Regulations on Code Numbers and Qualification Standards for Judicial Records Professional Titles

Pursuant to the Law on Public Servants dated November 15, 2010; the Law Amending and Supplementing Certain Provisions of the Law on Cadres and Civil Servants and the Law on Public Servants dated November 25, 2019; Pursuant to Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government stipulating recruitment, utilization, and management of public servants;
Pursuant to Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government amending and supplementing certain provisions of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government stipulating recruitment, utilization, and management of public servants; Pursuant to Decree No. of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Article 2. Code Numbers for Judicial Records Professional TitlesNo.1. Grade I Judicial Records Officer - Code Number: V.01.01.01. of professional titles 2. Grade II Judicial Records Officer - Code Number: V.01.01.02.
Article 1. Scope of Regulation and Applicability
3. Grade III Judicial Records Officer - Code Number: V.01.01.03.
1. Possess a sense of responsibility, honesty, objectivity, dedication to work; comply with the regulations and internal rules of the agency or unit.
2. Adhere to the provisions regarding authority, procedures, and formalities in carrying out tasks related to building, managing, protecting, exploiting the Judicial Records Database, and issuing Judicial Records Certificates.
3. Strictly implement regulations ensuring information security and privacy protection, respecting the private life of individuals, facilitating agencies, organizations, and individuals requesting Judicial Records Certificates in accordance with the law and the regulations of the agency or organization.
4. Proactively propose solutions and innovations in judicial records work.
5. Other qualifications according to the regulations of the Minister of Justice on ethical standards for judicial records professionals.
Article 3. General standards for professional ethics
Article 4. General Qualifications in Education and Training
1. Graduated from a university or higher in Law.
2. Hold a certificate in training for judicial records professional titles according to the program of the Ministry of Justice.
Article 5. Tasks and Qualifications in Professional Competence for Grade I Judicial Records Officers
a) Lead or be primarily responsible for building, managing, using, and exploiting the Judicial Records Database, issuing Judicial Records Certificates; inspect and supervise the performance of Grade II and Grade III Judicial Records Officers as assigned by competent authorities;
b) Lead or be primarily responsible for providing professional guidance on judicial records, developing materials and content for professional guidance for Grade II and Grade III Judicial Records Officers;
c) Lead in drafting and implementing programs, plans, projects, documents, regulations, technical procedures on judicial records;
d) Lead in compiling, developing materials, organizing training and professional development in the field of judicial records;
đ) Lead research on scientific and technological tasks from grassroots levels upwards;
1. Tasks
e) Participate in drafting and preparing projects, normative legal documents as assigned by competent authorities;
g) Lead or be primarily responsible for resolving complaints from organizations and individuals regarding judicial records;
h) Other tasks as prescribed by law or as assigned by competent authorities.
a) Master and strictly adhere to the Party's guidelines, policies, and state laws concerning judicial records work;
b) Have knowledge, skills, and abilities to perform the tasks specified in Clause 1 of this Article;
c) Have organizational capabilities to develop and implement the tasks specified in Clause 1 of this Article;
d) Have writing skills, analytical, and evaluation capabilities to perform the tasks specified in points b, c, and d of Clause 1 of this Article;
đ) Have coordination capabilities with relevant agencies, organizations, and individuals in performing the tasks specified in Clause 1 of this Article.
Clause 2. Professional Competence Standards
a) Master and implement correctly the Party's guidelines, policies, and the State's laws on judicial record work;
b) Possess knowledge, expertise, and skills to perform the tasks specified in Clause 1 of this Article;
c) Have organizational capacity, build content, and carry out the tasks specified in Clause 1 of this Article;
d) Have the ability and skills to draft documents, analyze, and evaluate to perform the tasks specified in points b, c, and d of Clause 1 of this Article;
đ) Have the ability to coordinate with relevant agencies, organizations, and individuals in performing the tasks specified in Clause 1 of this Article.
Article 6. Tasks and professional competence standards for Judicial Record Officers of Class II
1. Tasks
a) Inspect and supervise the results of tasks related to building, managing, using, and exploiting the Judicial Record Database of Judicial Record Officers of Class III according to the division of responsibilities by the competent authority; propose corrections, cancellations of erroneous data and information, and propose issuance or refusal of Judicial Record Certificates;
b) Provide professional guidance on judicial records to Judicial Record Officers of Class III and individuals, agencies, organizations according to the division of responsibilities by the competent authority;
c) Advise, propose, build, and organize the implementation of programs, plans, projects, documents, regulations, procedures, technical processes related to judicial records according to the division of responsibilities by the competent authority;
d) Participate in compiling, building training programs, materials, organizing training sessions, and enhancing professional skills in judicial records;
đ) Participate in researching scientific and technological tasks from grassroots levels upwards;
c) Have organizational capabilities to develop and implement the tasks specified in Clause 1 of this Article;
g) Participate in resolving complaints from organizations and individuals in the field of judicial records;
h) Perform other tasks assigned.
Clause 2. Professional Competence Standards
a) Master and implement correctly the Party's guidelines, policies, and state laws in judicial record work;
b) Possess the ability and skills to advise, propose, draft documents, organize, coordinate, and resolve tasks to fulfill the duties stipulated in Clause 1 of this Article;
c) Possess the ability to provide professional guidance to fulfill the duties stipulated in Clause 1 of this Article;
d) Possess the ability to coordinate with relevant agencies and organizations when performing the duties stipulated in Clause 1 of this Article.
Article 7. Tasks and professional competence standards for Judicial Record Officers of Class III
1. Tasks
a) Receive, inspect, classify, process, provide, review information to build the judicial record database; search and exploit information in the database to issue Judicial Record Certificates; establish and store paper-based judicial record files;
b) Receive and process applications for Judicial Record Certificates;
c) Participate in providing vocational guidance on judicial records to individuals, agencies, organizations according to the division of responsibilities by the competent authority;
d) Participate in contributing opinions and organizing the implementation of programs, plans, projects, documents, regulations, rules, technical procedures related to judicial records;
đ) Perform other tasks assigned;
Clause 2. Professional Competence Standards
a) Master and implement correctly the Party's guidelines, policies, and state laws in judicial record work;
b) Possess knowledge, expertise, and skills to perform the tasks specified in Clause 1 of this Article;
c) Possess the skill to coordinate with relevant agencies and organizations when performing the duties stipulated in Clause 1 of this Article.
Article 8. Transitional Provisions
In cases where there are no provisions on salary grading for the profession of judicial records, the salary grading shall be applied based on the scale of the Professional Salary Table for civil servants and officers in state-run units (Table 3) issued together with Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary system for civil servants, public officials, officers, and armed forces personnel (amended and supplemented by Decrees No. 76/2009/ND-CP dated September 15, 2009, No. 14/2012/ND-CP dated March 7, 2012, No. 17/2013/ND-CP dated February 19, 2013, and No. 117/2016/ND-CP dated July 21, 2016) until specific provisions on salary grading for the profession of judicial records are established, specifically as follows:
1. The profession of judicial records at Level I shall apply the salary coefficient for Class A3 officer type, Group A3.1 (salary coefficient ranging from 6.20 to 8.00).
2. The profession of judicial records at Level II shall apply the salary coefficient for Class A2 officer type, Group A2.1 (salary coefficient ranging from 4.40 to 6.78).
3. The profession of judicial records at Level III shall apply the salary coefficient for Class A1 officer type (salary coefficient ranging from 2.34 to 4.98).
Article 9. Effectiveness and Responsibility for Enforcement
1. This Circular shall take effect from January 15, 2025.
2. In cases where laws on civil servants or normative legal documents referred to in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new provisions in the amended, supplemented, or replacing legal document.
3. The Academy of Judicial Studies shall be responsible for coordinating with the National Registry of Criminal Records Center and the Cadre and Civil Service Department to develop a program for training the profession of criminal record officer as prescribed in Clause 2, Article 4 of this Circular, to be completed before July 15, 2025.
4. The Director of the National Registry of Criminal Records Center, the Head of the Cadre and Civil Service Department, the Director of the Academy of Judicial Studies, the Heads of units under the Ministry, and individuals and organizations related to this matter shall be responsible for enforcing and implementing this Circular.
5. During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals shall report them to the Ministry of Justice for consideration and resolution./.
