Circular No. 13/2021/TT-BVHTTDL amends and supplements some articles of Circular No. 06/2017/TT-BVHTTDL dated December 15, 2017, issued by the Minister of Culture, Sports and Tourism detailing certain provisions of the Tourism Law.

AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 06/2017/TT-BVHTTDL DATED DECEMBER 15, 2017 ISSUED BY THE MINISTER OF CULTURE, SPORTS AND TOURISM REGULATING DETAIL OF CERTAIN PROVISIONS OF THE TOURISM LAW

Pursuant to the Tourism Law dated June 19, 2017;

Pursuant to Decree No. 79/2017/NĐ-CP dated July 17, 2017, of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Legal Department and the General Director of the Tourism Administration;

The Minister of Culture, Sports and Tourism issues this Circular amending and supplementing certain articles of Circular No. 06/2017/TT-BVHTTDL dated December 15, 2017 issued by the Minister of Culture, Sports and Tourism regulating detail of certain provisions of the Tourism Law.

Article 1. Amending and supplementing certain articles of Circular No. 06/2017/TT-BVHTTDL dated December 15, 2017 issued by the Minister of Culture, Sports and Tourism regulating detail of certain provisions of the Tourism Law

1. Amending and supplementing Point a Clause 3 Article 6 as follows:

"a) Within thirty days from the date of publishing the decision to revoke the travel agency business license on the electronic portal of the licensing authority and the website for managing travel service businesses, if there are no complaints or reports related to the obligations towards tourists and tourism service providers, the licensing authority shall issue a letter to the bank allowing the enterprise to withdraw the deposit; if there are complaints or reports related to the obligations of the enterprise towards tourists and tourism service providers, the licensing authority shall cooperate with relevant competent authorities to resolve them according to the law;"

2. Amend and supplement Clause 1, Article 7 as follows:

"1. Within five working days from the date of receiving the inspection and audit conclusion of the competent authority, the licensing authority shall issue a decision to revoke the travel agency business license; the revocation decision shall be sent to the enterprise, the competent authority responsible for inspection and audit, the state agency responsible for immigration, the tax authority, the registration authority of the province where the enterprise's headquarters is located, and published on the electronic portal of the licensing authority and the website for managing travel service businesses."

Article 2. Responsibility for Implementation

1. The General Department of Tourism shall take the lead and coordinate with the Legal Department and relevant agencies and units to guide the implementation of this Circular.

2. Heads of agencies and units under the Ministry, Directors of Departments of Culture, Sports and Tourism, Tourism Departments, and related individuals are responsible for organizing the implementation of this Circular.

During the implementation process, if any difficulties arise, agencies, units, and individuals are requested to promptly report to the Ministry of Culture, Sports and Tourism for research and appropriate amendments and supplements.

Article 3. Implementation Provisions

1. This Circular takes effect from the date of issuance.

2. Agencies, units, and travel service businesses currently processing refund procedures according to Articles 6 and 7 of Circular No. 06/2017/TT-BVHTTDL shall continue to resolve them within the time limit stipulated in this Circular.
