Regarding the establishment of the Management Board of the Special Economic and Trade ZoneLao Bao, Quang Tri Province

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decision No. 11/2005/QĐ-TTg dated January 12, 2005 of the Prime Minister promulgating the Regulation of the Lao Bao Special Economic-Zone, Quang Tri Province;

At the request of the Chairman of the People's Committee of Quang Tri Province and the Minister of Home Affairs.

DECISION:

Article 1.

1. Establish the Management Board of the Special Economic and Trade Zone Lao Bao under the People's Committee of Quang Tri Province based on the existing Management Board of the Lao Bao Trade Zone.

2. The Management Board of the Special Economic and Trade Zone Lao Bao shall be a state administrative body directly managing the Special Economic and Trade Zone Lao Bao, having legal personality, bank accounts, seals bearing the national emblem, office premises, staffing, and operational funds allocated from the state budget for Quang Tri Province, and shall be the focal point for planning and balancing separate construction capital from the state budget.

Article 2. Duties and powers of the Management Board of the Special Economic and Trade Zone Lao Bao:

The Management Board of the Special Economic and Trade Zone Lao Bao shall perform the duties and powers stipulated in Article 31 of the Regulation on the Special Economic and Trade Zone Lao Bao issued by Decision No. 11/2005/QĐ-TTg dated January 12, 2005 of the Government.

Article 3. Organizational structure and staffing of the Management Board of the Special Economic and Trade Zone Lao Bao:

1. The Management Board of the Special Economic and Trade Zone Lao Bao shall have a Director, Deputy Directors, and supporting staff.

The Director shall be appointed by the Prime Minister at the proposal of the Chairman of the People's Committee of Quang Tri Province.

The Deputy Directors shall be appointed by the Chairman of the People's Committee of Quang Tri Province at the proposal of the Director of the Management Board of the Special Economic and Trade Zone Lao Bao.

2. Administrative support staff shall include:

- Office;

- Inspection;

- Specialized Departments.

3. Affiliated units.

Depending on the specific development requirements of the Special Economic and Trade Zone Lao Bao at each stage, the Director of the Management Board of the Special Economic and Trade Zone Lao Bao shall submit organizational structures for approval by the Chairman of the People's Committee of the province.

4. Staffing of the Management Board of the Special Economic and Trade Zone Lao Bao:

The staffing of the Office, Inspectorate, and specialized departments shall be state administrative staffing.

The staffing of the Management Board of the Special Economic and Trade Zone Lao Bao shall be determined by the Chairman of the People's Committee of Quang Tri Province in accordance with Decree No. 71/2003/NĐ-CP dated June 19, 2003 of the Government on decentralization in the management of civil service and public service staffing, and Decree No. 112/2004/NĐ-CP dated April 8, 2004 of the Government on the mechanism for managing staffing for public institutions.

Article 4. This Decision shall take effect 15 days after its publication in the Official Gazette. Decision No. 1528/1998/QĐ-UB dated December 15, 1998 of the People's Committee of Quang Tri Province regarding the establishment of the Management Board of the Lao Bao Trade Zone is hereby repealed.

Article 5. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, the Chairman of the People's Committee of Quang Tri Province, and the Director of the Management Board of the Special Economic and Trade Zone Lao Bao are responsible for implementing this Decision.
