Guidelines for determining the structure of civil service grades

Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 62/2020/NĐ-CP dated June 1, 2020, of the Government, on positions and staffing of civil servants;

At the request of the Director of the Civil Servant and Public Official Department;

The Minister of Home Affairs issues this Circular guiding the determination of the structure of civil service grades.

Article 1. Scope of Regulation and Applicability

This Circular guides the determination of the structure of civil service grades in administrative agencies and organizations under ministries, ministerial-level agencies, government agencies; organizations established by the Government and the Prime Minister that are not public service units; People's Councils and People's Committees of provinces and centrally governed cities (hereinafter referred to collectively as ministries, sectors, and localities).

1. The determination of the structure of civil service grades for each administrative agency and organization of ministries, sectors, and localities shall be based on:

a) The list of positions for specialized civil servants and common civil servant positions in specialized fields guided by the Ministry of Home Affairs and sector-managing ministries according to the provisions of Government Decree No. 62/2020/NĐ-CP dated June 1, 2020 on job positions and civil servant quotas;

b) The complexity level of work and the number of civil servant quotas to be arranged for each position within the agency or organization, as approved by the competent authority;

c) The criteria for specialized civil service grade positions corresponding to job positions.

Article 3. Procedure for Determining the Structure of Civil Service Grades

2. The head of the agency managing civil servants shall approve the structure of civil service grades suitable for the complexity level of work according to job positions, nature, characteristics, and scale of operation of the agency using civil servants.

3. The personnel and cadre affairs department of the agency, organization, or unit shall have the responsibility to advise and assist the head in determining the number of civil service grades and the structure of civil service grades of the agency, organization, or unit to submit to the competent authority for consideration and decision.

1. Ministries, ministerial-level agencies, government agencies, organizations established by the Government and the Prime Minister that are not public service units, and People's Committees of provinces and centrally governed cities shall base on the provisions of this Circular to implement the determination of the structure of civil service grades for each administrative agency and organization within their jurisdiction, serving as the basis for implementing grade transfers, promotions, and implementing policies for civil servants.

2. Ministries, sectors, and localities shall aggregate and report the results of determining the structure of civil service grades for each administrative agency and organization within their jurisdiction according to Appendix No. 01 and Appendix No. 02 issued together with this Circular and the approved job position plan to the Ministry of Home Affairs for management in accordance with the law.

3. In cases where there is a change in the structure of civil service grades of an agency or organization, ministries, sectors, and localities shall promptly report to the Ministry of Home Affairs for consensus before implementation.

Article 5. Effective Date

1. This Circular takes effect from February 15, 2023.

2. Ministers, heads of ministerial-level agencies, heads of government agencies, heads of organizations established by the Government and the Prime Minister that are not public service units, Chairmen of People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Circular./.
