CIRCULAR

GUIDELINES ON REQUIREMENTS, PROCEDURES, AND REGULATIONS FOR REGISTERING THE FIELD OF ACTIVITIES IN CONFORMITY ASSESSMENT

Circular No. 08/2009/TT-BKHCN dated April 8, 2009, issued by the Minister of Science and Technology, guiding on requirements, procedures, and regulations for registering the field of activities in conformity assessment, which took effect from May 23, 2009, has been amended and supplemented by:

Circular No. 10/2011/TT-BKHCN dated June 30, 2011, issued by the Minister of Science and Technology, amending and supplementing certain provisions of Circular No. 08/2009/TT-BKHCN dated April 8, 2009, issued by the Minister of Science and Technology, guiding on requirements, procedures, and regulations for registering the field of activities in conformity assessment, which took effect from August 20, 2011.

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;

The Ministry of Science and Technology guides uniformly on requirements, procedures, and regulations for registering the field of activities in conformity assessment as follows: [1]:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

This Circular applies to units under the Ministry of Education and Training; departments of education and training, education and training divisions; preschool education institutions, general education institutions, regular education institutions, teacher training colleges, college of education, universities, universities, academies, other educational institutions, and related organizations and individuals (hereinafter referred to collectively as agencies and units).

1.1. This Circular guides on requirements, procedures, and regulations for registering the field of activities of organizations providing conformity assessment services including testing, inspection, examination, certification.

1.2. This Circular applies to organizations providing conformity assessment services and relevant state management agencies related to conformity assessment activities.

1.3. This Circular does not apply to the following activities:

1.3.1. Examination of measuring instruments listed in the catalog of measuring instruments required to be examined under the law on measurement;

1.3.2. Testing for internal organizational activities that do not provide testing services externally.

2. General Principles

2.1. The Ministry of Science and Technology is responsible for unified state management over conformity assessment activities.

2.2. Ministries managing sectors and fields are responsible for managing conformity assessment activities within their assigned management scope.

2.3. Terminology and definitions regarding testing, inspection, examination, and certification are defined in Article 3 of the Law on Product and Goods Quality.

2.4. In cases where standards specified in this Circular are modified, supplemented, or replaced, they shall be implemented according to the revised, supplemented, or newly issued documents.

II. REQUIREMENTS, PROCEDURES, AND REGULATIONS FOR REGISTERING THE FIELD OF ACTIVITIES IN CONFORMITY ASSESSMENT

1. For Certification Organizations

1.1. General Requirements

1.1.1. Have registered their scope of certification activities at the Ministry of Science and Technology according to Circular No. 08/2009/TT-BKHCN dated April 8, 2009, issued by the Minister of Science and Technology, guiding on requirements, procedures, and procedures for registering the scope of compliance assessment activities;

1.1.1. Established in accordance with the law, having functions to operate in the certification field;

1.1.2. The management system and operational capacity of the certification organization must meet the requirements stipulated in national standards, international standards, and international guidelines for each corresponding type as follows:

- National Standard TCVN 7457:2004 or International Standard ISO/IEC Guide 65:1996 and related guidelines of the International Accreditation Forum (IAF) for product and goods certification activities;

- National Standard TCVN ISO/IEC 17021:2008 or International Standard ISO/IEC 17021:2006 and related guidelines of the International Accreditation Forum (IAF) for management system certification activities.

1.1.3. Always have at least five full-time staff members (civil servants or employees with contracts of at least twelve months or indefinite-term contracts) of the organization who meet the following requirements:

a) Hold a bachelor's degree or higher and have expertise relevant to the certified field;

b) Have evaluation capabilities meeting the requirements stipulated in National Standard TCVN ISO 19011:2003 or International Standard ISO 19011:2002 - Guidelines for Quality Management Systems and/or Environmental Management Systems Auditing;

c) Be trained in management system certification (for management system certification organizations); be trained in product certification (for product certification organizations).

1.2. Procedures and Regulations for Registering the Field of Certification Activities

1.2.1. Certification organizations that meet the requirements stipulated in Point 1.1 Clause 1 Section II, prepare one set of registration application documents for the field of certification activities and submit them to the competent authority specified in Point 1.3 Clause 1 Section III of Circular No. 08/2009/TT-BKHCN dated April 8, 2009, issued by the Ministry of Science and Technology guiding on requirements, procedures, and regulations for registering the field of activities in conformity assessment (hereinafter referred to as Circular No. 08/2009/TT-BKHCN).

In case of submitting the application directly to the competent authority specified in Point 1.3 Clause 1 Section III of Circular No. 08/2009/TT-BKHCN, original copies of the documents specified in Points 1.2.2.2, 1.2.2.3, and 1.2.2.4 Clause 1 Section II must be available for verification. In case the application is sent through postal service, the certification organization must submit certified copies of the documents specified in Points 1.2.2.2, 1.2.2.3, and 1.2.2.4 Clause 1 Section II.

1.2.2. The application documents for registering the field of certification activities include:

1.2.2.1. Application form for registering the field of certification activities according to the model prescribed in Appendix II of this Circular;

1.2.2.2. Copy of the Decision on Establishment or Business Registration Certificate or Investment License;

1.2.2.3. List of evaluators meeting the requirements stipulated in Clause 1.1.3 of this Section, according to the model prescribed in Appendix I of this Circular accompanied by copies of corresponding training certificates;

1.2.2.4. Documents proving the operational capacity for certification meeting the requirements stipulated in Point 1.1 Clause 1 of this Section, specifically as follows:

- For certification organizations already evaluated and granted accreditation certificates by legitimate accreditation organizations in Vietnam or international accreditation organizations that are members of the International Accreditation Forum (IAF) and the Pacific Accreditation Cooperation (PAC): Submit copies of the accreditation certificates along with the scope of accreditation.

- For certification organizations not yet accredited: Submit documents, evaluation procedures, and other related materials to prove operational capacity consistent with the requirements of the corresponding standards stipulated in Point 1.1 Clause 1 of this Section.

1.2.2.5. Sample of the Certificate and Certification Seal;

1.2.2.6. Results of certification activities conducted in the registered field for the most recent year (if applicable).

1.2.3.[4] Within five working days from the date of receipt of a complete and valid file as prescribed in point 1.2.2 clause 1 Section this Article, the competent authority specified in point 1.3 clause 1 Section III Circular No. 08/2009/TT-BKHCN shall examine the file and issue the Certificate of Registration for the Field of Certification Activities according to the model prescribed in Appendix III of Circular No. 08/2009/TT-BKHCN to the certification organization.

In case the file does not meet the requirements and a practical assessment is necessary, within fifteen working days from the date of receipt of a complete file, the General Department of Standardization, Metrology and Quality Control shall review the file, appoint experts or establish an evaluation team to conduct a practical assessment at the certification organization. The costs for the evaluation activities of the experts or the evaluation team shall be borne by the certification organization.

Based on the registration file, the Practical Assessment Report and the results of corrective actions that meet the requirements, within five working days from the date of receipt of a complete file, the General Department of Standardization, Metrology and Quality Control shall issue the Certificate of Registration for the Field of Certification Activities according to the model prescribed in Appendix III of Circular No. 08/2009/TT-BKHCN to the certification organization.

In case of refusal to issue the Certificate, the competent authority must notify the reasons for refusal in writing to the certification organization that has submitted the registration file.

1.3.[5] A certification organization that has been issued a Certificate of Registration for the Field of Certification Activities when it needs to change or supplement the registered fields of activity must submit a change or supplementary registration file in accordance with points 1.2.2.3, 1.2.2.4 and 1.2.2.6 clause 1 Section II. The application for changing or supplementing the field of activity is prescribed in Appendix IV of Circular No. 08/2009/TT-BKHCN.

2. For testing organizations

2.1. General Requirements

Testing organizations must meet the following requirements:

2.1.1. Established in accordance with the provisions of the law;

2.1.2. Possess testing capabilities that meet the requirements stipulated in the national standard TCVN ISO/IEC 17025:2007 or the international standard ISO/IEC 17025:2005;

2.1.3. Have at least one tester with appropriate professional qualifications corresponding to the registered testing field.

In cases where there are national standards or international standards on quality management systems for specialized testing organizations, such specialized testing organizations must meet the requirements of those standards.

2.2. Procedure and formalities for registering the field of testing activities

2.2.1.[6] A testing organization that meets the requirements stipulated in point 2.1 clause 2 Section II shall prepare one set of registration files for the field of testing activities and send them to the competent authority specified in point 1.3 clause 1 Section III Circular No. 08/2009/TT-BKHCN.

In case the file is directly submitted to the competent authority specified in point 1.3 clause 1 Section III Circular No. 08/2009/TT-BKHCN, original copies of the documents specified in points 2.2.2.2, 2.2.2.3, and 2.2.2.4 clause 2 Section II which have not been certified must be provided for verification. In case the file is sent through postal service, the certification organization must submit certified copies of the documents specified in points 2.2.2.2, 2.2.2.3, and 2.2.2.4 clause 2 Section II.

2.2.2. The registration file for the field of testing activities includes:

2.2.2.1. Application for Registration of Testing Activity Fields according to the model prescribed in Appendix II of this Circular;

2.2.2.2. Copy of the Decision on Establishment or Business Registration Certificate or Investment License;

2.2.2.3. List of testers corresponding to the registered testing field along with certified copies of training certificates;

2.2.2.4. Documents proving the capability to perform testing activities meeting the requirements stipulated in point 2.1 clause 2 Section II, specifically as follows:

- For testing organizations that have been evaluated and granted accreditation certificates by legally recognized accreditation organizations in Vietnam or foreign accreditation organizations that are members of the International Laboratory Accreditation Cooperation (ILAC) or the Asia-Pacific Laboratory Accreditation Cooperation (APLAC) for testing activities in Vietnam: Submit a copy of the accreditation certificate along with the scope of accreditation.

- For testing organizations that have not yet been accredited: Submit documents, procedures, and other materials to prove the capability to perform testing activities in compliance with the relevant standard requirements stipulated in point 2.1 clause 2 Section II.

2.2.2.5. Sample Test Result Report Form;

2.2.2.6. Results of testing activities conducted in the registered field during the most recent year (if available).

2.2.3.[7] Within five working days from the date of receipt of a complete and valid file as prescribed in point 2.2.2 clause 2 Section II, the competent authority specified in point 1.3 clause 1 Section III Circular No. 08/2009/TT-BKHCN shall examine the file and issue the Certificate of Registration for the Field of Testing Activities according to the model prescribed in Appendix III of Circular No. 08/2009/TT-BKHCN to the testing organization.

In case the file does not meet the requirements and a practical assessment is necessary, within fifteen working days from the date of receipt of a complete file, the General Department of Standardization, Metrology and Quality Control shall review the file, appoint experts or establish an evaluation team to conduct a practical assessment at the testing organization. The costs for the evaluation activities of the experts or the evaluation team shall be borne by the testing organization.

Based on the registration file, the Practical Assessment Report and the results of corrective actions that meet the requirements, within five working days from the date of receipt of a complete file, the General Department of Standardization, Metrology and Quality Control shall issue the Certificate of Registration for the Field of Testing Activities according to the model prescribed in Appendix III of Circular No. 08/2009/TT-BKHCN to the testing organization.

In case of refusal to issue the Certificate, the competent authority must notify the reasons for refusal in writing to the testing organization that has submitted the registration file.

2.2.4.[8] A testing organization that has been issued a Certificate of Registration for the Field of Testing Activities when it needs to change or supplement the registered fields of activity must submit a change or supplementary registration file in accordance with points 2.2.2.3, 2.2.2.4 and 2.2.2.6 clause 2 Section II. The application for changing or supplementing the field of activity is prescribed in Appendix IV of Circular No. 08/2009/TT-BKHCN.

3. For appraisal organizations and inspection organizations

3.1. General Requirements

3.1.1. For appraisal organizations

The appraisal organization must meet the following requirements:

3.1.1.1. Established in accordance with the provisions of the law;

3.1.1.2. Possessing the capacity to conduct appraisals that comply with the requirements set forth in the national standard TCVN ISO /IEC 17020: 2001 or the international standard ISO /IEC 17020:1998;

3.1.1.3. Having appraisers who meet the qualifications specified in the Law on Trade.

3.1.2. For inspection organizations

Inspection organizations must meet the following requirements:

3.1.2.1. Established in accordance with the provisions of the law;

3.1.2.2. Possessing a testing laboratory that complies with the requirements set forth in the national standard TCVN ISO /IEC 17025: 2007 or the international standard ISO /IEC 17025:2005;

3.1.2.3. Having at least one inspector with appropriate professional qualifications corresponding to the inspection field registered.

3.2. Procedures and formalities for registering the scope of appraisal and inspection activities

3.2.1. For appraisal organizations

3.2.1.1. The procedures and formalities for registering the scope of appraisal activities are carried out in accordance with the provisions of the Law on Trade and guiding documents: Decree No. 20/2006/NĐ-CP dated February 20, 2006 of the Government, Circular No. 06/2006/TT-BTM dated April 11, 2006 of the Ministry of Trade (now the Ministry of Industry and Trade).

3.2.1.2. Regarding conditions, appraisal organizations must meet the requirements stipulated in Point 3.1.1 Clause 3 Section of this Article.

3.2.2. For inspection organizations

3.2.2.1. The procedures and formalities for registering the scope of inspection activities are carried out in accordance with the regulations of the sectoral management ministry regarding products and goods within their assigned management scope.

3.2.2.2. Regarding conditions, inspection organizations must meet the requirements stipulated in Point 3.1.2 Clause 3 Section of this Article.

III. RESPONSIBILITIES OF THE MANAGEMENT AUTHORITY AND ORGANIZATIONS FOR ASSESSING COMPLIANCE

1. Responsibilities of the sectoral management ministry

1.1. The Ministry of Industry and Trade designates the lead agency responsible for managing appraisal activities in accordance with the laws on trade and announces it through mass media so that organizations and individuals are aware, while also notifying the Ministry of Science and Technology for coordination in management.

1.2. The sectoral management ministry designates the lead agency responsible for managing product quality inspection activities within its assigned management scope and announces it through mass media so that organizations and individuals are aware, while also notifying the Ministry of Science and Technology for coordination in management.

1.3. The Ministry of Science and Technology designates the following agencies as lead agencies:

1.3.1. The General Department of Standardization, Metrology and Quality Control is the lead agency responsible for managing conformity assessment activities, product quality testing, and evaluation activities for products and goods under the responsibility of the Ministry of Science and Technology (excluding nuclear radiation safety-related products).

1.3.2. The Radiation Safety and Nuclear Safety Agency is the lead agency responsible for managing conformity assessment activities for nuclear radiation safety-related products.

2. Responsibilities of the designated lead agency

2.1. Receiving, processing registration files, and issuing certificates of registration for the scope of conformity assessment activities for conformity assessment organizations.

2.2. Managing and inspecting the conformity assessment activities of organizations that have been issued certificates of registration for the scope of conformity assessment activities. Applying warning, temporary suspension, or revocation measures for certificates of registration when conformity assessment organizations violate the provisions of this Circular or Article 20 of the Product and Goods Quality Law.

2.3. Compiling a list of conformity assessment organizations that have been issued certificates of registration for the scope of conformity assessment activities along with the scope of conformity assessment and organizations that have been registered for the scope of conformity assessment activities but have been warned, temporarily suspended, or had their certificates revoked; publicly announcing on the electronic information website of the sectoral management ministry for organizations and individuals to be aware and reporting to the Ministry of Science and Technology (General Department of Standardization, Metrology and Quality Control) for comprehensive compilation.

2.4.[9] Annually and at any time upon request, the lead agencies are responsible for compiling the situation and results of the activities of conformity assessment organizations that have been issued certificates of registration for the scope of conformity assessment activities, reporting to the sectoral management ministry and reporting to the Ministry of Science and Technology (General Department of Standardization, Metrology and Quality Control) for coordinated management.

3. Responsibilities of conformity assessment organizations

3.1. Implementing rights and obligations as prescribed in Articles 19 and 20 of the Product and Goods Quality Law. In case of violation of the provisions of this Circular or Article 20 of the Product and Goods Quality Law, they will be subject to warnings, temporary suspension, or revocation of the certificate of registration for the scope of conformity assessment activities depending on the nature and severity of the violation.

3.2.[10] Annually and at any time upon request, reporting according to the form prescribed in Appendix V of Circular No. 08/2009/TT-BKHCN on the results of conformity assessment activities that have been registered, separately for certification organizations, reporting according to the form prescribed in Appendix VI of Circular No. 08/2009/TT-BKHCN on certification activity results; simultaneously notifying the Ministry of Science and Technology (General Department of Standardization, Metrology and Quality Control) for compilation and reporting to the Prime Minister.

3.3. Notifying the lead agency prescribed in Clause 1 Section III of this Circular about changes affecting the registered conformity assessment capability within fifteen days from the date of change.

IV. IMPLEMENTATION [11]

1. Sectoral management ministries are responsible for guiding the implementation of this Circular within their assigned management scope. Based on the guidance provided in this Circular, establishing specific requirements, procedures, and formalities for registering the scope of activities for inspection and appraisal organizations within their assigned management scope.

2. The General Department of Standardization, Metrology and Quality Control is responsible for monitoring and urging the implementation of this Circular.

3. This Circular shall take effect forty-five days from the date of issuance and shall replace the provisions on registration of conformity assessment activities stipulated in Articles 8 and 9 of the Decree on Conformity Assessment, Certification, and Declaration of Conformity issued together with Decision No. 24/2007/QĐ-BKHCN dated September 28, 2007 of the Minister of Science and Technology.

4. Six months from the date this Circular takes effect, organizations that have been granted certificates of registration for conformity assessment activities under Decision No. 24/2007/QĐ-BKHCN dated September 28, 2007 of the Minister of Science and Technology must complete the supplementary documents and certificates as specified in Clause 1.2.2 Section I to be converted to certificates of registration for conformity assessment activities in accordance with this Circular.

5. Six months from the date this Circular takes effect, conformity assessment organizations must register their fields of activity in accordance with this Circular. In case of violation, penalties will be imposed according to the nature and degree of the violation as prescribed by law.

6. During implementation, if there are any difficulties, relevant agencies, organizations, and individuals shall promptly report them to the Ministry of Science and Technology (Standardization, Metrology, and Quality Control Department) for consideration and resolution./.

[1] Circular No. 10/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 08/2009/TT-BKHCN dated April 8, 2009, issued by the Minister of Science and Technology guiding requirements, procedures, and registration formalities for conformity assessment activities, is hereby promulgated as follows:

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

On the basis of Resolution number 67/NQ-CP dated December 24, 2010 of the Government regarding simplifying administrative procedures within the scope of management functions of the Ministry of Science and Technology;

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;

Considering the proposal of the Director General of the Standardization, Measurement, and Quality Control Department,

The Minister of Science and Technology stipulates:"

[2] This Point is amended and supplemented pursuant to Clause 1, Article 1 of Circular No. 10/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 08/2009/TT-BKHCN dated April 8, 2009, issued by the Minister of Science and Technology guiding requirements, procedures, and registration formalities for conformity assessment activities, which takes effect from August 20, 2011.

[3] This Point is amended and supplemented pursuant to Clause 2, Article 1 of Circular No. 10/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 08/2009/TT-BKHCN dated April 8, 2009, issued by the Minister of Science and Technology guiding requirements, procedures, and registration formalities for conformity assessment activities, which takes effect from August 20, 2011.

[10] This Point is amended and supplemented pursuant to Clause 5, Article 1 of Circular No. 10/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 08/2009/TT-BKHCN dated April 8, 2009, issued by the Minister of Science and Technology guiding requirements, procedures, and registration formalities for conformity assessment activities, which takes effect from August 20, 2011.

[11] Articles 2 and 3 of Circular No. 10/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 08/2009/TT-BKHCN dated April 8, 2009, issued by the Minister of Science and Technology guiding requirements, procedures, and registration formalities for conformity assessment activities, which takes effect from August 20, 2011, are stipulated as follows:

Article 2. The General Department of Standardization, Metrology and Quality Assurance is responsible for guiding and organizing the implementation of this Circular.

Article 3.

1. This Circular shall take effect from August 20, 2011.

2. In cases where laws, regulations, or national standards cited in Circular No. 08/2009/TT-BKHCN and this Circular are amended, supplemented, or replaced, they shall be implemented according to the new documents."

3. The Director of the Standardization, Metrology and Quality Control General Department, the Head of the Legal Affairs Department, and relevant organizations and individuals are responsible for implementing this Circular. ”.
