Guidelines for Implementing Special Allowances for Particularly Skilled Workers
Implementing Decision No. 97-CT dated April 14, 1986 of the Chairman of the Council of Ministers, the Ministry of Labor guides the implementation of special allowances for particularly skilled workers as follows:
I- OBJECTIVE AND SIGNIFICANCE
The special allowance system for particularly skilled workers aims to reward and encourage technical workers with many talents who are currently exerting their influence in production and work, in nurturing, guiding, and passing on good knowledge and experience to colleagues within the same production or work unit. It creates conditions for factory directors to pay appropriate attention to the training and effective utilization of teams of skilled workers, thereby enhancing their professional capabilities in production and work for the common benefit.
II- ELIGIBILITY FOR ALLOWANCES AND AMOUNT OF SPECIAL ALLOWANCE FOR PARTICULARLY SKILLED WORKERS
1. Objectives:
Those eligible for consideration of special allowances for particularly skilled workers are workers receiving wages according to the five wage scales specified in Point A, Article 3 of Decree No. 235-HĐBT dated September 18, 1985 of the Council of Ministers, who are currently working in state enterprises.
2. Subsidy levels:
Workers recognized as particularly skilled workers shall be entitled to a special allowance of 7% of their wage grade level.
- If they regularly work in normal conditions, it will be calculated based on the regular wage level.
- If they regularly work in hazardous or extremely hazardous conditions, it will be calculated based on the hazardous or extremely hazardous wage level.
III- CONDITIONS AND STANDARDS FOR RECOGNITION AS A PARTICULARLY SKILLED WORKER
1. The condition for recognizing "particularly skilled worker" is that workers have been classified at the final level of the wage scale based on current technical grade standards (classified at Grade 7 for seven-grade scales, at Grade 6 for six-grade scales).
2. The standard for recognition as a particularly skilled worker is that workers are effectively utilizing their abilities in production, possess extensive practical experience and initiatives in addressing technical production difficulties, improving and perfecting technological processes, or proposing measures to address unexpected production issues, resulting in tangible economic benefits.
IV- IMPLEMENTATION
Based on the conditions and standards stipulated above, the enterprise establishes a Wage Classification Committee to review and approve the title of particularly skilled worker. The composition of the Committee is determined by the Director. After receiving the recommendation from the Wage Classification Committee, the enterprise director consults with the Trade Union at the same level and decides which workers are recognized as particularly skilled workers.
Workers recognized as particularly skilled workers shall enjoy special allowances for up to two years. After this period, the enterprise's Wage Classification Committee will conduct another review and recommend to the Director. If continued recognition is granted, the allowance will continue; if not, the allowance will cease.
In cases where workers recognized as particularly skilled workers suffer from prolonged illness or transfer to other jobs, they will not be entitled to special allowances for particularly skilled workers.
Upon recognition as a particularly skilled worker, in addition to enjoying special allowances for particularly skilled workers, they will also continue to receive seniority allowances exceeding the framework.
This Circular takes effect from May 1, 1986. During its implementation, any issues encountered should be reported to the Ministry of Labor for study and resolution.
