Decree No. 130/2022/ND-CP amending and supplementing certain articles of Decree No. 84/2019/ND-CP dated November 14, 2019 of the Government on fertilizer management and Decree No. 94/2019/ND-CP dated December 13, 2019 of the Government detailing some provisions of the Law on Crop Production regarding seed varieties and cultivation practices.

DECREE

Amending and supplementing certain Articles of Decree No. 84/2019/NĐ-CP dated November 14, 2019 of the Government on fertilizer management, and Decree No. 94/2019/NĐ-CP dated December 13, 2019 of the Government detailing certain provisions of the Law on Crop Production regarding plant varieties and cultivation practices.

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Crop Production dated November 19, 2018;

At the proposal of the Minister of Agriculture and Rural Development;

The Government promulgates this Decree amending and supplementing certain Articles of Decree No. 84/2019/NĐ-CP dated November 14, 2019 of the Government on fertilizer management, and Decree No. 94/2019/NĐ-CP dated December 13, 2019 of the Government detailing certain provisions of the Law on Crop Production regarding plant varieties and cultivation practices.

Article 1. Amending and supplementing certain Articles of Decree No. 84/2019/NĐ-CP dated November 14, 2019 of the Government on fertilizer management (hereinafter referred to as Decree No. 84/2019/NĐ-CP).

1. Amending and supplementing Clause 2 of Article 15 as follows:

"2. Information on training and professional development certification related to fertilizers shall be reflected in the Application for Issuance of Certificate of Eligibility for Fertilizer Trading or a copy of the graduation certificate from a secondary vocational school or higher of the person directly trading fertilizers as stipulated at point c, Clause 2, Article 42 of the Law on Crop Production."

2. Repealing Clause 4, Article 14.

3. Repealing point b, Clause 3, Article 16.

4. Replacing Model No. 07 and Model No. 08 in Appendix I issued together with Decree No. 84/2019/NĐ-CP with Appendix I and Appendix II issued together with this Decree.

Article 2. Amending and supplementing certain Articles of Decree No. 94/2019/NĐ-CP dated December 13, 2019 of the Government detailing certain provisions of the Law on Crop Production regarding plant varieties and cultivation practices (hereinafter referred to as Decree No. 94/2019/NĐ-CP).

1. Amending and supplementing point a, Clause 3, Article 7 as follows:

"3. Procedures, formalities, and authority for issuing and reissuing Decision on Recognition of Plant Variety Testing Organizations:
a) Procedures, formalities, and authority for issuing Decision on Recognition of Plant Variety Testing Organizations: Organizations and individuals submit application files to the Crop Production Department. Within twenty working days from the date of receiving complete and valid application files, the Crop Production Department will organize the review of the organization's application file. If the application file meets all conditions, the Crop Production Department will issue the Decision on Recognition of Plant Variety Testing Organization according to Model No. 03.KN in Appendix V issued together with this Decree and publish the Decision on the Crop Production Department's online portal; if the application file does not meet all conditions, the Crop Production Department will notify in writing with specific reasons. In case organizations and individuals fail to complete the application file within three months from the date of receiving notification from the Crop Production Department, they must resubmit the application file in accordance with Clause 1 of this Article."

2. Repealing point c, Clause 1, Article 11.

3. Repealing point c, Clause 1, Article 12.

4. Replacing Model No. 01.XK in Appendix VIII issued together with Decree No. 94/2019/NĐ-CP with Appendix III issued together with this Decree.

Article 3. Effectiveness

This Decree takes effect from the date of issuance.

Article 4. Transitional Provisions

For applications received before the effective date of this Decree, the provisions of Decree No. 84/2019/NĐ-CP and Decree No. 94/2019/NĐ-CP shall apply.

Article 5. Responsibilities for Implementation

Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities, and relevant organizations and individuals are responsible for implementing this Decree./.
