Circular No. 13/2024/TT-BNV amends and supplements certain provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014 on confirming the unit nameplate of volunteer youth units that have been established and operated during various periods for volunteer youth units whose unit nameplates have not yet been confirmed.

CIRCULAR
Amending and supplementing certain Articles of Circular No. 18/2014/TT-BNV dated November 25, 2014 of the Minister of Home Affairs on the confirmation of the unit nameplate of volunteer youth units that have been established and operated during various periods for units not yet confirmed with a unit nameplate.

Pursuant to the Youth Law dated June 16, 2020;

Based on Decree No. 112/2017/NĐ-CP dated October 6, 2017, issued by the Government on the system of policies and benefits for Volunteer Youth Force units in the South participating in the resistance war from 1965 to 1975;

Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

At the proposal of the Director of the Department of Youth Work;

The Minister of Home Affairs issues this Circular amending and supplementing certain Articles of Circular No. 18/2014/TT-BNV dated November 25, 2014 of the Minister of Home Affairs on the confirmation of the unit nameplate of volunteer youth units that have been established and operated during various periods for units not yet confirmed with a unit nameplate.

Article 1. Amending and supplementing certain Articles of Circular No. 18/2014/TT-BNV dated November 25, 2014 of the Minister of Home Affairs on the confirmation of the unit nameplate of volunteer youth units that have been established and operated during various periods for units not yet confirmed with a unit nameplate.

"b) DEPARTMENTS AND EQUIVALENTS; COMMUNE, WARD, TOWN POLICE AND EQUIVALENTS; POLICE STATIONS AND EQUIVALENTS HAVE THE RESPONSIBILITY TO ASSIGN STAFF TO PERFORM STATE SECRECY PROTECTION TASKS AT PLANNING AND ADMINISTRATIVE OR COMBINED UNITS."

"c) Administrative Committee of district, inter-district, autonomous region; provincial-level administrative committee, county-level administrative committee."

2. Amending and supplementing Point c Clause 2 Article 5 as follows:

"c) Administrative Committee of district, inter-district, autonomous region; provincial-level administrative committee, county-level administrative committee."

3. Amending and supplementing Point c, Point d Clause 2 Article 6 as follows:

"c) Administrative Committee of district, inter-district, autonomous region; provincial-level administrative committee, county-level administrative committee;"

d) Youth League of People's Revolutionary Government of South Vietnam or revolutionary government authorities at district, provincial, county, and commune levels in the South."

4. Amending and supplementing certain Clauses and Points of Article 7 as follows:

a) Amend and supplement Clause 1 as follows:

"1. Resolution on establishment

Based on Directive No. 460-TTg dated September 23, 1978 of the Prime Minister on organizing volunteer youth forces to build the economy in southern provinces and cities or Decision No. 216-HĐBT dated November 13, 1987 of the Council of Ministers on organizing volunteer youth forces under current circumstances or Directive No. 259-CT dated July 12, 1990 of the Chairman of the Council of Ministers on organizing volunteer youth forces to engage in economic activities or Decision No. 770-TTg dated December 20, 1994 of the Prime Minister on organization and policies for volunteer youth or documents issued by competent authorities mobilizing participation in national defense wars, international missions in Cambodia, and assistance to Laos after April 30, 1975 or resolutions of provincial party committees, documents mobilizing volunteer youth to participate in post-war reconstruction and economic development issued by provincial people's committees, or documents of the Communist Youth Union of Ho Chi Minh at the provincial level."

b) Amending and supplementing Point d Clause 2 as follows:

"d) Provincial-level Youth League."

c) Amending and supplementing Point a Clause 3 as follows:

"a) Force, division, brigade, battalion, general team, team, joint team, company, platoon, squad of volunteer youth;"

d) Amending and supplementing Clause 6 as follows:

"6. Living conditions and equipment of volunteer youth members during duty shall be guaranteed by the competent authority mobilizing them (without salary). Cadres managing and volunteer youth members of economic units shall enjoy salaries and other allowances as prescribed by law."

5. Amending and supplementing Point b Clause 1 Article 8 as follows:

"b) Provincial People's Committee confirms the unit nameplate of volunteer youth units for those units established or directly managed and utilized by provincial, county, or commune levels."

6. Amending and supplementing Clause 1 Article 9 as follows:

"1. Application of the unit liaison board according to Model No. 01 or application of individuals directly participating in duties at the unit according to Model No. 02 or relevant documents from related agencies, units, organizations according to Model No. 03 requesting confirmation of the unit nameplate of volunteer youth units."

7. Amending and supplementing certain Clauses of Article 10 as follows:

a) Amend and supplement Clause 1 as follows:

"1. The unit liaison board or individuals directly participating in duties at the unit or related agencies, units, organizations requesting confirmation of the unit nameplate of volunteer youth units shall submit one set of documents according to Clause 9 of this Circular either in person or through postal service to the Vietnam Association of Former Volunteer Youth."

b) Amend and supplement Clause 3 as follows:

"3. Within a maximum period of 45 working days from the date of receiving complete valid documents according to Clause 9 of this Circular, the personnel organization advisory body of the competent authority stipulated in Article 8 of this Circular shall be responsible for reviewing the documents and submitting them to the competent authority for examination and decision-making on confirming the unit nameplate of volunteer youth units if the unit meets the requirements, or responding in writing if the unit does not meet the requirements."

8. Amending and supplementing Article 11 as follows:

"Article 11. Procedures and formalities for confirming the unit nameplate of volunteer youth units established, managed, and utilized by provincial, county, or commune levels

1. The unit liaison board or individuals directly participating in duties at the unit or related agencies, units, organizations requesting confirmation of the unit nameplate of volunteer youth units shall submit one set of documents according to Clause 9 of this Circular either in person or through postal service to the Provincial Association of Former Volunteer Youth or the Provincial Liaison Board of Former Volunteer Youth.

2. The Provincial Association of Former Volunteer Youth or the Provincial Liaison Board of Former Volunteer Youth shall be responsible for receiving, guiding, and completing the documents and sending a letter to the Department of Home Affairs for examination and submission to the Provincial People's Committee for decision-making on confirming the unit nameplate of volunteer youth units.

3. Within a maximum period of 45 working days from the date of receiving complete valid documents according to Clause 9 of this Circular, the Department of Home Affairs shall be responsible for reviewing the documents and submitting them to the Provincial People's Committee for examination and decision-making on confirming the unit nameplate of volunteer youth units if the unit meets the requirements, or responding in writing if the unit does not meet the requirements."

9. Supplementing Article 12a after Article 12 as follows:

"Article 12a. Budget for implementing the work of confirming the unit nameplate."

The expenses for verifying the confirmation file of the designation; the expenses for organizing meetings to review and confirm the designation (if any) shall be implemented in accordance with Circular No. 40/2017/TT-BTC dated April 28, 2017, issued by the Minister of Finance, stipulating the travel expense regulations and conference expenditure regulations; in cases where the travel expense regulations and conference expenditure regulations are amended, supplemented, or replaced, they shall be implemented according to the provisions of the new amended, supplemented, or replaced documents.

10. Repeal the phrase "management officials" as prescribed in Clause 6, Article 4, Clause 6, Article 5, and Clause 6, Article 6.

Article 2. Effective Date

1. This Circular takes effect from February 1, 2025.

2. In case of any difficulties during implementation, it is requested that agencies, organizations, and individuals report to the Ministry of Home Affairs for study and resolution.
