DECISION OF THE CHAIRMAN OF THE GOVERNMENT
REGARDING THE ESTABLISHMENT OF THE STATE COMMISSION FOR ACCEPTANCE OF NATIONAL CONSTRUCTION PROJECTS
INCLUDING THE HO CHI MINH HIGHWAY, THE HA VUAN MOUNTAIN PASS TUNNEL, CAI LAN PORT, BA CHAY BRIDGE, THANH TRI BRIDGE, AND CAN THO BRIDGE
WHEREAS, pursuant to Decree No. 52/1999/NĐ-CP dated July 8, 1999 of the Government promulgating the Investment Management and Construction Regulation, and Decree No. 12/2000/NĐ-CP dated May 5, 2000 of the Government amending and supplementing certain articles of the Investment Management and Construction Regulation promulgated together with Decree No. 52/1999/NĐ-CP;
PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
CONSIDERING the proposal of the Minister of Construction regarding the establishment of the State Commission for Acceptance of the aforementioned construction projects (Circular No. 1370/BXD-GD dated July 31, 2000; Circular No. 2037/BXD-GD dated November 1, 2000), the opinion of the Ministry of Planning and Investment (Circular No. 5100 BKH/CSHT dated August 17, 2000), the Ministry of Transport (Circular No. 2746/BGTVT dated August 17, 2000; Circular No. 3683/BGTVT dated October 31, 2000), the Ministry of Finance (Circular No. 3635 TC/ĐT dated September 5, 2000), and the Ministry of Science, Technology and Environment (Circular No. 2338/BKHCNMT-CN dated August 11, 2000),
The State Commission for Acceptance of the following construction projects is hereby established: the Ho Chi Minh Highway, the Ha Van Mountain Pass Tunnel, Cai Lan Port, Can Tho Bridge, Bai Chay Bridge, and Thanh Tri Bridge. Members of the Commission:
DECISION:
Article 1. 1. Chairman of the Commission: Professor, Academician Dang Huu;
2. Deputy Chairmen of the Commission: Deputy Ministers of the Ministries of Construction, Transport, Science, Technology, and Environment;
3. Members of the Commission: Director of the National Construction Quality Control Bureau under the Ministry of Construction, Director of the National Transportation Project Quality Control and Management Bureau under the Ministry of Transport;
4. The National Construction Quality Control Bureau under the Ministry of Construction shall serve as the permanent office of the Commission.
The State Commission for Acceptance of the aforementioned construction projects shall have the following tasks:
Article 2. 1. To conduct comprehensive national acceptance of the quality of the aforementioned construction projects in accordance with the regulations of the State;
2. To inspect the activities of the project acceptance boards established by the project sponsors, the quality acceptance of products by contractors and consultants in compliance with the Investment Management and Construction Regulation and relevant technical standards and specifications;
3. To periodically and randomly inspect sections or technical stop points of the projects; if any violations affecting the quality of the projects are discovered, the Commission may require the implementing units to correct them in accordance with the regulations; if the violations are serious or the implementing units refuse to correct them, the Commission may require the implementing units to temporarily suspend work and report to the Prime Minister for instructions; all economic losses caused by the violations must be compensated by the responsible units;
4. To coordinate with the Ministry of Transport to issue working regulations for the State Commission for Acceptance of the aforementioned projects;
5. To report to the Prime Minister on the results of the State Commission's work according to a regular schedule, after completing the acceptance of each project, and to submit final reports on the completion of the State Commission's tasks for each project.
The operating costs of the State Commission for Acceptance shall be included in the total investment budget of each project. Annually, the Ministry of Transport shall be responsible for allocating funds for the State Commission for Acceptance based on the annual budget estimate, and the State Commission for Acceptance shall be responsible for settling accounts in accordance with the regulations so that the Ministry of Transport can settle accounts for each project.
Article 3. This Decision shall take effect fifteen days from the date of issuance and shall cease to be effective when the State Commission for Acceptance completes its assigned acceptance tasks for the aforementioned projects. The Ministers of the Ministries of Construction, Transport, Planning and Investment, Science, Technology, and Environment, Finance, and other related ministries, sectors, localities, and the Chairman of the State Commission for Acceptance shall be responsible for implementing this Decision./.
Article 4. This Decision shall take effect fifteen days from the date of issuance and shall cease to be effective upon completion of the acceptance tasks assigned to the State Acceptance Council for the works mentioned above. The Ministers of the Ministries of Construction, Transport, Planning and Investment, Science and Technology, Environment, Finance, and other relevant ministries, sectors, localities, and the Chairman of the State Acceptance Council are responsible for implementing this Decision./.
