CIRCULAR
REGULATIONS ON DETERMINING THE ADMINISTRATIVE AUTHORITY IN THE FIELD OF COOPERATIVE ECONOMY AND RURAL DEVELOPMENT AND POVERTY REDUCTION
On the basis of Law on Government Organization dated February 18, 2025;
On the basis of Law on Local Administration Organization dated June 16, 2025;
Pursuant to Resolution No. Decision No. 190/2025/QH15 of February 19, 2025 of the 15th National Assembly regarding the handling of certain issues related to the restructuring of state administrative bodies;
Decree No. 35/2025/NĐ-CP dated February 25, 2025, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Decree No. Decree No. 131/2025/NĐ-CP of June 12, 2025 of the Government on determining the administrative authority of two levels of local administration in the field of management by the Ministry of Agriculture and Rural Development;
At the proposal of the Director of the Department of Cooperative Economy and Rural Development and the Head of the National Office for Poverty Reduction;
The Minister of Agriculture and Rural Development promulgates this Circular on determining the administrative authority in the field of cooperative economy and rural development and poverty reduction.
Article 1. Scope of Regulation and Applicability
This Circular stipulates the determination of administrative authority in the field of cooperative economy and rural development and poverty reduction.
This Circular applies to central administrative agencies, local authorities, organizations, and individuals related to the determination of administrative authority in the field of cooperative economy and rural development and poverty reduction.
Article 2. Amending and supplementing some articles of Circular No. 09/2017/TT-BNNPTNT dated April 17, 2017 guiding the classification and evaluation of cooperatives operating in the agricultural sector
1. Amending and supplementing Point c, Point d Clause 2 Article 5 as follows:
“c) Step 3: Agricultural cooperatives submit the self-assessment score sheet.
Object implementing: Board of Management of agricultural cooperatives.
Object receiving: People's Committee of the commune.
Time of implementation: Before April 1 each year.
d) Step 4: Report the results to the provincial and communal state management agencies and publicly announce the self-assessment scores and classification of cooperatives to members.
For reporting the results to the provincial and communal state management agencies: Object reporting: People's Committee of the commune. Object receiving report: Department of Agriculture and Rural Development.
Content of report: List of classified agricultural cooperatives in the area (number of each type of agricultural cooperative rated as excellent, good, average, weak, and number of cooperatives not classified). Method of conducting: The People's Committee of the commune urges and guides agricultural cooperatives to self-assess (in cases where it is necessary to re-examine the appropriateness of the cooperative's self-assessment score sheet, the People's Committee of the commune works with the cooperative to guide them to reassess their scores according to the content of this Circular); compile and report. Reporting time: Before April 10 each year.
For publicly announcing the self-assessment scores and classification of cooperatives to members:
Object announcing: Board of Management of agricultural cooperatives. Object receiving announcement: Members of agricultural cooperatives. Time and method of conducting: By April 15 each year, if there is no opinion from the People's Committee of the commune, the Board of Management of the agricultural cooperative publicly announces the self-assessment scores and classification of the cooperative to its members.”
2. Amending and supplementing Clause 2, Clause 3 Article 7 as follows:
"2. Departments of Agriculture and Rural Development; People's Committees of communes; relevant agencies in the agriculture sector and agricultural cooperatives are responsible for implementing this Circular.
3. Agricultural cooperatives are responsible for annually conducting self-classification, assessment, ranking, and reporting to the People's Committee of the commune. The assessment results of cooperatives serve as the basis for considering and selecting awards in the agriculture sector."
Article 3. Amending and supplementing some articles of Circular No. 06/2019/TT-BNNPTNT dated July 19, 2019 on special activities, reporting requirements for agricultural cooperatives, and state management responsibilities at all levels for agricultural cooperatives.
1. Amend Point c Clause 1 Article 6 as follows:
“c) Place to submit reports:
Agricultural cooperatives shall submit reports to the People's Committee of the commune where their main office is located;
The Federation of Agricultural Cooperatives (units registered to operate at provincial level) shall submit reports to the Department of Agriculture and Rural Development of the province or city where their main office is located.”
2. Amend Point a Clause 2 Article 6 as follows:
“a) The People's Committee of the commune shall compile annual reports on the special activities of agricultural cooperatives (as stipulated in the Appendix attached hereto) and submit them to the Department of Agriculture and Rural Development.”
3. Delete the term "district" in Article 1 and Article 5.
Article 4. Amending and supplementing some articles of Circular No. 02/2020/TT-BNNPTNT dated February 28, 2020 on criteria for farm economies.
1. Amending and supplementing Point a Clause 2 Article 5 as follows:
“a) Annually, the People's Committee of the commune shall compile and report on the farm economy within its jurisdiction to the Department of Agriculture and Rural Development;”
2. Amending and supplementing Section Notes of Appendix II issued together with Circular No. 02/2020/TT-BNNPTNT as follows:
“Notes:
1. The People's Committee of the commune shall report the contents of Part I, attaching copies of declarations of information about farms by farm owners within its jurisdiction to the People's Committee of the province.
2. The People's Committee of the commune and the Department of Agriculture and Rural Development shall report the contents of Parts I and II.”
Article 5. Amending and supplementing some articles of Circular No. 09/2020/TT-BNNPTNT dated July 24, 2020 guiding the confirmation of natural disasters and epidemics in implementing the policy of supporting agricultural insurance.
1. Amending Clause 2 Article 4 as follows:
“Organizations and individuals engaged in agricultural production or insurance companies shall use the report provided for in Clause 1 of this Article by the specialized agency under the People's Committee of the commune or province to determine insurance events in implementing the policy of supporting agricultural insurance.”
2. Amending Clause 2 Article 5 as follows:
“Organizations and individuals engaged in agricultural production or insurance companies shall use the report, notification document, and urgent telegrams provided for in Clause 1 of this Article by the specialized agency under the People's Committee of the commune or province to determine insurance events in implementing the policy of supporting agricultural insurance.”
3. Amending Clause 2 Article 6 as follows:
“The People's Committee of the province: Directs the People's Committee of the commune and the specialized agency under the People's Committee of the province to publicly disclose the notification documents and reports provided for in Clause 1 of Articles 3, 4, and 5 of this Circular as the basis for determining insurance events in implementing the policy of supporting agricultural insurance.”
Article 6. Amending Point a Article 2 of Circular No. 04/2022/TT-BNNPTNT dated July 11, 2022 guiding the implementation of support for production development in the field of agriculture under the National Target Program on Sustainable Poverty Reduction for the period 2021-2025 as follows:
“a) Workers belonging to poor households, near-poor households, newly escaped poverty households, persons with disabilities (without stable livelihoods) throughout the country; people living in communes with extremely difficult conditions in coastal areas, islands, and sea regions.”
Article 7. Amend and supplement some articles of Circular No. 24/2023/TT-BNNPTNT dated December 21, 2023 guiding certain contents for implementing Decision No. 590/QĐ-TTg dated May 18, 2022 of the Prime Minister approving the Program on Arranging Population in Areas Affected by Natural Disasters, Particularly Difficult Areas, Border Areas, Marine Islands, Free Migration, Specialized Forest Areas for the period 2021-2025 with a vision to 2030.
1. Amending Clause 6 of Article 3 as follows:
"6. Arranging stable population within the province: Refers to arranging stable population within the scope of a commune or arranging stable population from one commune to another commune within the administrative area of a province."
2. Amend Point a and Point b Clause 2 Article 5 as follows:
"2. Establish, review, and approve plans for arranging stable population interwovenly.
a) The People's Committee of the provincial level assigns the People's Committee of the commune level to take the lead, coordinate with relevant sectors and levels of administration to establish plans for arranging stable population interwovenly according to the provisions stipulated in Clause 1 of this Article, and submit them to the competent authority for review;
b) The dossier for reviewing plans for arranging stable population interwovenly includes: The report of the People's Committee of the commune level submitting to the People's Committee of the provincial level requesting review of the plan for arranging stable population interwovenly; the content of the plan for arranging stable population interwovenly and accompanying annexes;"
3. Amend Point a Clause 2 Article 6 as follows:
"a) Based on the guidelines of the Ministry of Finance regarding the preparation of medium-term public investment plans and annual plans, and the guidelines of the Ministry of Agriculture and Rural Development, the Department of Agriculture and Rural Development guides the People's Committees of communes and related units to incorporate the content of arranging stable population into medium-term public investment plans and annual plans according to Annex III and IV issued together with this Circular; consolidate and unify with the Department of Finance to submit to the People's Committee of the provincial level for consolidation into the general plan of the province, and submit to the competent authority for consideration and approval;"
4. Amend the name of Article 10 as follows:
"Article 10. Arranging Stable Population within the Province"
5. Amend Point d and Point đ Clause 1 Article 10 as follows:
"d) Compile the list of households and individuals participating in projects and plans for arranging stable population according to Annex VII issued together with this Circular, and submit it to the People's Committee of the commune level for examination and approval;
đ) Notify households and individuals who are arranged for stable settlement according to the Decision approving the arrangement of stable population issued by the People's Committee of the commune level."
6. Amend the name of Clause 3 Article 10 as follows: "3. Provincial People's Committee shall implement"
7. Delete the phrase "within the district; outside the district" at Item 4 of Annex I, the phrase "within the district" at Item 4 of Annex III, and the word "district" at Item 4 of Annex III, VI, VII, VIII, IX issued together with Circular No. 24/2023/TT-BNNPTNT.
8. Repeal Clause 7 Article 3, Article 11.
Article 8. Amend and supplement some articles of Circular No. 07/2021/TT-BLDTBXH dated July 18, 2021 guiding methods for reviewing and classifying poor households and near-poor households; determining income of households engaged in agriculture, forestry, fisheries, salt production with moderate living standards for the period 2022-2025 and reporting forms, which have been amended and supplemented by Circular No. 02/2022/TT-BLDTBXH dated March 30, 2022.
1. Delete the phrase "town" at Annex I, Annex II, Annex III, Annex VI issued together with Circular No. 07/2021/TT-BLDTBXH (which has been amended and supplemented by Circular No. 02/2022/TT-BLDTBXH dated March 30, 2022).
2. Delete the term "District/County/City" at Annex II, Annex III, Annex IV, Annex VIII, and the term "county" at Annex VII, and the term "County/District" at Annex VIII issued together with Circular No. 07/2021/TT-BLDTBXH (which has been amended and supplemented by Circular No. 02/2022/TT-BLDTBXH dated March 30, 2022).
3. Replace the term "county" with the term "commune" at Annex VII issued together with Circular No. 07/2021/TT-BLDTBXH (which has been amended and supplemented by Circular No. 02/2022/TT-BLDTBXH dated March 30, 2022).
Article 9. Amending and supplementing some articles of Circular No. 03/2024/TT-BLDTBXH dated April 18, 2024 guiding certain contents for implementing diversification of livelihoods, developing poverty reduction models, and supporting workers to work abroad under contracts within the National Target Program on Sustainable Poverty Reduction for the period 2021-2025.
1. Amend Point b Clause 2 Article 6 as follows:
"b) When preparing the project proposal, the leading unit shall coordinate with the People's Committee of the commune where the project is expected to be implemented to survey and select the content of activities, participants, and the implementation area of the project in accordance with the provisions of Clause 1 of this Article."
2. Amend Point c Clause 3 Article 15 as follows:
"c) Direct the People's Committee of the commune to implement diversified livelihood activities, develop poverty reduction models, and support workers to work abroad under contracts within the commune; inspect, supervise, conduct mid-term reviews, final evaluations, assess, and report every six months and annually on the results of implementation according to regulations."
3. Delete the phrase "poor district" in Clause 1, Clause 2, Clause 3, Clause 5, Clause 6 Article 13 and Clause 3 Article 14.
Article 10. Amending and supplementing some articles of Circular No. 10/2022/TT-BLDTBXH dated May 31, 2022 guiding supervision and evaluation of the implementation of the National Target Program on Sustainable Poverty Reduction for the period 2021-2025
1. Amend Point a Clause 3 Section II Appendix I promulgated together with Circular No. 10/2022/TT-BLDTBXH as follows:
"a) Collect information, report at the commune level
The People's Committee of the commune directs the Management Board of the commune:
- Regularly collect information according to Forms 03, Form 04, Form 05, Form 06, Form 07, Form 08, Form 09, Form 10, Form 11, Form 12, Form 13, Form 14, and Form 15.
For forms from Form 04 to Form 15, only regularly collect information in communes benefiting from projects, sub-projects, components of the Program directly managed or implemented by the commune.
- Summarize Form 01, Form 02 and prepare the Mid-Year and Annual Supervision Report (Form 01), Initial, Mid-Term, Final, and Annual Reports (Form 02) and send them to the Department of Agriculture and Environment and other departments, agencies responsible for managing and implementing projects, sub-projects, components of the Program.
- Update information on the National Target Program on Sustainable Poverty Reduction Management System according to regulations."
2. Delete the word "district" in Clause 3 Article 5.
3. Remove the provisions regarding the district level in Appendix I, Appendix II, Appendix III promulgated together with Circular No. 10/2022/TT-BLDTBXH.
4. Delete Point c Clause 4, Point c Clause 5 Section I, Point b Clause 3 Section II Appendix I promulgated together with Circular No. 10/2022/TT-BLDTBXH.
5. Replace the phrase "District Steering Committee for the National Target Programs on the supervision plan" with "Commune Management Board" in the first bullet point of Point b Clause 4 Section I Appendix I; replace the phrase "District Steering Committee for the National Target Programs, Department of Labor - Invalids and Social Affairs" with "Department of Agriculture and Environment" in the third bullet point of Point d Clause 5, Section I Appendix I; replace the term "district" with "commune", replace the phrase "Commune in poor district" with "Commune in poor district during the period 2021-2025 according to Decision No. 353/QĐ-TTg dated March 15, 2022 of the Prime Minister approving the list of poor districts, extremely difficult communes in coastal areas, islands during the period 2021-2025", replace the term "district level" with "commune level" in Appendix III promulgated together with Circular No. 10/2022/TT-BLDTBXH.
Article 11. Replace the names of agencies and units as follows:
1. Replace the phrase "Ministry of Agriculture and Rural Development" with the phrase "Ministry of Agriculture and Environment", the phrase "Department of Agriculture and Rural Development" with the phrase "Department of Agriculture and Environment", the phrase "General Department for Flood Disaster Prevention and Control" with the phrase "Directorate for Dike Management and Flood Disaster Prevention", the phrase "Plant Protection Agency" with the phrase "Crop Production and Plant Protection Agency", the phrase "Veterinary Agency" with the phrase "Livestock and Veterinary Agency" in Circular No. 09/2017/TT-BNNPTNT, Circular No. 06/2019/TT-BNNPTNT, Circular No. 02/2020/TT-BNNPTNT, Circular No. 09/2020/TT-BNNPTNT, Circular No. 04/2022/TT-BNNPTNT, and Circular No. 24/2023/TT-BNNPTNT.
2. Replace the phrase "Ministry of Labor, Invalids and Social Affairs" with the phrase "Ministry of Agriculture and Environment", and the phrase "Department of Labor, Invalids and Social Affairs" with the phrase "Department of Agriculture and Environment" in Circular No. 07/2021/TT-BLDTBXH, Circular No. 03/2024/TT-BLDTBXH, and Circular No. 10/2022/TT-BLDTBXH.
3. Replace the phrase "Ministry of Labor, Invalids and Social Affairs" with the phrase "National Office for Poverty Reduction under the Ministry of Agriculture and Environment" in Article 9 of Circular No. 04/2022/TT-BNNPTNT.
Article 12. Effective Date
This Circular shall take effect from July 1, 2025.
Article 13. Responsibility for Implementation
The Cooperative Economy and Rural Development Bureau, the National Office for Poverty Reduction shall guide the implementation, supervise, consolidate and report to the Ministry of Agriculture and Environment on the implementation of this Circular.
Provincial People's Committees and Commune People's Committees are responsible for organizing the implementation of tasks and authorities assigned according to the provisions of this Circular./.
