Guidelines for implementing functions, tasks, authorities, and organizational structure of public service units in the performing arts sector under the Departments of Culture, Sports and Tourism, and Departments of Culture and Sports of provinces and centrally governed cities
Pursuant to Decree No. 01/2023/NĐ-CP dated January 16, 2023 of the Government providing for the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

The Minister of Culture, Sports and Tourism issues this Circular guiding the implementation of functions, tasks, authorities, and organizational structure of public service units in the performing arts sector under the Departments of Culture, Sports and Tourism, and Departments of Culture and Sports of provinces and centrally governed cities.
Article 1. Scope of Regulation and Applicability
Article 1. This Circular guides the implementation of functions, tasks, authorities, and organizational structure of public service units in the performing arts sector under the Departments of Culture, Sports and Tourism, and Departments of Culture and Sports of provinces and centrally governed cities (hereinafter referred to as public service units in the performing arts sector at provincial level).
Article 2. This Circular applies to public service units in the performing arts sector at provincial level and related agencies, organizations, and individuals.
Article 2. Functions
Point 1. Public service units in the performing arts sector at provincial level shall have the function of organizing performing arts performances to serve local political tasks, meeting cultural, artistic, and entertainment needs of the people; disseminating and popularizing Party guidelines, State policies, and laws through performing arts activities; implementing public service provision and management services within the performing arts sector according to the provisions of the law.
Point 2. Public service units in the performing arts sector at provincial level shall have legal personality, separate seals, bank accounts, and premises as prescribed by law.
Article 3. Duties and Authorities
The public service units in the field of performing arts at provincial level have the following duties and authorities:
1. To develop long-term, annual, or ad hoc plans for performing arts activities, submit them to the competent authority for approval, and organize their implementation after approval;
2. To create, disseminate artistic works and programs in performing arts; to establish and implement model activity formats in the field of performing arts;
3. To exploit, research, collect, preserve, restore, introduce, promote, and enhance various forms of performing arts;
4. To take the lead and coordinate with relevant departments, agencies, and organizations in implementing tasks to develop performing arts activities serving political, economic, cultural, social, and other local tasks;
5. To organize contests and festivals of various forms of performing arts;
6. To provide basic and essential public services in the field of performing arts;
7. To engage in joint ventures and collaborations with organizations and individuals to organize performing arts activities in accordance with the law;
8. To organize training, workshops, and creative activities to improve the performance skills of actors within the unit according to approved plans; to cooperate with related agencies, organizations, and training institutions in selecting and training individuals with talent in performing arts;
9. To cooperate, exchange, and interact professionally and technically with related units both domestically and internationally in accordance with the law;
10. To participate in professional contests and festivals of various forms of performing arts both domestically and internationally in accordance with the law;
11. To implement periodic and ad hoc reporting and statistical systems as prescribed by law;
12. To develop job positions suitable to the functions and tasks of the unit, submit them to the competent authority for approval; to establish targets, plans, measures, and solutions to fulfill assigned tasks;
13. To manage organizational structures, staffing, and implement policies and regulations for civil servants and employees under its jurisdiction;
14. To manage and utilize financial resources, assets, and other allocated resources and revenues in accordance with the law;
15. To perform other tasks assigned by the Director of the Department of Culture, Sports and Tourism, the Director of the Department of Culture and Sports, and heads of competent agencies in accordance with the law.
Article 4. Organizational Structure
1. The leadership of public service units in the field of performing arts at provincial level consists of a head and deputy heads as prescribed by law. The head is responsible before the Director of the Department of Culture, Sports and Tourism, the Department of Culture and Sports, and the law for the performance of assigned functions, tasks, and authorities. Deputy heads assist the head and are responsible before the head and the law for the execution of assigned tasks.
2. Professional and technical organizations of public service units in the field of performing arts at provincial level include administrative, comprehensive, internal management offices; offices responsible for professional and technical functions in performing arts, organizing performing arts performances, and performing arts troupes to implement tasks stipulated in Article 3 of this Circular.
3. The establishment of offices, troupes, and the number of deputy heads of office and troupe leaders in public service units in the field of performing arts at provincial level shall be carried out in accordance with the law on establishing, restructuring, and dissolving public service units.
Article 5. Transitional Provisions
1. The Department of Culture, Sports and Tourism, the Department of Culture and Sports shall review and complete the establishment or restructuring files of public service units in the field of performing arts that were submitted to the competent authority before the effective date of this Circular to ensure compliance with the provisions of this Circular.
2. The Department of Culture, Sports and Tourism, the Department of Culture and Sports shall review the functions, tasks, authorities, and organizational structure of public service units in the field of performing arts at provincial level currently in operation, submit to the competent authority for issuance of documents defining the functions, tasks, authorities, and organizational structure of such units in accordance with the guidance of this Circular and the law on establishing, restructuring, and dissolving public service units within twenty-four months from the effective date of this Circular.
Article 6. Implementation Organization
1. The Performing Arts Administration is responsible for guiding, urging, and inspecting the implementation of this Circular.
2. The Department of Culture, Sports and Tourism, the Department of Culture and Sports shall establish the functions, tasks, authorities, and organizational structure of public service units in the field of performing arts at provincial level in accordance with the law on establishing, restructuring, and dissolving public service units and the guidance of this Circular, and submit them to the competent authority for issuance in accordance with the law.
Article 7. Implementation Provisions
1. This Circular shall take effect from January 15, 2025.
2. During the implementation process, if there are difficulties, agencies, organizations, and individuals are requested to promptly report to the Ministry of Culture, Sports and Tourism (through the Performing Arts Administration) for guidance or consideration for amendment and supplementation./.
