks and Seashores

a) Adhere to and fully implement all contents ensuring disaster prevention and control requirements in managing, operating, and using landslide prevention and control facilities along riverbanks and seashores as stipulated in Clause 1, Article 7 of this Circular.

b) Handle or coordinate with others to handle activities increasing natural disaster risks; accidents, potential accidents, and mitigate losses caused by natural disasters affecting landslide prevention and control facilities along riverbanks and seashores. In cases exceeding capacity, promptly report to the People's Committee and state management agencies on disaster prevention and control directly managing the area for resolution.

c) Review and assess the level of safety for disaster prevention and control, and develop emergency protection plans for critical weak points (if any) within their management scope, and report to provincial disaster prevention and control management agencies.

d) Comply with inspections, checks, and supervision by competent state management agencies regarding disaster prevention and control.

3. Responsibilities of the Department of Agriculture and Rural Development

a) Monitor, urge, and organize guidance and inspection on the implementation of regulations ensuring requirements for disaster prevention and control as stipulated in Clause 1, Article 7 of this Circular.

b) Advise the Provincial People's Committee on the allocation and delegation of responsibilities for managing and ensuring requirements for disaster prevention and control for riverbank and coastal erosion prevention works within their jurisdiction.

c) Advise on mobilizing resources and organizing handling of incidents or potential incidents, activities increasing disaster risk, and mitigating damage caused by disasters in the management of riverbank and coastal erosion prevention works within their jurisdiction.

d) Annually review, evaluate, and compile reports to the provincial People's Committee on critical weak points and emergency protection plans for riverbank and coastal erosion prevention works within their jurisdiction, 15 days before the flood season.

đ) Promote and disseminate content ensuring requirements for disaster prevention and control in the management of riverbank and coastal erosion prevention works within their jurisdiction; train and instruct staff on professional skills related to the management of such works.

e) Fulfill other state management responsibilities in the management of riverbank and coastal erosion prevention works within their jurisdiction.

4. Responsibilities of the General Department of Disaster Prevention and Control

a) Guide the implementation of content ensuring requirements for disaster prevention and control for riverbank and coastal erosion prevention works.

c) Conduct inspections and checks on the implementation of regulations ensuring requirements for disaster prevention and control in the management of riverbank and coastal erosion prevention works.

d) Fulfill other state management responsibilities regarding disaster prevention and control in the management of riverbank and coastal erosion prevention works within their authority.

5. Responsibilities of People's Committees at all levels

a) Direct agencies, organizations, and individuals to implement content ensuring requirements for disaster prevention and control; promote and educate to raise awareness about disaster prevention and control in the management of riverbank and coastal erosion prevention works within their jurisdiction.

b) Allocate and delegate state management responsibilities of state management agencies for the management of riverbank and coastal erosion prevention works within their jurisdiction.

c) Organize handling of incidents, potential incidents, situations increasing disaster risks, and mitigation of disaster consequences for riverbank and coastal erosion prevention works within their jurisdiction according to their authority. In cases exceeding capacity, report to the directly managing People's Committee or the Ministry of Agriculture and Rural Development for support.

d) The provincial People's Committee compiles and reports annually on critical weak points and emergency protection plans for riverbank and coastal erosion prevention works, sending them to the National Steering Committee for Disaster Prevention and Control and the Ministry of Agriculture and Rural Development before the flood season.

đ) Ensure financial resources for activities ensuring requirements for disaster prevention and control in the management of riverbank and coastal erosion prevention works within their jurisdiction.

e) Organize inspections and checks on regulations ensuring requirements for disaster prevention and control in the management of riverbank and coastal erosion prevention works within their jurisdiction.

Article 8. Ensuring Requirements for Flood and Storm Prevention and Control in the Management, Operation, and Use of Dyke and Flood Control Works

1. Contents ensuring requirements for flood and storm prevention and control in the management, operation, and use of dyke and flood control works

a) Monitoring the development and operation of dyke and flood control works, areas affected by the operation of such works, and natural disasters impacting the safety of dyke and flood control works: continuously monitoring rainfall, floods, typhoons, and measuring flood water levels, waves, tides affecting the safety of dyke and flood control works; conducting patrols and guarding according to warning levels prescribed by laws on dykes and flood control; surveying topography and geology of embankment sections lacking data for evaluating dyke and flood control works; periodically mapping cross-sections of rivers; measuring changes in riverbeds; measuring beach changes before embankments; monitoring deformation, displacement, seepage of embankment sections, protective revetments, and weak sluices.

b) Maintaining and repairing dyke and flood control works; supplementing, maintaining, collecting emergency materials for flood and storm prevention and managing and using such materials according to laws on dykes and flood control and guiding documents.

c) Organizing the construction, review, approval within their authority or submitting to competent authorities for approval and implementing dike protection plans and protecting critical weak points of dyke and flood control works, including contents: current status of works, anticipated scenarios, technical solutions, quantities of materials, equipment, forces for response, mobilization plans, assignment of responsibilities.

Dike protection plans and protecting critical weak points of dyke and flood control works must comply with the principle of "four at the spot," be constructed, reviewed, and adjusted according to laws on flood and storm prevention and control, dykes and flood control, and approved before May 15 each year.

d) Establishing, approving, and organizing the implementation of operational procedures for flood diversion, delayed flood release, sluices through embankments, emergency overflow structures, gates through embankments, pumping stations, and boat harbors within the protected area of dyke and flood control works as prescribed by laws. When operating flood diversion, delayed flood release, sluices through embankments, emergency overflow structures, gates through embankments, pumping stations, and boat harbors within the protected area of dyke and flood control works, information and warnings must be provided to relevant agencies, organizations, individuals, and local authorities affected by the operation process; the implementation of operational procedures must be fully recorded in logbooks and monitored.

đ) Inspecting, identifying, and handling risks and incidents causing loss of safety of dyke and flood control works: regularly inspecting and monitoring the condition of dyke and flood control works; inspecting and assessing the condition of dyke and flood control works before the annual flood season, determining critical weak points; inspecting and assessing the condition of dyke and flood control works immediately after large rainstorms, floods, typhoons, or the end of such events; inspecting, identifying, preventing, and promptly handling violations of laws on dyke and flood control.

During inspections, if incidents or high-risk situations are discovered, activities that may cause loss of safety of dyke and flood control works beyond the capacity to handle them must be proactively addressed to minimize damage, while timely reporting to the People's Committee directly managing, specialized state agencies on flood and storm prevention and control directly managing for support.

e) Dike Protection: dike protection must be conducted regularly, especially during the flood and typhoon seasons, and timely rescue operations must be carried out when dyke and flood control works suffer incidents or are at risk of incidents; ensuring the safety of dyke and flood control works during the flood and typhoon seasons according to laws on dykes and flood control and other related laws.

g) Establishing and storing databases on natural disasters and records on the management, operation, and use of dyke and flood control works as prescribed. Databases on natural disasters affecting dyke and flood control works and damages caused by natural disasters to such works must be updated regularly and by each event; records on the management, operation, and use of dyke and flood control works must be collected, established, and stored comprehensively (including: survey and design documents, completion documents for construction, repair, upgrading of dyke and flood control works; documents on inspection, maintenance, repair of dyke and flood control works; minutes, reports on the assessment of the current status of works; dike protection plans, protecting critical weak points of dyke and flood control works; operational procedures for flood diversion, delayed flood release, sluices through embankments, emergency overflow structures, gates through embankments, pumping stations, and boat harbors within the protected area of dyke and flood control works, and other documents related to the safety of dyke and flood control works).

2. Responsibilities of specialized management forces for ensuring requirements for flood and storm prevention and control for embankment lines from Class III to Special Class

a) Inspecting and monitoring the condition of dyke and flood control works; establishing and updating records on dyke and flood control works and natural disasters affecting such works.

b) Developing dike protection plans, protecting critical weak points of dyke and flood control works; plans for handling incidents of dyke and flood control works.

c) Implementing other contents related to ensuring requirements for flood and storm prevention and control for dyke and flood control works as stipulated in Clause 1 of this Article and laws on dykes and flood control.

d) For embankment lines of Class IV and V; embankment lines and flood diversion works, delay flood release works, the Provincial People's Committee shall specify the organization, management, and implementation according to point a, point b, point c, Clause 2 of this Article.

3. Responsibilities of specialized agencies advising the Department of Agriculture and Rural Development in performing state management over the field of dyke and flood control works for ensuring requirements for flood and storm prevention and control.

a) Taking the lead, coordinating with relevant agencies, directing specialized management forces for dyke and flood control works to carry out inspections and assessments of the current status of dyke and flood control works in their jurisdiction; maintaining and repairing dyke and flood control works.

b) Developing dike protection plans, protecting critical weak points of dyke and flood control works and other contents related to ensuring requirements for flood and storm prevention and control for dyke and flood control works according to assigned functions and tasks.

4. Responsibilities of the Department of Agriculture and Rural Development for ensuring requirements for flood and storm prevention and control

a) Directing specialized agencies on dyke and flood control works to coordinate with relevant agencies to organize the implementation of contents ensuring requirements for flood and storm prevention and control as stipulated in Clause 1 of this Article.

b) Guide, organize the construction, review, adjustment, supplementation, and submit for approval plans for dike protection and key vulnerable points of dike works.

c) Implement within their authority or recommend competent state agencies to promptly handle incidents, potential incidents, situations affecting the safety of dike works, and violations of laws on dike works within their management scope.

d) Aggregate and report to the provincial People's Committee key vulnerable points regarding flood and storm prevention for dike works before April 30 each year.

đ) Carry out other state management responsibilities related to ensuring requirements for flood and storm prevention in managing, operating, and using dike works.

5. Responsibilities for Ensuring Requirements for Flood and Storm Prevention of the National Center for Natural Disaster Prevention and Control

a) Monitor, urge, and guide agencies, organizations, and individuals to implement regulations concerning ensuring requirements for flood and storm prevention in managing, operating, and using works related to dike safety as stipulated in Clause 1 of this Article and laws on dike works.

b) Urge and guide localities, report to the Ministry of Agriculture and Rural Development to direct prompt handling of incidents, potential incidents, situations affecting the safety of dike works, and violations of laws on dike works.

c) Carry out other state management responsibilities related to ensuring requirements for flood and storm prevention in managing, operating, and using dike works.

6. Responsibilities of Local People's Committees at all levels

a) Provide information, communicate, educate to enhance awareness about ensuring requirements for flood and storm prevention in managing, operating, and using dike works.

b) Review and approve plans for protecting key vulnerable points of dike works and dike protection plans according to assigned tasks and powers.

c) Implement contents related to ensuring dike work safety as prescribed in Chapter III on Protection and Utilization of Dike Works, Chapter IV on Dike Protection, and Chapter VI on State Management Responsibilities for Dike Works of the Law on Dikes, and other contents stipulated in Clause 1 of this Article according to assigned responsibilities and powers.

d) The provincial People's Committee aggregates and reports annually on key vulnerable points regarding flood and storm prevention for dike works under their management to the National Steering Committee for Natural Disaster Prevention and Control and the Ministry of Agriculture and Rural Development before May 15.

đ) Organize inspections and checks on the management, operation, and use of dike works under their management.

Article 9. Ensuring Requirements for Flood and Storm Prevention in Managing, Exploiting, and Operating Water Retaining Dams, Reservoirs, Flood Mitigation, Drought Resistance, and Saltwater Intrusion Prevention Works.

1. Contents for Ensuring Requirements for Flood and Storm Prevention

a) Construct, improve, train, and enhance professional skills for personnel managing, exploiting, and operating water retaining dams, reservoirs, flood mitigation, drought resistance, and saltwater intrusion prevention works, providing them with adequate tools, equipment, communication devices, protective gear that meet flood and storm prevention requirements.

b) Develop and promulgate working regulations in managing, exploiting, and operating works and activities within the management scope of water retaining dams, reservoirs, flood mitigation, drought resistance, and saltwater intrusion prevention works that comply with flood and storm prevention requirements.

c) Develop protection plans for works in accordance with the Law on Water Resources and guiding documents implementing the Law on Water Resources.

d) Develop, review, adjust, and supplement emergency response plans for natural disasters and emergency situation response plans as required for water retaining dams and reservoirs. Organize drills based on approved plans and prepare sufficient forces, materials, means, equipment, and essential supplies.

đ) Establish and implement operational procedures for works; timely inform and warn when operating works, while implementing measures to respond to reduce human and property losses.

e) Monitor and observe the current status and development of works; perform maintenance on works; control repair and upgrade activities, construction of technical infrastructure for water resources projects according to national technical standards and specifications without increasing natural disaster risks or generating new ones.

g) Monitor and supervise natural disaster developments, warn weak areas of works and adjacent areas at risk of incidents due to natural disasters affecting work stability, and take measures to ensure safety.

h) Regularly inspect and evaluate the current status and level of safety for flood and storm prevention for water retaining dams, reservoirs, flood mitigation, drought resistance, and saltwater intrusion prevention works. Detect, prevent, and promptly address situations and natural impacts causing damage or threatening work safety, activities increasing natural disaster risks, incidents, or incident risks for water retaining dams, reservoirs, flood mitigation, drought resistance, and saltwater intrusion prevention works.

In case of discovering incidents or potential incidents, situations, or activities increasing natural disaster risks beyond handling capacity, immediate response measures must be taken to limit damage, and reports must be made immediately to competent authorities for prompt handling.

i) Review and assess post-flood discharge capacities of water reservoirs; list damaged and deteriorated works not meeting design capacity and at risk of safety loss, and funding requirements; assess, determine, and aggregate key vulnerable points for flood and storm prevention and develop plans to protect these key vulnerable points before the annual flood season for water retaining dams, reservoirs, flood mitigation, drought resistance, and saltwater intrusion prevention works.

k) Implement emergency response plans and emergency situation response plans approved in accordance with actual natural disaster scenarios and promptly mitigate consequences caused by natural disasters.

l) Establish and maintain a database on natural disasters, files on the management, operation, and use of irrigation dams and reservoirs, flood control, drought prevention, and saltwater intrusion works as prescribed.

2. Responsibilities to ensure requirements for disaster prevention and mitigation of organizations and individuals managing, operating, and utilizing

a) Adhere to and fully implement all contents ensuring requirements for disaster prevention and mitigation in the management, operation, and utilization of irrigation dams and reservoirs, flood control, drought prevention, and saltwater intrusion works as stipulated in Clause 1, Article 9 of this Circular.

b) Detect, prevent, and promptly address violations of laws on disaster prevention and mitigation. In cases exceeding their capacity, they must promptly report to local authorities, specialized state management agencies, and relevant agencies as prescribed for handling.

c) Handle or coordinate in handling incidents or potential incidents, situations increasing natural disaster risks, and mitigate damages caused by natural disasters. In cases exceeding their capacity, they must promptly report to the managers, owners of the works, People's Committees at various levels for resolution.

d) Review and assess the level of safety for disaster prevention and mitigation and develop critical protection plans for weak points (if any) within their management scope, and report to provincial specialized disaster prevention and mitigation management agencies.

đ) Comply with inspections, checks, and supervision by competent state management agencies regarding disaster prevention and mitigation.

3. Responsibilities of the Department of Agriculture and Rural Development

a) Direct local water resources management agencies to cooperate with related agencies in organizing the implementation of contents ensuring requirements for disaster prevention and mitigation as stipulated in Clause 1, Article 9 of this Circular and other relevant regulations.

b) Organize training, propaganda, and dissemination of contents ensuring requirements for disaster prevention and mitigation concerning the management, operation, and utilization of irrigation dams and reservoirs, flood control, drought prevention, and saltwater intrusion works within their jurisdiction; train, instruct, and conduct drills on disaster prevention and mitigation skills for agencies and organizations managing, operating, and utilizing such works within their management scope.

c) Guide and organize the construction, review, adjustment, supplementation, and submission for approval of protection plans and emergency response plans for works.

d) Advise and guide the implementation of maintenance for works; handle incidents or potential incidents, violations of laws on disaster prevention and mitigation; mitigate damages caused by natural disasters for irrigation dams and reservoirs, flood control, drought prevention, and saltwater intrusion works within their management scope.

đ) Review, assess, and compile reports to the provincial People's Committee on critical weak points and protection plans for critical weak points for irrigation dams and reservoirs, flood control, drought prevention, and saltwater intrusion works fifteen days before the flood season.

e) Advise the provincial People's Committee on the allocation and delegation of responsibilities for the management of irrigation dams and reservoirs, flood control, drought prevention, and saltwater intrusion works within their jurisdiction.

g) Fulfill other state management responsibilities regarding disaster prevention and mitigation within their management scope.

4. Responsibilities of the General Department of Water Resources

a) Monitor, urge, and guide the implementation of regulations ensuring requirements for disaster prevention and mitigation concerning the management, operation, and utilization of irrigation dams and reservoirs, flood control, drought prevention, and saltwater intrusion works.

b) Fulfill the responsibilities of the manager of water resources works managed by the Ministry of Agriculture and Rural Development as prescribed in the Law on Water Resources and guiding documents implementing the Law on Water Resources.

c) Submit to the Ministry of Agriculture and Rural Development plans for protecting water resources works; measures to ensure safety and handle incidents in water resources works under its management.

d) Compile and report annually on the current status of safety inspections of irrigation dams and reservoirs before the flood season.

đ) Fulfill other state management responsibilities to ensure requirements for disaster prevention and mitigation concerning the management, operation, and utilization of irrigation dams and reservoirs, flood control, drought prevention, and saltwater intrusion works.

5. Responsibilities of People's Committees at all levels

a) Propagate and educate to enhance awareness about disaster prevention and mitigation concerning the management, operation, and utilization of irrigation dams and reservoirs, flood control, drought prevention, and saltwater intrusion works.

b) Allocate and delegate state management responsibilities of state management agencies concerning the management, operation, and utilization of irrigation dams and reservoirs, flood control, drought prevention, and saltwater intrusion works within their management scope.

c) Ensure funding for work maintenance; promptly address incidents or potential incidents, mitigate natural disaster damages, and violations of laws on disaster prevention and mitigation within their management scope. In cases exceeding their capacity, report to higher-level People's Committees, the National Steering Committee for Disaster Prevention and Control, and the Ministry of Agriculture and Rural Development for resolution.

d) Provincial People's Committees compile and report periodically annually on critical weak points and protection plans for critical weak points for irrigation dams and reservoirs, flood control, drought prevention, and saltwater intrusion works within their management scope, submit to the National Steering Committee for Disaster Prevention and Control and the Ministry of Agriculture and Rural Development before the flood season.

đ) Organize inspections and checks on regulations ensuring requirements for disaster prevention and mitigation concerning the management, operation, and utilization of irrigation dams and reservoirs, flood control, drought prevention, and saltwater intrusion works within their management scope.

Article 10. Ensuring Requirements for Disaster Prevention and Mitigation in the Management, Operation, and Use of Fishing Vessel Shelter Areas

1. Contents ensuring requirements for disaster prevention and mitigation in the management, operation, and use of fishing vessel shelter areas

a) Building, improving, training, and enhancing professional capacity, providing sufficient tools, equipment, communication information, and protective gear to meet disaster prevention and mitigation requirements for personnel managing, operating, and using fishing vessel shelter areas.

b) Issuing and publicly announcing regulations on managing fishing vessel shelter areas. Announcing lists of fishing vessel shelter areas according to the Fisheries Law.

c) Developing, reviewing, adjusting, and supplementing emergency response plans for disasters and search and rescue operations, and plans for arranging fishing vessels to anchor. Organizing drills based on approved plans and preparing adequate forces, materials, means, equipment, and supplies.

d) Monitoring, tracking, informing, and promptly warning about disasters; hoisting storm and tropical depression signals when disasters occur as prescribed; notifying channels, buoys, navigation aids, and safety conditions at fishing vessel shelter areas; and reporting the status of fishing vessels anchored at these areas.

đ) Monitoring the current status of shelter areas; implementing maintenance, upkeep, and controlling repair and upgrade activities of fishing vessel shelter areas according to national technical standards for works without increasing disaster risks or causing new disasters.

e) Regularly, periodically, and urgently inspecting and evaluating the current status and level of safety for disaster prevention and mitigation in fishing vessel shelter areas. Identifying, preventing, and promptly handling violations of laws on disaster prevention and mitigation, activities that increase disaster risks, incidents, or potential incidents in fishing vessel shelter areas.

In case of discovering incidents or potential incidents, situations, or activities increasing natural disaster risks beyond handling capacity, immediate response measures must be taken to limit damage, and reports must be made immediately to competent authorities for prompt handling.

g) Reviewing, assessing, identifying, and compiling critical weak points regarding disaster prevention and mitigation in fishing vessel shelter areas and formulating protection plans for these critical weak points.

h) Organizing guidance and arranging fishing vessels to anchor in designated locations; ensuring safety measures for people and means; checking and supervising people remaining on vessels during disasters; complying with orders from competent authorities in emergencies.

i) Establishing and storing databases on disasters and records on the management, operation, and use of fishing vessel shelter areas as prescribed.

2. Responsibilities of Organizations and Individuals Managing, Operating, and Using Fishing Vessel Shelter Areas

a) Adhering to and fully implementing all contents ensuring disaster prevention and mitigation requirements in the management, operation, and use of fishing vessel shelter areas as stipulated in Clause 1, Article 10 of this Circular.

b) Maintaining logs on operational situations, technical conditions, and equipment of fishing vessel shelter areas.

c) Promptly detecting, preventing, and handling incidents or potential incidents; situations that increase disaster risks, violations of laws on disaster prevention and mitigation, and mitigating disaster consequences. In cases exceeding capabilities, timely reporting to the directly managing People's Committee and relevant agencies for support.

đ) Counting the number of fishing vessels anchoring before storms or tropical depressions landfall; enforcing orders or compulsory measures to ensure safety and organize safe evacuation when emergencies arise.

e) Complying with inspections, checks, and supervision by state management agencies responsible for disaster prevention and mitigation.

3. Responsibilities of the Department of Agriculture and Rural Development

a) Organizing training, propaganda, and dissemination of contents ensuring disaster prevention and mitigation requirements in the management, operation, and use of fishing vessel shelter areas within their jurisdiction; training and conducting drills on disaster prevention and mitigation skills for management, operation, and use organizations under their jurisdiction.

b) Guiding the development, review, adjustment, supplementation, and submission for approval of emergency response plans for disasters and search and rescue operations, and plans for arranging fishing vessels to anchor within their jurisdiction.

c) Advising and guiding the implementation of maintenance and upkeep of fishing vessel shelter areas; handling incidents or potential incidents, violations of laws on disaster prevention and mitigation; mitigating losses caused by disasters to fishing vessel shelter areas within their jurisdiction.

d) Reviewing, assessing, compiling, and reporting to the provincial People's Committee or the Ministry of Agriculture and Rural Development on critical weak points and protection plans for fishing vessel shelter areas 15 days before the flood season.

đ) Advising the provincial People's Committee on assigning and delegating responsibilities for state management of fishing vessel shelter areas within their jurisdiction.

e) Implementing other state management responsibilities to ensure disaster prevention and mitigation requirements in the management, operation, and use of fishing vessel shelter areas within their jurisdiction.

4. Responsibilities of the Fisheries General Department

a) Supervising, urging, and guiding the implementation of regulations ensuring disaster prevention and mitigation requirements in the management, operation, and use of fishing vessel shelter areas as stipulated in Clause 1 of this Article and fisheries laws.

b) Organizing specialized training on managing fishing vessel shelter areas as prescribed by law.

c) Compiling and reporting results of inspections on the current safety status for disaster prevention and mitigation in fishing vessel shelter areas.

d) Implementing other state management responsibilities to ensure disaster prevention and mitigation requirements in the management, operation, and use of fishing vessel shelter areas within their jurisdiction.

5. Responsibilities of People's Committees at all levels

a) Propaganda and education to raise awareness about disaster prevention and mitigation in the management, operation, and use of fishing vessel shelter areas within their jurisdiction.

b) Assign responsibilities for state management agencies regarding the management, operation, and use of anchorage areas for fishing vessels to avoid typhoons.

c) Ensure funding for maintenance and repair of facilities; promptly address incidents or potential incidents, and violations of laws on disaster prevention and mitigation within the scope of management; report to competent authorities if the situation exceeds capacity for support.

d) The provincial People's Committee shall compile and report annually on key weak points and emergency response plans for anchorage areas for fishing vessels under their jurisdiction to the National Steering Committee for Disaster Prevention and Control and the Ministry of Agriculture and Rural Development before the flood season.

đ) Organize inspections, checks, and handling of violations of laws concerning requirements for disaster prevention and mitigation for anchorage areas for fishing vessels under their jurisdiction.

Article 11. Ensuring Requirements for Disaster Prevention and Mitigation in Managing, Operating, and Using Specialized Monitoring, Warning, Surveillance, and Tracking Systems.

1. Contents ensuring requirements for disaster prevention and mitigation in managing specialized monitoring, warning, surveillance, and tracking systems.

a) Establish, improve, train, and enhance the professional skills of personnel responsible for managing, operating, and using specialized monitoring, warning, surveillance, and tracking systems; provide them with adequate tools, equipment, communication devices, and protective gear to meet disaster prevention and mitigation requirements.

b) Develop and promulgate regulations on the management and use, and operational procedures for specialized monitoring, warning, surveillance, and tracking systems.

c) Review and perfect national standards and technical regulations in managing, operating, and using specialized monitoring, warning, surveillance, and tracking systems to ensure disaster prevention and mitigation requirements.

d) Develop, adjust, and approve emergency response plans according to the Law on Disaster Prevention and Control; organize drills based on these plans; prepare sufficient forces, materials, means, equipment, and supplies appropriate to the approved emergency response plans.

đ) Measure and monitor the current status and basic parameters of specialized monitoring, warning, surveillance, and tracking systems; inspect, detect, and handle malfunctions and interruptions in information provision; implement measures to maintain system operations.

e) Maintain and repair the system to ensure its operational capability; supervise and inspect repairs and upgrades to meet design and construction standards for specialized monitoring, warning, surveillance, and tracking systems.

g) Regularly and periodically inspect and evaluate the current status and safety level of specialized monitoring, warning, surveillance, and tracking systems; promptly identify, prevent, and handle malfunctions and potential incidents; report to the directly managing People's Committee and relevant disaster control authorities if incidents exceed capacity.

h) Annually review, assess, determine key weak points, and develop protection plans for specialized monitoring, warning, surveillance, and tracking systems.

i) Organize implementation of approved emergency response plans suitable for occurring natural disaster scenarios and promptly mitigate losses caused by natural disasters.

k) Establish and retain records of surveys, designs, completion reports for construction, repairs, maintenance; regular inspection and evaluation reports on the current status; emergency response plans, and other related documents.

l) Apply advanced technology in managing specialized monitoring, warning, surveillance, and tracking systems.

2. Responsibilities of agencies and organizations managing specialized monitoring, warning, surveillance, and tracking systems.

a) Adhere to and fully implement all contents ensuring disaster prevention and mitigation requirements in managing, operating, and using specialized monitoring, warning, surveillance, and tracking systems as stipulated in Clause 1, Article 11 of this Circular.

b) Address or coordinate in addressing activities that increase disaster risks; incidents, potential incidents, and damages caused by disasters to specialized monitoring, warning, surveillance, and tracking systems; report to the People's Committee and relevant disaster control authorities if the situation exceeds capacity.

c) Review and assess the safety level for disaster prevention and mitigation and develop protection plans for specialized monitoring, warning, surveillance, and tracking systems; report to authorized bodies as prescribed.

d) Comply with inspections, checks, and supervision by competent state management agencies regarding disaster prevention and control.

3. Responsibilities of the Department of Agriculture and Rural Development

a) Advise the provincial People's Committee to assign the People's Committees at district and commune levels to protect monitoring, warning, surveillance, and tracking stations installed within the province.

b) Coordinate in implementing operations, inspections, maintenance, repairs, and upgrades of specialized monitoring, warning, surveillance, and tracking systems.

c) Timely operate the system within delegated authority to warn the public about disasters.

d) Annually review, assess, compile, and report to the provincial People's Committee on key weak points and protection plans for specialized monitoring, warning, surveillance, and tracking systems under their jurisdiction 15 days before the flood season.

đ) Promote and disseminate contents ensuring disaster prevention and mitigation requirements in managing and operating specialized monitoring, warning, surveillance, and tracking systems within their jurisdiction; train and instruct personnel on professional skills for managing such systems.

e) Fulfill other state management responsibilities in managing and operating specialized monitoring, warning, surveillance, and tracking systems.

4. Responsibilities of the General Department of Disaster Prevention and Control

a) Monitor, urge, and guide the implementation of contents ensuring disaster prevention and mitigation requirements for specialized monitoring, warning, surveillance, and tracking stations.

b) Inspect and supervise the implementation of regulations ensuring requirements for natural disaster prevention and control in managing dedicated early warning, monitoring, and surveillance stations.

c) Submit to the Ministry of Agriculture and Rural Development proposals on measures to respond to natural disasters and protect dedicated early warning, monitoring, and surveillance stations under its management.

d) Advise the Ministry of Agriculture and Rural Development on allocating funds for managing, operating, and maintaining the system, including inspection, maintenance, repair, replacement of equipment, and ensuring the continuous operation of dedicated early warning, monitoring, and surveillance stations assigned for management.

đ) Carry out other state management responsibilities regarding natural disaster prevention and control in managing and operating dedicated early warning, monitoring, and surveillance stations within their jurisdiction.

5. Responsibilities of People's Committees at all levels

a) Direct agencies, organizations, and individuals to implement content ensuring requirements for natural disaster prevention and control; promote education to raise awareness about natural disaster prevention and control in managing and operating dedicated early warning, monitoring, and surveillance stations within their jurisdiction.

b) Assign and delegate state management responsibilities among state management agencies at various levels for managing dedicated early warning, monitoring, and surveillance stations within their scope of management.

c) Ensure funding for maintenance and repair of facilities; promptly address incidents or potential incidents, violations of laws on natural disaster prevention and control, and mitigate consequences of natural disasters within their jurisdiction. In cases exceeding capacity, report to competent state management authorities for support.

d) The People's Committee of the province shall compile and report annually on the status and protection plans for dedicated early warning, monitoring, and surveillance stations before the flood season, to be submitted to the National Steering Committee for Natural Disaster Prevention and Control and the Ministry of Agriculture and Rural Development.

đ) Ensure financial resources for activities ensuring requirements for natural disaster prevention and control in managing and operating dedicated early warning, monitoring, and surveillance stations within their jurisdiction.

e) Organize inspections and supervision of regulations ensuring requirements for natural disaster prevention and control in managing and operating dedicated early warning, monitoring, and surveillance stations within their jurisdiction.

Chapter IV

IMPLEMENTING PROVISIONS

Article 12. Effective Date

1. This Circular takes effect from December 10, 2021.

2. During implementation, any arising issues should be promptly reported in writing to the Ministry of Agriculture and Rural Development for research, consideration, and resolution./.
